L. 100–203, title V, § 5002, Dec. 22, 1987, 101 Stat. 1330–227.)","seq_in_title":6028,"parent_identifier":"/us/usc/t42/ch108","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108","level":"chapter","num":"CHAPTER 108—","heading":"NUCLEAR WASTE POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id0b03b2f5-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101\"><num value=\"10101\">§ 10101.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b2f6-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/1\"><num value=\"1\">(1)</num><content> The term “Administrator” means the Administrator of the Environmental Protection Agency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b2f7-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/2\"><num value=\"2\">(2)</num><chapeau> The term “affected Indian tribe” means any Indian tribe—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2f8-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/2/A\"><num value=\"A\">(A)</num><content> within whose reservation boundaries a monitored retrievable storage facility, test and evaluation facility, or a repository for high-level radioactive waste or spent fuel is proposed to be located;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2f9-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/2/B\"><num value=\"B\">(B)</num><content> whose federally defined possessory or usage rights to other lands outside of the reservation’s boundaries arising out of congressionally ratified treaties may be substantially and adversely affected by the locating of such a facility: <i>Provided</i>, That the Secretary of the Interior finds, upon the petition of the appropriate governmental officials of the tribe, that such effects are both substantial and adverse to the tribe; <ref class=\"footnoteRef\" idref=\"fn003847\">1</ref><note type=\"footnote\" id=\"fn003847\"><num>1</num> So in original. The semicolon probably should be a period.</note></content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b2fa-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3\"><num value=\"3\">(3)</num><chapeau> The term “atomic energy defense activity” means any activity of the Secretary performed in whole or in part in carrying out any of the following functions:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2fb-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/A\"><num value=\"A\">(A)</num><content> naval reactors development;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2fc-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/B\"><num value=\"B\">(B)</num><content> weapons activities including defense inertial confinement fusion;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2fd-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/C\"><num value=\"C\">(C)</num><content> verification and control technology;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2fe-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/D\"><num value=\"D\">(D)</num><content> defense nuclear materials production;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b2ff-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/E\"><num value=\"E\">(E)</num><content> defense nuclear waste and materials by-products management;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b300-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/F\"><num value=\"F\">(F)</num><content> defense nuclear materials security and safeguards and security investigations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b301-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/3/G\"><num value=\"G\">(G)</num><content> defense research and development.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b302-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/4\"><num value=\"4\">(4)</num><content> The term “candidate site” means an area, within a geologic and hydrologic system, that is recommended by the Secretary under <ref href=\"/us/usc/t42/s10132\">section 10132 of this title</ref> for site characterization, approved by the President under <ref href=\"/us/usc/t42/s10132\">section 10132 of this title</ref> for site characterization, or undergoing site characterization under <ref href=\"/us/usc/t42/s10133\">section 10133 of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b303-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/5\"><num value=\"5\">(5)</num><content> The term “civilian nuclear activity” means any atomic energy activity other than an atomic energy defense activity.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b304-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/6\"><num value=\"6\">(6)</num><content> The term “civilian nuclear power reactor” means a civilian nuclear powerplant required to be licensed under section 2133 or 2134(b) of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b305-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/7\"><num value=\"7\">(7)</num><content> The term “Commission” means the Nuclear Regulatory Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b306-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/8\"><num value=\"8\">(8)</num><content> The term “Department” means the Department of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b307-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/9\"><num value=\"9\">(9)</num><content> The term “disposal” means the emplacement in a repository of high-level radioactive waste, spent nuclear fuel, or other highly radioactive material with no foreseeable intent of recovery, whether or not such emplacement permits the recovery of such waste.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b308-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/10\"><num value=\"10\">(10)</num><content> The terms “disposal package” and “package” mean the primary container that holds, and is in contact with, solidified high-level radioactive waste, spent nuclear fuel, or other radioactive materials, and any overpacks that are emplaced at a repository.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b309-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/11\"><num value=\"11\">(11)</num><content> The term “engineered barriers” means manmade components of a disposal system designed to prevent the release of radionuclides into the geologic medium involved. Such term includes the high-level radioactive waste form, high-level radioactive waste canisters, and other materials placed over and around such canisters.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b30a-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/12\"><num value=\"12\">(12)</num><chapeau> The term “high-level radioactive waste” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b30b-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/12/A\"><num value=\"A\">(A)</num><content> the highly radioactive material resulting from the reprocessing of spent nuclear fuel, including liquid waste produced directly in reprocessing and any solid material derived from such liquid waste that contains fission products in sufficient concentrations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b30c-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/12/B\"><num value=\"B\">(B)</num><content> other highly radioactive material that the Commission, consistent with existing law, determines by rule requires permanent isolation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b30d-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/13\"><num value=\"13\">(13)</num><content> The term “Federal agency” means any Executive agency, as defined in <ref href=\"/us/usc/t5/s105\">section 105 of title 5</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b30e-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/14\"><num value=\"14\">(14)</num><content> The term “Governor” means the chief executive officer of a State.