and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id649dc729-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/a/2\"><num value=\"2\">(2)</num><content> greater than the simplified acquisition threshold but not greater than $5,000,000 for which the contracting officer reasonably expects, based on the nature of the property or services sought and on market research, that offers will include only commercial products or commercial services.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id649dc72a-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Prohibition on Dividing Purchases</inline>.—</heading><content>A proposed purchase or contract for an amount above the simplified acquisition threshold may not be divided into several purchases or contracts for lesser amounts to use the simplified acquisition procedures required by subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id649dc72b-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Promotion of Competition Required</inline>.—</heading><content>When using simplified acquisition procedures, the head of an executive agency shall promote competition to the maximum extent practicable.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id649dc72c-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Consideration of Offers Timely Received</inline>.—</heading><content>The simplified acquisition procedures contained in the Federal Acquisition Regulation shall include a requirement that a contracting officer consider each responsive offer timely received from an eligible offeror.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id649dc72d-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Special Rules for Commercial Products and Commercial Services</inline>.—</heading><chapeau>The Federal Acquisition Regulation shall provide that an executive agency using special simplified procedures to purchase commercial products or commercial services—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id649dc72e-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/e/1\"><num value=\"1\">(1)</num><content> shall publish a notice in accordance with <ref href=\"/us/usc/t41/s1708\">section 1708 of this title</ref> and, as provided in <ref href=\"/us/usc/t41/s1708/c/4\">section 1708(c)(4) of this title</ref>, permit all responsible sources to submit a bid, proposal, or quotation (as appropriate) that the agency shall consider;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id649dc72f-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/e/2\"><num value=\"2\">(2)</num><content> may not conduct the purchase on a sole source basis unless the need to do so is justified in writing and approved in accordance with <ref href=\"/us/usc/t10/s3204/e\">section 3204(e) of title 10</ref> or <ref href=\"/us/usc/t41/s3304/e\">section 3304(e) of this title</ref>, as applicable; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id649dc730-cc52-11ee-8f35-f48966c205bc\" identifier=\"/us/usc/t41/s1901/e/3\"><num value=\"3\">(3)</num><content> shall include in the contract file a written description of the procedures used in awarding the contract and the number of offers received.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id649dc731-cc52-11ee-8f35-f48966c205bc\">(<ref href=\"/us/pl/111/350/s3\">Pub. The Administrator shall carry out the program in accordance with this section, through multiple contracts with multiple commercial e-commerce portal providers, and shall design the program to be implemented in phases with the objective of enabling Government-wide use of such portals.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Use of Program</inline>.—</heading><content>The head of a department or agency may procure, as appropriate, commercial products for the department or agency using the program established pursuant to subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Implementation and Reporting Requirements</inline>.—</heading><chapeau>The Director of the Office of Management and Budget, in consultation with the Administrator and the heads of other relevant departments and agencies, shall carry out the implementation phases set forth in, and submit to the appropriate congressional committees the items of information required by, the following paragraphs:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Phase i: implementation plan</inline>.—</heading><content>Not later than 90 days after the date of the enactment of this Act [<date date=\"2017-12-12\">Dec. 12, 2017</date>], an implementation plan and schedule for carrying out the program established pursuant to subsection (a), including a discussion and recommendations regarding whether any changes to, or exemptions from, laws that set forth policies, procedures, requirements, or restrictions for the procurement of property or services by the Federal Government are necessary for effective implementation of this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Phase ii: market analysis and consultation</inline>.—</heading><chapeau>Not later than one year after the date of the submission of the implementation plan and schedule required under paragraph (1), recommendations for any changes to, or exemptions from, laws necessary for effective implementation of this section, and information on the results of the following actions:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> Market analysis and initial communications with potential commercial e-commerce portal providers on technical considerations of how the portals function (including the use of standard terms and conditions of the portals by the Government), the degree of customization that can occur without creating a Government-unique portal, the measures necessary to address the considerations for supplier and product screening specified in subsection (e), security of data, considerations pertaining to nontraditional Government contractors, and potential fees, if any, to be charged by the Administrator, the portal provider, or the suppliers for participation in the program established pursuant to subsection (a).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> Consultation with affected departments and agencies about their unique procurement needs, such as supply chain risks for health care products, information technology, software, or any other category determined necessary by the Administrator.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> An assessment of the products or product categories that are suitable for purchase on the commercial e-commerce portals.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> An assessment of the precautions necessary to safeguard any information pertaining to the Federal Government, especially precautions necessary to protect against national security or cybersecurity threats.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> A review of standard terms and conditions of commercial e-commerce portals in the context of Government requirements.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> An assessment of the impact on existing programs, including schedules, set-asides for small business concerns, and other preference programs.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Phase iii: program implementation guidance</inline>.—</heading><content>Not later than two years after the date of the submission of the implementation plan and schedule required under paragraph (1), guidance to implement and govern the use of the program established pursuant to subsection (a), including protocols for oversight of procurement through the program, and compliance with laws pertaining to supplier and product screening requirements, data security, and data analytics.