L. 116–30, § 2(a), July 25, 2019, 133 Stat. 1032.)","seq_in_title":168,"parent_identifier":"/us/usc/t40/stII/ptA/ch33","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII","level":"subtitle","num":"SUBTITLE II—","heading":"PUBLIC BUILDINGS AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII/ptA","level":"part","num":"PART A—","heading":"GENERAL","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII/ptA/ch33","level":"chapter","num":"CHAPTER 33—","heading":"ACQUISITION, CONSTRUCTION, AND ALTERATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0a8247a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318\"><num value=\"3318\">§ 3318.</num><heading> Lactation room in public buildings</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a8247b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a8247c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Appropriate authority</inline>.—</heading><content>The term “appropriate authority” means the head of a Federal agency, the Architect of the Capitol, or other official authority responsible for the operation of a public building.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a8247d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Covered public building</inline>.—</heading><content>The term “covered public building” means a public building (as defined in section 3301) that is open to the public and contains a public restroom, and includes a building listed in section 6301 or 5101.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a8247e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Lactation room</inline>.—</heading><chapeau>The term “lactation room” means a hygienic place, other than a bathroom, that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a8247f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/3/A\"><num value=\"A\">(A)</num><content> is shielded from view;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a82480-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/3/B\"><num value=\"B\">(B)</num><content> is free from intrusion; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a82481-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/a/3/C\"><num value=\"C\">(C)</num><content> contains a chair, a working surface, and, if the public building is otherwise supplied with electricity, an electrical outlet.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a84b92-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Lactation Room Required</inline>.—</heading><content>Except as provided in subsection (c), the appropriate authority of a covered public building shall ensure that the building contains a lactation room that is made available for use by members of the public to express breast milk.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a84b93-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Exceptions</inline>.—</heading><chapeau>A covered public building may be excluded from the requirement in subsection (b) at the discretion of the appropriate authority if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a84b94-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/c/1\"><num value=\"1\">(1)</num><chapeau> the public building—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a84b95-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/c/1/A\"><num value=\"A\">(A)</num><content> does not contain a lactation room for employees who work in the building; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a84b96-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/c/1/B\"><num value=\"B\">(B)</num><content> does not have a room that could be repurposed as a lactation room or a space that could be made private using portable materials, at a reasonable cost; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a84b97-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/c/2\"><num value=\"2\">(2)</num><content> new construction would be required to create a lactation room in the public building and the cost of such construction is unfeasible.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a84b98-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s3318/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">No Unauthorized Entry</inline>.—</heading><content>Nothing in this section shall be construed to authorize an individual to enter a public building or portion thereof that the individual is not otherwise authorized to enter.</content>\n</subsection>\n<sourceCredit id=\"idf0a84b99-b211-11e9-9941-df2837ad0631\">(Added <ref href=\"/us/pl/116/30/s2/a\">Pub.
