<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb49ff10a-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705"><num value="8705">§ 8705.</num><heading> Administrative offsets</heading><subsection style="-uslm-lc:I11" class="indent0" id="idb49ff10b-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><content>In this section, the term “contracting officer” has the meaning given that term in chapter 71 of this title.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb49ff10c-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/b"><num value="b">(b)</num><heading> <inline class="small-caps">Offset Authority</inline>.—</heading><content>A contracting officer of a contracting agency may offset the amount of a kickback provided, accepted, or charged in violation of <ref href="/us/usc/t41/s8702">section 8702 of this title</ref> against amounts the Federal Government owes the prime contractor under the prime contract to which the kickback relates.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb49ff10d-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/c"><num value="c">(c)</num><heading> <inline class="small-caps">Duties of Prime Contractor.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idb49ff10e-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Withholding and paying over or retaining amounts</inline>.—</heading><chapeau>On direction of a contracting officer of a contracting agency with respect to a prime contract, the prime contractor shall withhold from amounts owed to a subcontractor under a subcontract of the prime contract the amount of a kickback which was or may be offset against the prime contractor under subsection (b). The contracting officer may order that amounts withheld—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb49ff10f-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/c/1/A"><num value="A">(A)</num><content> be paid over to the contracting agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb49ff110-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/c/1/B"><num value="B">(B)</num><content> be retained by the prime contractor if the Federal Government has already offset the amount against the prime contractor.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb49ff111-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Notice</inline>.—</heading><content>The prime contractor shall notify the contracting officer when an amount is withheld and retained under paragraph (1)(B).</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idb49ff112-0612-11ea-8672-cbacc8e63a99" identifier="/us/usc/t41/s8705/d"><num value="d">(d)</num><heading> <inline class="small-caps">Offset, Direction, or Order is Claim of Federal Government</inline>.—</heading><content>An offset under subsection (b) or a direction or order of a contracting officer under subsection (c) is a claim by the Federal Government for the purposes of chapter 71 of this title.</content>