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Additional implementation phases</inline>.—</heading><content>A description of additional implementation phases, as determined by the Administrator, that includes a selection of agencies to participate in any such additional implementation phase (which may include the award of contracts to multiple commercial e-commerce portal providers).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Additional testing</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this paragraph [<date date=\"2021-12-27\">Dec. 27, 2021</date>], the Administrator shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> begin testing commercial e-commerce portal models (other than any such model selected for the initial proof of concept) identified pursuant to paragraph (2); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> submit to the congressional defense committees [Committees on Armed Services and Appropriations of the Senate and the House of Representatives], the Committee on Oversight and Reform [now Committee on Oversight and Accountability] of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate a report that includes—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> a summary of the assessments conducted under paragraph (2) with respect to a commercial e-commerce portal model identified pursuant to such paragraph;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> a list of the types of commercial products that could be procured using models tested pursuant to subparagraph (A);</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> an estimate of the amount that could be spent by the head of a department or agency under the program, disaggregated by type of commercial e-commerce portal model; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> an update on the models tested pursuant to subparagraph (A) and a timeline for completion of such testing.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><chapeau>Upon completion of testing conducted under paragraph (5) and before taking any action with respect to the commercial e-commerce portal models tested, the Administrator of General Services shall submit to the congressional defense committees [Committees on Armed Services and Appropriations of the Senate and the House of Representatives], the Committee on Oversight and Reform [now Committee on Oversight and Accountability] of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate, a report on the results of such testing that includes—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><chapeau> an assessment and comparison of commercial e-commerce portal models with respect to—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> price and quality of the commercial products supplied by each commercial e-commerce portal model;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> supplier reliability and service;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> safeguards for the security of Government information and third-party supplier proprietary information;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> protections against counterfeit commercial products;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> supply chain risks, particularly with respect to complex commercial products; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vi\">“(vi)</num><content> overall adherence to Federal procurement rules and policies; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> an analysis of the costs and benefits of the convenience to the Federal Government of procuring commercial products from each such commercial e-commerce portal model.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Considerations for Commercial e-commerce Portals</inline>.—</heading><content>The Administrator shall consider commercial e-commerce portals for use under the program established pursuant to subsection (a) that are widely used in the private sector and have or can be configured to have features that facilitate the execution of program objectives, including features related to supplier and product selection that are frequently updated, an assortment of product and supplier reviews, invoicing payment, and customer service.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Information on Suppliers, Products, and Purchases.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Supplier participation and product screening</inline>.—</heading><content>The Administrator shall provide or ensure electronic availability to a commercial e-commerce portal provider awarded a contract pursuant to subsection (a) on a periodic basis information necessary to ensure compliance with laws pertaining to supplier and product screening as identified during implementation phase III, as described in subsection (c)(3).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Provision of order information</inline>.—</heading><content>The Administrator shall require each commercial e-commerce portal provider awarded a contract pursuant to subsection (a) to provide order information as determined by the Administrator during implementation phase II, as described in subsection (c)(2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Relationship to Other Provisions of Law.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> All laws, including laws that set forth policies, procedures, requirements, or restrictions for the procurement of property or services by the Federal Government, apply to the program established pursuant to subsection (a) unless otherwise provided in this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> A procurement of a product made through a commercial e-commerce portal under the program established pursuant to subsection (a) is deemed to be an award of a prime contract for purposes of the goals established under section 15(g) of the Small Business Act (<ref href=\"/us/usc/t15/s644/g\">15 U.S.C. 644(g)</ref>), if the purchase is from a supplier that is a small business concern.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> Nothing in this section shall be construed as limiting the authority of a department or agency to restrict competition to small business concerns.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> Nothing in this section shall be construed as limiting the applicability of <ref href=\"/us/usc/t31/s1341\">section 1341 of title 31</ref>, United States Code (popularly referred to as the Anti-Deficiency Act).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><chapeau> A procurement of a product made through a commercial e-commerce portal under the program established pursuant to subsection (a) is deemed to satisfy requirements for full and open competition pursuant to sections 3201 through 3205 of title 10, United States Code, and <ref href=\"/us/usc/t41/s3301\">section 3301 of title 41</ref>, United States Code, if—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> there are offers from two or more suppliers of such a product or similar product with substantially the same physical, functional, or performance characteristics on the online marketplace; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the Administrator establishes procedures to implement subparagraph (A) and notifies Congress at least 30 days before implementing such procedures.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Use of Commercial Practices and Standard Terms and Conditions</inline>.