<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb466e017-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152"><num value="152">§ 152.</num><heading> Competitive procedures</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In division C, the term “competitive procedures” means procedures under which an executive agency enters into a contract pursuant to full and open competition. The term also includes—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb466e018-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/1"><num value="1">(1)</num><content> procurement of architectural or engineering services conducted in accordance with chapter 11 of title 40;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb466e019-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/2"><num value="2">(2)</num><content> the competitive selection of basic research proposals resulting from a general solicitation and the peer review or scientific review (as appropriate) of those proposals;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb469290a-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/3"><num value="3">(3)</num><chapeau> the procedures established by the Administrator of General Services for the multiple awards schedule program of the General Services Administration if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb469290b-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/3/A"><num value="A">(A)</num><content> participation in the program has been open to all responsible sources; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb469290c-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/3/B"><num value="B">(B)</num><content> orders and contracts under those procedures result in the lowest overall cost alternative to meet the needs of the Federal Government;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb469290d-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/4"><num value="4">(4)</num><content> procurements conducted in furtherance of section 15 of the Small Business Act (<ref href="/us/usc/t15/s644">15 U.S.C. 644</ref>) as long as all responsible business concerns that are entitled to submit offers for those procurements are permitted to compete; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb469290e-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s152/5"><num value="5">(5)</num><content> a competitive selection of research proposals resulting from a general solicitation and peer review or scientific review (as appropriate) solicited pursuant to section 9 of that Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>).</content>
