<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a532c-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/1"><num value="1">(1)</num><heading> <inline class="small-caps">Blind</inline>.—</heading><content>The term “blind” refers to an individual or class of individuals whose central visual acuity does not exceed 20/200 in the better eye with correcting lenses or whose visual acuity, if better than 20/200, is accompanied by a limit to the field of vision in the better eye to such a degree that its widest diameter subtends an angle of no greater than 20 degrees.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a532d-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/2"><num value="2">(2)</num><heading> <inline class="small-caps">Committee</inline>.—</heading><content>The term “Committee” means the Committee for Purchase From People Who Are Blind or Severely Disabled established under <ref href="/us/usc/t41/s8502">section 8502 of this title</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a532e-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/3"><num value="3">(3)</num><heading> <inline class="small-caps">Direct labor</inline>.—</heading><chapeau>The term “direct labor”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7d6a532f-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/3/A"><num value="A">(A)</num><content> includes all work required for preparation, processing, and packing of a product, or work directly relating to the performance of a service; but</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d6a5330-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/3/B"><num value="B">(B)</num><content> does not include supervision, administration, inspection, or shipping.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a5331-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/4"><num value="4">(4)</num><heading> <inline class="small-caps">Entity of the federal government and federal government</inline>.—</heading><content>The terms “entity of the Federal Government” and “Federal Government” include an entity of the legislative or judicial branch, a military department or executive agency (as defined in sections 102 and 105 of title 5, respectively), the United States Postal Service, and a nonappropriated fund instrumentality under the jurisdiction of the Armed Forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a5332-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/5"><num value="5">(5)</num><heading> <inline class="small-caps">Other severely disabled</inline>.—</heading><content>The term “other severely disabled” means an individual or class of individuals under a physical or mental disability, other than blindness, which (according to criteria established by the Committee after consultation with appropriate entities of the Federal Government and taking into account the views of non-Federal Government entities representing the disabled) constitutes a substantial handicap to employment and is of a nature that prevents the individual from currently engaging in normal competitive employment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7d6a5333-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6"><num value="6">(6)</num><heading> <inline class="small-caps">Qualified nonprofit agency for other severely disabled</inline>.—</heading><chapeau>The term “qualified nonprofit agency for other severely disabled” means an agency—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7d6a5334-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="id7d6a5335-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/A/i"><num value="i">(i)</num><content> organized under the laws of the United States or a State;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7d6a5336-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/A/ii"><num value="ii">(ii)</num><content> operated in the interest of severely disabled individuals who are not blind; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7d6a5337-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/A/iii"><num value="iii">(iii)</num><content> of which no part of the net income of the agency inures to the benefit of a shareholder or other individual;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d6a5338-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/B"><num value="B">(B)</num><content> that complies with any applicable occupational health and safety standard prescribed by the Secretary of Labor; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7d6a5339-446e-11e6-9013-db96b408e4b2" identifier="/us/usc/t41/s8501/6/C"><num value="C">(C)</num><content> that in the production of products and in the provision of services (whether or not the products or services are procured under this chapter) during the fiscal year employs blind or other severely disabled individuals for at least 75 percent of the hours of direct labor required for the production or provision of the products or services.</content>
</subparagraph>
</paragraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Statement of Policy</inline>.—</heading><content>The Secretary of Defense, the Secretary of Education, and the Chairman of the Committee for Purchase From People Who Are Blind or Severely Disabled shall jointly issue a statement of policy related to the implementation of the Randolph-Sheppard Act (<ref href="/us/usc/t20/s107">20 U.S.C. 107</ref> et seq.) and the Javits-Wagner-O’Day Act ([former] <ref href="/us/usc/t41/s48">41 U.S.C. 48</ref> [46 et seq.]) [now <ref href="/us/usc/t41/s8501">41 U.S.C. 8501</ref> et seq.] within the Department of Defense and the Department of Education. The joint statement of policy shall specifically address the application of those Acts to both operation and management of all or any part of a military mess hall, military troop dining facility, or any similar dining facility operated for the purpose of providing meals to members of the Armed Forces, and shall take into account and address, to the extent practicable, the positions acceptable to persons representing programs implemented under each Act.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than <date date="2006-04-01">April 1, 2006</date>, the Secretary of Defense, the Secretary of Education, and the Chairman of the Committee for Purchase From People Who Are Blind or Severely Disabled shall submit to the Committees on Armed Services of the Senate and the House of Representatives, the Committee on Health, Education, Labor and Pensions of the Senate, and the Committee on Education and the Workforce of the House of Representatives a report describing the joint statement of policy issued under subsection (b), with such findings and recommendations as the Secretaries consider appropriate.”</content>
