</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7d484c23-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/b"><num value="b">(b)</num><heading> Application.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c24-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided in paragraph (2), the requirement for adjustment under subsection (c) applies to a dollar threshold that is specified in law as a factor in defining the scope of the applicability of a policy, procedure, requirement, or restriction provided in that law to the procurement of property or services by an executive agency, as the Council determines.</content>
</paragraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c29-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Relationship to other inflation adjustment authorities</inline>.—</heading><content>This section supersedes the applicability of other provisions of law that provide for the adjustment of a dollar threshold that is adjustable under this section.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id7d484c2a-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c"><num value="c">(c)</num><heading> Requirement for Periodic Adjustment.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c2b-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Baseline constant dollar value</inline>.—</heading><chapeau>For purposes of paragraph (2), the baseline constant dollar value for a dollar threshold—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c2c-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c/1/A"><num value="A">(A)</num><content> in effect on <date date="2000-10-01">October 1, 2000</date>, that was first specified in a law that took effect on or before <date date="2000-10-01">October 1, 2000</date>, is the <date date="2000-10-01">October 1, 2000</date>, constant dollar value of that dollar threshold; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c2d-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c/1/B"><num value="B">(B)</num><content> specified in a law that takes effect after <date date="2000-10-01">October 1, 2000</date>, is the constant dollar value of that threshold as of the effective date of that dollar threshold pursuant to that law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c2e-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Adjustment</inline>.—</heading><content>On October 1 of each year evenly divisible by 5, the Council shall adjust each acquisition-related dollar threshold provided by law, as described in subsection (b)(1), to the baseline constant dollar value of that threshold.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c2f-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Exclusive means of adjustment</inline>.—</heading><content>A dollar threshold adjustable under this section shall be adjusted only as provided in this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7d484c30-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/d"><num value="d">(d)</num><heading> <inline class="small-caps">Publication</inline>.—</heading><content>The Council shall publish a notice of the adjusted dollar thresholds under this section in the Federal Register. The thresholds take effect on the date of publication.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7d484c31-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e"><num value="e">(e)</num><heading> <inline class="small-caps">Calculation</inline>.—</heading><chapeau>An adjustment under this section shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c32-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/1"><num value="1">(1)</num><content> calculated on the basis of changes in the Consumer Price Index for all-urban consumers published monthly by the Secretary of Labor; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c33-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/2"><num value="2">(2)</num><chapeau> rounded, in the case of a dollar threshold that as calculated under paragraph (1) is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c34-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/2/A"><num value="A">(A)</num><content> less than $10,000, to the nearest $500;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c35-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/2/B"><num value="B">(B)</num><content> not less than $10,000, but less than $100,000, to the nearest $5,000;</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c36-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/2/C"><num value="C">(C)</num><content> not less than $100,000, but less than $1,000,000, to the nearest $50,000;</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c37-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/e/2/D"><num value="D">(D)</num><content> not less than $1,000,000, but less than $10,000,000, to the nearest $500,000;</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id7d484c3b-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f"><num value="f">(f)</num><heading> Petition for Inclusion of Omitted Threshold.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c3c-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Petition submitted to administrator</inline>.—</heading><content>A person may request adjustment of a dollar threshold adjustable under this section that is not included in a notice of adjustment published under subsection (d) by submitting a petition for adjustment to the Administrator.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c3d-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Actions of administrator</inline>.—</heading><chapeau>On receipt of a petition for adjustment of a dollar threshold under paragraph (1), the Administrator—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c3e-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f/2/A"><num value="A">(A)</num><content> shall determine, in writing, whether the dollar threshold is required to be adjusted under this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d484c3f-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f/2/B"><num value="B">(B)</num><content> on determining that it should be adjusted, shall publish in the Federal Register a revised notice of the adjustment dollar thresholds under this section that includes the adjustment of the dollar threshold covered by the petition.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d484c40-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s1908/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Effective date of adjustment by petition</inline>.—</heading><content>The adjustment of a dollar threshold pursuant to a petition under this subsection takes effect on the date the revised notice adding the adjustment under paragraph (2)(B) is published.</content>
