</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf093d8b0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/a/2"><num value="2">(2)</num><content> the Clayton Act (<ref href="/us/usc/t15/s12">15 U.S.C. 12</ref> et seq., <ref href="/us/usc/t29/s52">29 U.S.C. 52</ref>, 53);</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idf093d8b3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/b"><num value="b">(b)</num><heading> <inline class="small-caps">Advice Required.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf093d8b4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>An executive agency shall not dispose of property to a private interest until the agency has received the advice of the Attorney General on whether the disposal to a private interest would tend to create or maintain a situation inconsistent with antitrust law.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf093d8b5-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Exception</inline>.—</heading><chapeau>This section does not apply to disposal of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf093d8b6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/b/2/A"><num value="A">(A)</num><content> real property, if the estimated fair market value is less than $3,000,000; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf093d8b7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/b/2/B"><num value="B">(B)</num><content> personal property (other than a patent, process, technique, or invention), if the estimated fair market value is less than $3,000,000.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idf093d8b8-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/c"><num value="c">(c)</num><heading> <inline class="small-caps">Notice to Attorney General.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf093d8b9-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>An executive agency that contemplates disposing of property to a private interest shall promptly transmit notice of the proposed disposal, including probable terms and conditions, to the Attorney General.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf093d8ba-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Copy</inline>.—</heading><content>Except for the General Services Administration, an executive agency that transmits notice under paragraph (1) shall simultaneously transmit a copy of the notice to the Administrator of General Services.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf093d8bb-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/d"><num value="d">(d)</num><heading> <inline class="small-caps">Advice From Attorney General</inline>.—</heading><content>Within a reasonable time, not later than 60 days, after receipt of notice under subsection (c), the Attorney General shall advise the Administrator and any interested executive agency whether, so far as the Attorney General can determine, the proposed disposition would tend to create or maintain a situation inconsistent with antitrust law.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf093ffcc-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/e"><num value="e">(e)</num><heading> <inline class="small-caps">Request for Information</inline>.—</heading><chapeau>On request from the Attorney General, the head of an executive agency shall furnish information the agency possesses that the Attorney General determines is appropriate or necessary to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf093ffcd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/e/1"><num value="1">(1)</num><content> give advice required by this section; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf093ffce-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/e/2"><num value="2">(2)</num><content> determine whether any other disposition or proposed disposition of surplus property violates antitrust law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf093ffcf-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s559/f"><num value="f">(f)</num><heading> <inline class="small-caps">No Effect on Antitrust Law</inline>.—</heading><content>This subtitle does not impair, amend, or modify antitrust law or limit or prevent application of antitrust law to a person acquiring property under this subtitle.</content>
