<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7d45db49-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709"><num value="1709">§ 1709.</num><heading> Contracting functions performed by Federal personnel</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7d45db4a-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/a"><num value="a">(a)</num><heading> <inline class="small-caps">Covered Personnel</inline>.—</heading><chapeau>Personnel referred to in subsection (b) are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7d45db4b-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/a/1"><num value="1">(1)</num><content> an employee, as defined in <ref href="/us/usc/t5/s2105">section 2105 of title 5</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d45db4c-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/a/2"><num value="2">(2)</num><content> a member of the armed forces; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d45db4d-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/a/3"><num value="3">(3)</num><content> an individual assigned to a Federal agency pursuant to subchapter VI of chapter 33 of title 5.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7d45db4e-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/b"><num value="b">(b)</num><heading> <inline class="small-caps">Limitation on Payment for Advisory and Assistance Services</inline>.—</heading><chapeau>No individual who is not an individual described in subsection (a) may be paid by an executive agency for services to conduct evaluations or analyses of any aspect of a proposal submitted for an acquisition unless personnel described in subsection (a) with adequate training and capabilities to perform the evaluations and analyses are not readily available in the agency or another Federal agency. When administering this subsection, the head of each executive agency shall determine in accordance with standards and procedures prescribed in the Federal Acquisition Regulation whether—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7d45db4f-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/b/1"><num value="1">(1)</num><content> a sufficient number of personnel described in subsection (a) in the agency or another Federal agency are readily available to perform a particular evaluation or analysis for the head of the executive agency making the determination; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d45db50-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/b/2"><num value="2">(2)</num><content> the readily available personnel have the training and capabilities necessary to perform the evaluation or analysis.</content>
</paragraph>

<subsection style="-uslm-lc:I11" class="indent0" id="id7d45db51-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1709/c"><num value="c">(c)</num><heading> <inline class="small-caps">Certain Relationship Not Affected</inline>.—</heading><content>This section does not affect the relationship between the Federal Government and a Federally funded research and development center.</content>
