<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3860c1a3-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558"><num value="558">§ 558.</num><heading> Donation of forfeited vessels</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3860c1a4-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>A vessel that is forfeited to the Federal Government may be donated, in accordance with procedures under this subtitle, to an eligible institution described in subsection (b).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3860c1a5-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b"><num value="b">(b)</num><heading> <inline class="small-caps">Eligible Institution</inline>.—</heading><chapeau>An eligible institution referred to in subsection (a) is an educational institution with a commercial fishing vessel safety program or other vessel safety, education and training program. The institution must certify to the federal officer making the donation that the program includes, at a minimum, all of the following courses in vessel safety:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1a6-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b/1"><num value="1">(1)</num><content> Vessel stability.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1a7-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b/2"><num value="2">(2)</num><content> Firefighting.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1a8-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b/3"><num value="3">(3)</num><content> Shipboard first aid.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1a9-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b/4"><num value="4">(4)</num><content> Marine safety and survival.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1aa-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/b/5"><num value="5">(5)</num><content> Seamanship rules of the road.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3860c1ab-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c"><num value="c">(c)</num><heading> <inline class="small-caps">Terms and Conditions</inline>.—</heading><chapeau>The donation of a vessel under this section shall be made on terms and conditions considered appropriate by the federal officer making the donation. All of the following terms and conditions are required:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1ac-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">No warranty</inline>.—</heading><content>The institution must accept the vessel as is, where it is, and without warranty of any kind and without any representation as to its condition or suitability for use.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1ad-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Maintenance</inline>.—</heading><content>The institution is responsible for maintaining the vessel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1ae-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Instruction only</inline>.—</heading><content>The vessel may be used only for instructing students in a vessel safety education and training program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1af-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/4"><num value="4">(4)</num><heading> <inline class="small-caps">Documentation</inline>.—</heading><content>If the vessel is eligible to be documented, it must be documented by the institution as a vessel of the United States under chapter 121 of title 46. The requirements of paragraph (5) must be noted on the permanent record of the vessel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1b0-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/5"><num value="5">(5)</num><heading> <inline class="small-caps">Disposal</inline>.—</heading><content>The institution must obtain prior approval from the Administrator of General Services before disposing of the vessel and any proceeds from disposal shall be payable to the Government.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3860c1b1-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/c/6"><num value="6">(6)</num><heading> <inline class="small-caps">Inspection or regulation</inline>.—</heading><content>The vessel shall be inspected or regulated in the same manner as a nautical school vessel under chapter 33 of title 46.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3860c1b2-56ae-11e3-9436-86e561d18d41" identifier="/us/usc/t40/s558/d"><num value="d">(d)</num><heading> <inline class="small-caps">Government Liability</inline>.—</heading><content>The Government is not liable in an action arising out of the transfer or use of a vessel transferred under this section.</content>
