<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8210ef96-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902"><num value="1902">§ 1902.</num><heading> Procedures applicable to purchases below micro-purchase threshold</heading><subsection style="-uslm-lc:I11" class="indent0" id="id8210ef97-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id8210ef98-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/a/1"><num value="1">(1)</num><content> Except as provided in paragraph (2) of this subsection, for purposes of this section, the micro-purchase threshold is $10,000.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8210ef99-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/a/2"><num value="2">(2)</num><chapeau> For purposes of this section, the micro-purchase threshold for procurement activities administered under sections 6303 through 6305 of title 31 by institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1001/a">20 U.S.C. 1001(a)</ref>), or related or affiliated nonprofit entities, or by nonprofit research organizations or independent research institutes is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8210ef9a-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/a/2/A"><num value="A">(A)</num><content> $10,000; or</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8210ef9c-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/b"><num value="b">(b)</num><heading> Compliance With Certain Requirements and Nonapplicability of Certain Authority.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id8210ef9d-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Compliance with certain requirements</inline>.—</heading><content>The head of each executive agency shall ensure that procuring activities of that agency, when awarding a contract with a price exceeding the micro-purchase threshold, comply with the requirements of section 8(a) of the Small Business Act (<ref href="/us/usc/t15/s637/a">15 U.S.C. 637(a)</ref>) and section 7102 of the Federal Acquisition Streamlining Act of 1994 (<ref href="/us/pl/103/355">Public Law 103–355</ref>, <ref href="/us/usc/t15/s644">15 U.S.C. 644</ref> note).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8210ef9e-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Nonapplicability of certain authority</inline>.—</heading><content>The authority under part 13.106(a)(1) of the Federal Acquisition Regulation (48 C.F.R. 13.106(a)(1)), as in effect on <date date="1993-11-18">November 18, 1993</date>, to make purchases without securing competitive quotations does not apply to a purchase with a price exceeding the micro-purchase threshold.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8210ef9f-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/c"><num value="c">(c)</num><heading> <inline class="small-caps">Nonapplicability of Certain Provisions</inline>.—</heading><content>An executive agency purchase with an anticipated value of the micro-purchase threshold or less is not subject to section 15(j) of the Small Business Act (<ref href="/us/usc/t15/s644/j">15 U.S.C. 644(j)</ref>) and chapter 83 of this title.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id821116b0-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/d"><num value="d">(d)</num><heading> <inline class="small-caps">Purchases Without Competitive Quotations</inline>.—</heading><content>A purchase with a price not greater than the micro-purchase threshold may be made without obtaining competitive quotations if an employee of an executive agency or a member of the armed forces, authorized to do so, determines that the price for the purchase is reasonable.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id821116b1-cd47-11e8-a82c-a501d04d748c" identifier="/us/usc/t41/s1902/e"><num value="e">(e)</num><heading> <inline class="small-caps">Equitable Distribution</inline>.—</heading><content>Purchases with a price not greater than the micro-purchase threshold shall be distributed equitably among qualified suppliers.</content>
