L. 107–217, Aug. 21, 2002, 116 Stat. 1126.)","seq_in_title":91,"parent_identifier":"/us/usc/t40/stI/ch7","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI","level":"subtitle","num":"SUBTITLE I—","heading":"FEDERAL PROPERTY AND ADMINISTRATIVE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch7","level":"chapter","num":"CHAPTER 7—","heading":"FOREIGN EXCESS PROPERTY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf09bc892-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704\"><num value=\"704\">§ 704.</num><heading> Other methods of disposal</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09bc893-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Foreign excess property not disposed of under section 702 or 703 of this title may be disposed of as provided in this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09bc894-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Methods of Disposal.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09bc895-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Sale, exchange, lease, or transfer</inline>.—</heading><content>The head of an executive agency may dispose of foreign excess property by sale, exchange, lease, or transfer, for cash, credit or other property, with or without warranty, under terms and conditions the head of the executive agency considers proper.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09bc896-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Exchange for foreign currency or credit</inline>.—</heading><chapeau>If the head of an executive agency determines that it is in the interest of the United States, foreign excess property may be exchanged for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09bc897-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b/2/A\"><num value=\"A\">(A)</num><content> foreign currencies or credits; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf09bc898-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b/2/B\"><num value=\"B\">(B)</num><content> substantial benefits or the discharge of claims resulting from the compromise or settlement of claims in accordance with law.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf09bc899-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Abandonment, destruction, or donation</inline>.—</heading><content>The head of an executive agency may authorize the abandonment, destruction, or donation of foreign excess property if the property has no commercial value or if estimated costs of care and handling exceed the estimated proceeds from sale.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09bc89a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Advertising</inline>.—</heading><content>The head of an executive agency may dispose of foreign excess property without advertising if the head of the executive agency finds that disposal without advertising is the most practicable and advantageous means for the Federal Government to dispose of the property.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf09befab-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s704/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Transfer of Title</inline>.—</heading><content>The head of an executive agency may execute documents to transfer title or other interests in, and take other action necessary or proper to dispose of, foreign excess property.</content>\n</subsection>\n<sourceCredit id=\"idf09befac-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
