<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6e8bd30-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008"><num value="1008">§ 1008.</num><heading> Overpayments and underpayments</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6e8bd31-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Whenever the Commissioner of Social Security finds that more or less than the correct amount of payment has been made to any person under this subchapter, proper adjustment or recovery shall be made, as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6e8e442-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/a/1"><num value="1">(1)</num><content> With respect to payment to a person of more than the correct amount, the Commissioner of Social Security shall decrease any payment under this subchapter to which the overpaid person (if a qualified individual) is entitled, or shall require the overpaid person or his or her estate to refund the amount in excess of the correct amount, or, if recovery is not obtained under these two methods, shall seek or pursue recovery by means of reduction in tax refunds based on notice to the Secretary of the Treasury, as authorized under <ref href="/us/usc/t31/s3720A">section 3720A of title 31</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida6e8e443-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/a/2"><num value="2">(2)</num><chapeau> With respect to payment of less than the correct amount to a qualified individual who, at the time the Commissioner of Social Security is prepared to take action with respect to the underpayment—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6e8e444-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/a/2/A"><num value="A">(A)</num><content> is living, the Commissioner of Social Security shall make payment to the qualified individual (or the qualified individual’s representative payee designated under <ref href="/us/usc/t42/s1007">section 1007 of this title</ref>) of the balance of the amount due the underpaid qualified individual; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6e8e445-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/a/2/B"><num value="B">(B)</num><content> is deceased, the balance of the amount due shall revert to the general fund of the Treasury.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6e8e446-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/b"><num value="b" class="bold">(b)</num><heading class="bold"> Waiver of recovery of overpayment</heading><content><p style="-uslm-lc:I11" class="indent0">In any case in which more than the correct amount of payment has been made, there shall be no adjustment of payments to, or recovery by the United States from, any person who is without fault if the Commissioner of Social Security determines that the adjustment or recovery would defeat the purpose of this subchapter or would be against equity and good conscience.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6e8e447-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limited immunity for disbursing officers</heading><content><p style="-uslm-lc:I11" class="indent0">A disbursing officer may not be held liable for any amount paid by the officer if the adjustment or recovery of the amount is waived under subsection (b), or adjustment under subsection (a) is not completed before the death of the qualified individual against whose benefits deductions are authorized.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6e8e448-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorized collection practices</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6e8e449-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">With respect to any delinquent amount, the Commissioner of Social Security may use the collection practices described in sections 3711(e), 3716, and 3718 of title 31, as in effect on <date date="1994-10-01">October 1, 1994</date>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6e8e44a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Definition</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of paragraph (1), the term “delinquent amount” means an amount—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6e8e44b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/d/2/A"><num value="A">(A)</num><content> in excess of the correct amount of the payment under this subchapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6e8e44c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1008/d/2/B"><num value="B">(B)</num><content> determined by the Commissioner of Social Security to be otherwise unrecoverable under this section from a person who is not a qualified individual under this subchapter.</content>
