The policies must be consistent with this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09b533a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Executive Agency Responsibility.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b533b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The head of an executive agency that has foreign excess property is responsible for the disposal of the property.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b533c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Conformance to policies</inline>.—</heading><chapeau>In carrying out functions under this chapter, the head of an executive agency shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b533d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/2/A\"><num value=\"A\">(A)</num><content> use the policies prescribed by the President under subsection (a) for guidance; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b533e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/2/B\"><num value=\"B\">(B)</num><content> dispose of foreign excess property in a manner that conforms to the foreign policy of the United States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b533f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Delegation of authority</inline>.—</heading><chapeau>The head of an executive agency may—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b5340-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/3/A\"><num value=\"A\">(A)</num><content> delegate authority conferred by this chapter to an official in the agency or to the head of another executive agency; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b5341-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/3/B\"><num value=\"B\">(B)</num><content> authorize successive redelegation of authority conferred by this chapter.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b7a52-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Employment of personnel</inline>.—</heading><chapeau>As necessary to carry out this chapter, the head of an executive agency may—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b7a53-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/4/A\"><num value=\"A\">(A)</num><content> appoint and fix the pay of personnel in the United States, subject to chapters 33 and 51 and subchapter III of chapter 53 of title 5; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b7a54-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/b/4/B\"><num value=\"B\">(B)</num><content> appoint personnel outside the States of the United States and the District of Columbia, without regard to chapter 33 of title 5.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09b7a55-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Special Responsibilities of Secretary of State.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b7a56-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Use of foreign currencies and credits</inline>.—</heading><chapeau>The Secretary of State may use foreign currencies and credits acquired by the United States under <ref href=\"/us/usc/t40/s704/b/2\">section 704(b)(2) of this title</ref>—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b7a57-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c/1/A\"><num value=\"A\">(A)</num><content> to carry out the Mutual Educational and Cultural Exchange Act of 1961 (<ref href=\"/us/usc/t22/s2451\">22 U.S.C. 2451</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b7a58-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c/1/B\"><num value=\"B\">(B)</num><content> to carry out the Foreign Service Buildings Act, 1926 (<ref href=\"/us/usc/t22/s292\">22 U.S.C. 292</ref> et seq.); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09b7a59-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c/1/C\"><num value=\"C\">(C)</num><content> to pay other governmental expenses payable in local currencies.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09b7a5a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s701/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Renewal of certain agreements</inline>.—</heading><content>Except as otherwise directed by the President, the Secretary of State shall continue to perform functions under agreements in effect on <date date=\"1949-07-01\">July 1, 1949</date>, related to the disposal of foreign excess property. The Secretary of State may amend, modify, and renew the agreements. Foreign currencies or credits the Secretary of State acquires under the agreements shall be administered in accordance with procedures that the Secretary of the Treasury may establish.
