<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb466dfce-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113"><num value="113">§ 113.</num><heading> Responsible source</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this subtitle, the term “responsible source” means a prospective contractor that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfcf-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/1"><num value="1">(1)</num><content> has adequate financial resources to perform the contract or the ability to obtain those resources;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd0-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/2"><num value="2">(2)</num><content> is able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Government business commitments;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd1-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/3"><num value="3">(3)</num><content> has a satisfactory performance record;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd2-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/4"><num value="4">(4)</num><content> has a satisfactory record of integrity and business ethics;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd3-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/5"><num value="5">(5)</num><content> has the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain the organization, experience, controls, and skills;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd4-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/6"><num value="6">(6)</num><content> has the necessary production, construction, and technical equipment and facilities, or the ability to obtain the equipment and facilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466dfd5-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s113/7"><num value="7">(7)</num><content> is otherwise qualified and eligible to receive an award under applicable laws and regulations.</content>
