L. 107–217, Aug. 21, 2002, 116 Stat. 1178.)","seq_in_title":190,"parent_identifier":"/us/usc/t40/stII/ptB/ch51","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII","level":"subtitle","num":"SUBTITLE II—","heading":"PUBLIC BUILDINGS AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII/ptB","level":"part","num":"PART B—","heading":"UNITED STATES CAPITOL","status":null,"is_section":false},{"identifier":"/us/usc/t40/stII/ptB/ch51","level":"chapter","num":"CHAPTER 51—","heading":"UNITED STATES CAPITOL BUILDINGS AND GROUNDS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0ad06ba-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109\"><num value=\"5109\">§ 5109.</num><heading> Penalties</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ad06bb-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Firearms, Dangerous Weapons, Explosives, or Incendiary Device Offenses</inline>.—</heading><content>An individual or group violating <ref href=\"/us/usc/t40/s5104/e/1\">section 5104(e)(1) of this title</ref>, or attempting to commit a violation, shall be fined under title 18, imprisoned for not more than five years, or both.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ad06bc-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Other Offenses</inline>.—</heading><content>A person violating section 5103 or 5104(b), (c), (d), (e)(2), or (f) of this title, or attempting to commit a violation, shall be fined under title 18, imprisoned for not more than six months, or both.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ad06bd-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Procedure.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ad06be-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>An action for a violation of this chapter or section 9, 9A, 9B, 9C or 14 of the Act of <date date=\"1946-07-31\">July 31, 1946</date> (ch. 707, <ref href=\"/us/stat/60/719\">60 Stat. 719</ref>, 720), including an attempt or a conspiracy to commit a violation, shall be brought by the Attorney General in the name of the United States. This chapter and sections 9, 9A, 9B, 9C and 14 do not supersede any provision of federal law or the laws of the District of Columbia. Where the conduct violating this chapter or section 9, 9A, 9B, 9C or 14 also violates federal law or the laws of the District of Columbia, both violations may be joined in a single action.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ad06bf-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Venue</inline>.—</heading><chapeau>An action under this section for a violation of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0ad06c0-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c/2/A\"><num value=\"A\">(A)</num><content> <ref href=\"/us/usc/t40/s5104/e/1\">section 5104(e)(1) of this title</ref> or for conduct that constitutes a felony under federal law or the laws of the District of Columbia shall be brought in the United States District Court for the District of Columbia; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0ad06c1-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c/2/B\"><num value=\"B\">(B)</num><content> any other section referred to in subsection (a) may be brought in the Superior Court of the District of Columbia.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ad06c2-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s5109/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Amount of penalty</inline>.—</heading><content>The penalty which may be imposed on a person convicted in an action under this subsection is the highest penalty authorized by any of the laws the defendant is convicted of violating.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idf0ad06c3-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
