<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7d6a52e0-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8105"><num value="8105">§ 8105.</num><heading> Waiver</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7d6a52e1-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8105/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>The head of an agency may waive a suspension of payments, termination of the contract or grant, or suspension or debarment of a contractor or grantee under this chapter with respect to a particular contract or grant if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a52e2-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8105/a/1"><num value="1">(1)</num><content> in the case of a contract, the head of the agency determines under <ref href="/us/usc/t41/s8102/b/1">section 8102(b)(1) of this title</ref>, after a final determination is issued under section 8102(b)(1), that suspension of payments, termination of the contract, suspension or debarment of the contractor, or refusal to permit a person to be treated as a responsible source for a contract would severely disrupt the operation of the agency to the detriment of the Federal Government or the general public; or</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a52e3-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8105/a/2"><num value="2">(2)</num><content> in the case of a grant, the head of the agency determines that suspension of payments, termination of the grant, or suspension or debarment of the grantee would not be in the public interest.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id7d6a52e4-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8105/b"><num value="b">(b)</num><heading> <inline class="small-caps">Waiver Authority May Not Be Delegated</inline>.—</heading><content>The authority of the head of an agency under this section to waive a suspension, termination, or debarment shall not be delegated.</content>