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b30f-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/15\"><num value=\"15\">(15)</num><content> The term “Indian tribe” means any Indian tribe, band, nation, or other organized group or community of Indians recognized as eligible for the services provided to Indians by the Secretary of the Interior because of their status as Indians, including any Alaska Native village, as defined in section 3(c) of the Alaska Native Claims Settlement Act (<ref href=\"/us/usc/t43/s1602/c\">43 U.S.C. 1602(c)</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b310-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/16\"><num value=\"16\">(16)</num><chapeau> The term “low-level radioactive waste” means radioactive material that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b311-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/16/A\"><num value=\"A\">(A)</num><content> is not high-level radioactive waste, spent nuclear fuel, transuranic waste, or by-product material as defined in <ref href=\"/us/usc/t42/s2014/e/2\">section 2014(e)(2) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b312-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/16/B\"><num value=\"B\">(B)</num><content> the Commission, consistent with existing law, classifies as low-level radioactive waste.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b313-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/17\"><num value=\"17\">(17)</num><content> The term “Office” means the Office of Civilian Radioactive Waste Management established in section 10224 <ref class=\"footnoteRef\" idref=\"fn003848\">2</ref><note type=\"footnote\" id=\"fn003848\"><num>2</num> See References in Text note below.</note> of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b314-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/18\"><num value=\"18\">(18)</num><content> The term “repository” means any system licensed by the Commission that is intended to be used for, or may be used for, the permanent deep geologic disposal of high-level radioactive waste and spent nuclear fuel, whether or not such system is designed to permit the recovery, for a limited period during initial operation, of any materials placed in such system. Such term includes both surface and subsurface areas at which high-level radioactive waste and spent nuclear fuel handling activities are conducted.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b315-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/19\"><num value=\"19\">(19)</num><chapeau> The term “reservation” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b316-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/19/A\"><num value=\"A\">(A)</num><content> any Indian reservation or dependent Indian community referred to in clause (a) or (b) of <ref href=\"/us/usc/t18/s1151\">section 1151 of title 18</ref>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b317-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/19/B\"><num value=\"B\">(B)</num><content> any land selected by an Alaska Native village or regional corporation under the provisions of the Alaska Native Claims Settlement Act (<ref href=\"/us/usc/t43/s1601\">43 U.S.C. 1601</ref> et seq.).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b318-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/20\"><num value=\"20\">(20)</num><content> The term “Secretary” means the Secretary of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b319-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/21\"><num value=\"21\">(21)</num><chapeau> The term “site characterization” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b31a-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/21/A\"><num value=\"A\">(A)</num><content> siting research activities with respect to a test and evaluation facility at a candidate site; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0b03b31b-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/21/B\"><num value=\"B\">(B)</num><content> activities, whether in the laboratory or in the field, undertaken to establish the geologic condition and the ranges of the parameters of a candidate site relevant to the location of a repository, including borings, surface excavations, excavations of exploratory shafts, limited subsurface lateral excavations and borings, and in situ testing needed to evaluate the suitability of a candidate site for the location of a repository, but not including preliminary borings and geophysical testing needed to assess whether site characterization should be undertaken.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b31c-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/22\"><num value=\"22\">(22)</num><content> The term “siting research” means activities, including borings, surface excavations, shaft excavations, subsurface lateral excavations and borings, and in situ testing, to determine the suitability of a site for a test and evaluation facility.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b31d-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/23\"><num value=\"23\">(23)</num><content> The term “spent nuclear fuel” means fuel that has been withdrawn from a nuclear reactor following irradiation, the constituent elements of which have not been separated by reprocessing.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b31e-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/24\"><num value=\"24\">(24)</num><content> The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and any other territory or possession of the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b31f-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/25\"><num value=\"25\">(25)</num><content> The term “storage” means retention of high-level radioactive waste, spent nuclear fuel, or transuranic waste with the intent to recover such waste or fuel for subsequent use, processing, or disposal.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b320-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/26\"><num value=\"26\">(26)</num><content> The term “Storage Fund” means the Interim Storage Fund established in section 10156(c) <sup>2</sup> of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b321-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/27\"><num value=\"27\">(27)</num><content> The term “test and evaluation facility” means an at-depth, prototypic, underground cavity with subsurface lateral excavations extending from a central shaft that is used for research and development purposes, including the development of data and experience for the safe handling and disposal of solidified high-level radioactive waste, transuranic waste, or spent nuclear fuel.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b322-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/28\"><num value=\"28\">(28)</num><content> The term “unit of general local government” means any borough, city, county, parish, town, township, village, or other general purpose political subdivision of a State.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b323-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/29\"><num value=\"29\">(29)</num><content> The term “Waste Fund” means the Nuclear Waste Fund established in <ref href=\"/us/usc/t42/s10222/c\">section 10222(c) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b324-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/30\"><num value=\"30\">(30)</num><content> The term “Yucca Mountain site” means the candidate site in the State of Nevada recommended by the Secretary to the President under <ref href=\"/us/usc/t42/s10132/b/1/B\">section 10132(b)(1)(B) of this title</ref> on <date date=\"1986-05-27\">May 27, 1986</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b325-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/31\"><num value=\"31\">(31)</num><content> The term “affected unit of local government” means the unit of local government with jurisdiction over the site of a repository or a monitored retrievable storage facility. Such term may, at the discretion of the Secretary, include units of local government that are contiguous with such unit.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b326-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/32\"><num value=\"32\">(32)</num><content> The term “Negotiator” means the Nuclear Waste Negotiator.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b327-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/33\"><num value=\"33\">(33)</num><content> As used in subchapter IV, the term “Office” means the Office of the Nuclear Waste Negotiator established under subchapter IV of this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0b03b328-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s10101/34\"><num value=\"34\">(34)</num><content> The term “monitored retrievable storage facility” means the storage facility described in <ref href=\"/us/usc/t42/s10161/b/1\">section 10161(b)(1) of this title</ref>.</content>\n</paragraph>\n<sourceCredit id=\"id0b03b329-80bc-11ea-808b-a3be13bc391b\">(<ref href=\"/us/pl/97/425/s2\">Pub.
