<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac86962d-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301"><num value="6301">§ 6301.</num><heading> Authorization requirement</heading><subsection style="-uslm-lc:I11" class="indent0" id="idac86962e-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>A contract or purchase on behalf of the Federal Government shall not be made unless the contract or purchase is authorized by law or is under an appropriation adequate to its fulfillment.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idac86962f-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b"><num value="b">(b)</num><heading> Exception.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="idac869630-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><chapeau>In this subsection, the term “defined Secretary” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac869631-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/1/A"><num value="A">(A)</num><content> the Secretary of Defense; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac869632-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/1/B"><num value="B">(B)</num><content> the Secretary of Homeland Security with respect to the Coast Guard when the Coast Guard is not operating as a service in the Navy.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac869633-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subsection (a) does not apply to a contract or purchase made by a defined Secretary for clothing, subsistence, forage, fuel, quarters, transportation, or medical and hospital supplies.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idac869634-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Current year limitation</inline>.—</heading><content>A contract or purchase made by a defined Secretary under this subsection may not exceed the necessities of the current year.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idac869635-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Reports</inline>.—</heading><content>The defined Secretary shall immediately advise Congress when authority is exercised under this subsection. The defined Secretary shall report quarterly on the estimated obligations incurred pursuant to the authority granted in this subsection.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idac869636-8841-11e3-a061-f27786e6d667" identifier="/us/usc/t41/s6301/c"><num value="c">(c)</num><heading> <inline class="small-caps">Special Rule for Purchase of Land</inline>.—</heading><content>Land may not be purchased by the Federal Government unless the purchase is authorized by law.</content>