—</heading><content>A procurement of a product through a commercial e-commerce portal used under the program established pursuant to subsection (a) shall be made, to the maximum extent practicable, under the standard terms and conditions of the portal relating to purchasing on the portal.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"h\">“(h)</num><heading> <inline class=\"small-caps\">Disclosure, Protection, and Use of Information</inline>.—</heading><chapeau>In any contract awarded to a commercial e-commerce portal provider pursuant to subsection (a), the Administrator shall require that the provider—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> agree not to sell or otherwise make available to any third party any information pertaining to a product ordered by the Federal Government through the commercial e-commerce portal in a manner that identifies the Federal Government, or any of its departments or agencies, as the purchaser, except if the information is needed to process or deliver an order or the Administrator provides written consent;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> agree to take the necessary precautions to safeguard any information pertaining to the Federal Government, especially precautions necessary to protect against national security or cybersecurity threats; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> agree not to use, for pricing, marketing, competitive, or other purposes, any information, including any Government-owned data, such as purchasing trends or spending habits, related to a product from a third-party supplier featured on the commercial e-commerce portal or the transaction of such product, except as necessary to comply with the requirements of the program established in subsection (a).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">Simplified Acquisition Threshold</inline>.—</heading><content>A procurement through a commercial e-commerce portal used under the program established pursuant to subsection (a) shall not exceed the simplified acquisition threshold in <ref href=\"/us/usc/t41/s134\">section 134 of title 41</ref>, United States Code.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"j\">“(j)</num><heading> <inline class=\"small-caps\">Comptroller General Assessments.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Assessment of implementation plan</inline>.—</heading><content>Not later than 90 days after the Director of the Office of Management and Budget submits the implementation plan described in subsection (c)(1) to the appropriate congressional committees, the Comptroller General of the United States shall submit to the appropriate congressional committees an assessment of the plan, including any other matters the Comptroller General considers relevant to the plan.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Assessment of program implementation</inline>.—</heading><chapeau>Not later than three years after the first contract with a commercial e-commerce portal provider is awarded pursuant to subsection (a), the Comptroller General of the United States shall submit to the appropriate congressional committees a report on the challenges and benefits the General Services Administration and participating departments and agencies observe regarding implementation of the program established pursuant to subsection (a). The report shall include the following elements:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> A description of the acquisition of the commercial e-commerce portals (including the extent to which the portals had to be configured or otherwise modified to meet the needs of the program) costs, and the implementation schedule.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> A description of participation by suppliers, with particular attention to those described under subsection (e), that have registered or that have sold goods with at least one commercial e-commerce portal provider, including numbers, categories, and trends.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> The effect, if any, of the program on the ability of agencies to meet goals established for suppliers and products described under subsection (e), including goals established under section 15(g) of the Small Business Act (<ref href=\"/us/usc/t15/s644/g\">15 U.S.C. 644(g)</ref>).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> A discussion of the limitations, if any, to participation by suppliers in the program.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> Any other matters the Comptroller General considers relevant to report.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"k\">“(k)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Administrator</inline>.—</heading><content>The term ‘Administrator’ means the Administrator of General Services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Appropriate congressional committees</inline>.—</heading><chapeau>The term ‘appropriate congressional committees’ means the following:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> The Committees on Armed Services of the Senate and House of Representatives.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> The Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform [now Committee on Oversight and Accountability] of the House of Representatives.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> The Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Commercial e-commerce portal</inline>.—</heading><content>The term ‘commercial e-commerce portal’ means a commercial solution providing for the purchase of commercial products aggregated, distributed, sold, or manufactured via an online portal. The term does not include an online portal managed by the Government for, or predominantly for use by, Government agencies.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Commercial product</inline>.—</heading><content>The term ‘commercial product’ means a commercially available off-the-shelf item, as defined in <ref href=\"/us/usc/t41/s104\">section 104 of title 41</ref>, United States Code, except the term does not include services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Small business concern</inline>.—</heading><content>The term ‘small business concern’ has the meaning given such term under section 3 of the Small Business Act (<ref href=\"/us/usc/t15/s632\">15 U.S.C. 632</ref>).”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"119-73","currency_date":"2026-01-23","congress":119,"law_num":73,"excluded_laws":[],"update_num":null,"seq":370,"is_partial":false,"caveat":null,"titles_affected":["01","03","05","06","10","14","15","16","17","18","20","21","22","28","29","31","32","33","34","36","37","38","39","40","41","42","43","46","48","49","50","51","52","54"],"ingested_titles":[]},"served_from":{"label":"119-73","currency_date":"2026-01-23","congress":119,"law_num":73,"excluded_laws":[],"update_num":null,"seq":370,"is_partial":false,"caveat":null,"titles_affected":["01","03","05","06","10","14","15","16","17","18","20","21","22","28","29","31","32","33","34","36","37","38","39","40","41","42","43","46","48","49","50","51","52","54"],"ingested_titles":[]},"content_first_seen":{"label":"118-34","currency_date":"2023-12-26","congress":118,"law_num":34,"excluded_laws":[],"update_num":null,"seq":317,"is_partial":false,"caveat":null,"titles_affected":["01","02","05","06","08","10","15","16","18","19","20","22","23","24","28","29","32","33","36","37","38","39","40","41","42","44","46","47","48","49","50","51"],"ingested_titles":[]},"is_exact":true,"note":null}
