<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb41d65b0-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903"><num value="1903">§ 1903.</num><heading> Special emergency procurement authority</heading><subsection style="-uslm-lc:I11" class="indent0" id="idb41d65b1-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/a"><num value="a">(a)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><chapeau>The authorities provided in subsections (b) and (c) apply with respect to a procurement of property or services by or for an executive agency that the head of the executive agency determines are to be used—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb41d65b2-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/a/1"><num value="1">(1)</num><content> in support of a contingency operation (as defined in <ref href="/us/usc/t10/s101/a">section 101(a) of title 10</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d65b3-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/a/2"><num value="2">(2)</num><content> to facilitate the defense against or recovery from cyber, nuclear, biological, chemical, or radiological attack against the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d65b4-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/a/3"><num value="3">(3)</num><content> in support of a request from the Secretary of State or the Administrator of the United States Agency for International Development to facilitate the provision of international disaster assistance pursuant to chapter 9 of part I of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2292">22 U.S.C. 2292</ref> et seq.); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8cc5-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/a/4"><num value="4">(4)</num><content> in support of an emergency or major disaster (as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5122">42 U.S.C. 5122</ref>)).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb41d8cc6-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b"><num value="b">(b)</num><heading> <inline class="small-caps">Increased Thresholds and Limitation</inline>.—</heading><chapeau>For a procurement to which this section applies under subsection (a)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8cc7-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/1"><num value="1">(1)</num><chapeau> the amount specified in section 1902(a), (d), and (e) of this title shall be deemed to be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8cc8-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/1/A"><num value="A">(A)</num><content> $15,000 in the case of a contract to be awarded and performed, or purchase to be made, in the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8cc9-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/1/B"><num value="B">(B)</num><content> $25,000 in the case of a contract to be awarded and performed, or purchase to be made, outside the United States;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8cca-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/2"><num value="2">(2)</num><chapeau> the term “simplified acquisition threshold” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8ccb-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/2/A"><num value="A">(A)</num><content> $750,000 in the case of a contract to be awarded and performed, or purchase to be made, in the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8ccc-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/2/B"><num value="B">(B)</num><content> $1,500,000 in the case of a contract to be awarded and performed, or purchase to be made, outside the United States; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8ccd-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/b/3"><num value="3">(3)</num><content> the $5,000,000 limitation in sections 1901(a)(2) and 3305(a)(2) of this title and <ref href="/us/usc/t10/s2304/g/1/B">section 2304(g)(1)(B) of title 10</ref> is deemed to be $10,000,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb41d8cce-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/c"><num value="c">(c)</num><heading> <inline class="small-caps">Authority To Treat Property or Service as Commercial Product or Commercial Service.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8ccf-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The head of an executive agency carrying out a procurement of property or a service to which this section applies under subsection (a)(2) may treat the property or service as a commercial product or a commercial service for the purpose of carrying out the procurement.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb41d8cd0-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Certain contracts not exempt from standards or requirements</inline>.—</heading><chapeau>A contract in an amount of more than $15,000,000 that is awarded on a sole source basis for a product or service treated as a commercial product or a commercial service under paragraph (1) is not exempt from—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8cd1-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/c/2/A"><num value="A">(A)</num><content> cost accounting standards prescribed under <ref href="/us/usc/t41/s1502">section 1502 of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb41d8cd2-3b2b-11eb-ae8c-f6eb835499e1" identifier="/us/usc/t41/s1903/c/2/B"><num value="B">(B)</num><content> cost or pricing data requirements (commonly referred to as truth in negotiating) under chapter 35 of this title and <ref href="/us/usc/t10/s2306a">section 2306a of title 10</ref>.</content>
