<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf09845cf-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591"><num value="591">§ 591.</num><heading> Purchase of electricity</heading><subsection style="-uslm-lc:I11" class="indent0" id="idf09845d0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Limitation on Use of Amounts</inline>.—</heading><chapeau>A department, agency, or instrumentality of the Federal Government may not use amounts appropriated or made available by any law to purchase electricity in a manner inconsistent with state law governing the provision of electric utility service, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf09845d1-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/a/1"><num value="1">(1)</num><content> state utility commission rulings; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf09845d2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/a/2"><num value="2">(2)</num><content> electric utility franchises or service territories established under state statute, state regulation, or state-approved territorial agreements.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idf09845d3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exceptions.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf09845d4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Energy savings</inline>.—</heading><content>This section does not preclude the head of a federal agency from entering into a contract under section 801 of the National Energy Conservation Policy Act (<ref href="/us/usc/t42/s8287">42 U.S.C. 8287</ref>).</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0986ce7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s591/b/2/B"><num value="B">(B)</num><content> purchasing electricity from any provider if the Secretary finds that the utility having the applicable state-approved franchise (or other service authorization) is unwilling or unable to meet unusual standards of service reliability that are necessary for purposes of national defense.</content>
