L. 97–425, title I, § 121, Jan. 7, 1983, 96 Stat. 2228.)","seq_in_title":6047,"parent_identifier":"/us/usc/t42/ch108/schI/ptA","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108","level":"chapter","num":"CHAPTER 108—","heading":"NUCLEAR WASTE POLICY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"DISPOSAL AND STORAGE OF HIGH-LEVEL RADIOACTIVE WASTE, SPENT NUCLEAR FUEL, AND LOW-LEVEL RADIOACTIVE WASTE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108/schI/ptA","level":"part","num":"Part A—","heading":"Repositories for Disposal of High-Level Radioactive Waste and Spent Nu­clear Fuel","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f26d262-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141\"><num value=\"10141\">§ 10141.</num><heading> Certain standards and criteria</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f26d263-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Environmental Protection Agency standards</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 1 year after <date date=\"1983-01-07\">January 7, 1983</date>, the Administrator, pursuant to authority under other provisions of law, shall, by rule, promulgate generally applicable standards for protection of the general environment from offsite releases from radioactive material in repositories.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f26d264-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Commission requirements and criteria</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f26d265-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f26d266-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/A\"><num value=\"A\">(A)</num><chapeau> Not later than <date date=\"1984-01-01\">January 1, 1984</date>, the Commission, pursuant to authority under other provisions of law, shall, by rule, promulgate technical requirements and criteria that it will apply, under the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2011\">42 U.S.C. 2011</ref> et seq.) and the Energy Reorganization Act of 1974 (<ref href=\"/us/usc/t42/s5801\">42 U.S.C. 5801</ref> et seq.), in approving or disapproving—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f26d267-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/A/i\"><num value=\"i\">(i)</num><content> applications for authorization to construct repositories;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f26d268-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> applications for licenses to receive and possess spent nuclear fuel and high-level radioactive waste in such repositories; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f26d269-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> applications for authorization for closure and decommissioning of such repositories.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f26d26a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/B\"><num value=\"B\">(B)</num><content> Such criteria shall provide for the use of a system of multiple barriers in the design of the repository and shall include such restrictions on the retrievability of the solidified high-level radioactive waste and spent fuel emplaced in the repository as the Commission deems appropriate.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f26f97b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/1/C\"><num value=\"C\">(C)</num><content> Such requirements and criteria shall not be inconsistent with any comparable standards promulgated by the Administrator under subsection (a).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f26f97c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/b/2\"><num value=\"2\">(2)</num><content> For purposes of this chapter, nothing in this section shall be construed to prohibit the Commission from promulgating requirements and criteria under paragraph (1) before the Administrator promulgates standards under subsection (a). If the Administrator promulgates standards under subsection (a) after requirements and criteria are promulgated by the Commission under paragraph (1), such requirements and criteria shall be revised by the Commission if necessary to comply with paragraph (1)(C).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f26f97d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10141/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Environmental impact statement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The promulgation of standards or criteria in accordance with the provisions of this section shall not require the preparation of an environmental impact statement under section 102(2)(C) of the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4332/2/C\">42 U.S.C. 4332(2)(C)</ref>), or to require any environmental review under subparagraph (E) or (F) of section 102(2) of such Act.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8f26f97e-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/97/425/tI/s121\">Pub. L. 102–486, title VIII, § 801</ref>, <date date=\"1992-10-24\">Oct. 24, 1992</date>, <ref href=\"/us/stat/106/2921\">106 Stat. 2921</ref>, provided that:<quotedContent origin=\"/us/pl/102/486/tVIII/s801\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Environmental Protection Agency Standards.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Promulgation</inline>.—</heading><content>Notwithstanding the provisions of section 121(a) of the Nuclear Waste Policy Act of 1982 (<ref href=\"/us/usc/t42/s10141/a\">42 U.S.C. 10141(a)</ref>), section 161 b. of the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2201/b\">42 U.S.C. 2201(b)</ref>), and any other authority of the Administrator of the Environmental Protection Agency to set generally applicable standards for the Yucca Mountain site, the Administrator shall, based upon and consistent with the findings and recommendations of the National Academy of Sciences, promulgate, by rule, public health and safety standards for protection of the public from releases from radioactive materials stored or disposed of in the repository at the Yucca Mountain site. Such standards shall prescribe the maximum annual effective dose equivalent to individual members of the public from releases to the accessible environment from radioactive materials stored or disposed of in the repository. The standards shall be promulgated not later than 1 year after the Administrator receives the findings and recommendations of the National Academy of Sciences under paragraph (2) and shall be the only such standards applicable to the Yucca Mountain site.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Study by national academy of sciences</inline>.—</heading><chapeau>Within 90 days after the date of the enactment of this Act [<date date=\"1992-10-24\">Oct. 24, 1992</date>], the Administrator shall contract with the National Academy of Sciences to conduct a study to provide, by not later than <date date=\"1993-12-31\">December 31, 1993</date>, findings and recommendations on reasonable standards for protection of the public health and safety, including—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> whether a health-based standard based upon doses to individual members of the public from releases to the accessible environment (as that term is defined in the regulations contained in subpart B of part 191 of title 40, Code of Federal Regulations, as in effect on <date date=\"1985-11-18\">November 18, 1985</date>) will provide a reasonable standard for protection of the health and safety of the general public;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> whether it is reasonable to assume that a system for post-closure oversight of the repository can be developed, based upon active institutional controls, that will prevent an unreasonable risk of breaching the repository’s engineered or geologic barriers or increasing the exposure of individual members of the public to radiation beyond allowable limits; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> whether it is possible to make scientifically supportable predictions of the probability that the repository’s engineered or geologic barriers will be breached as a result of human intrusion over a period of 10,000 years.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Applicability</inline>.—</heading><content>The provisions of this section shall apply to the Yucca Mountain site, rather than any other authority of the Administrator to set generally applicable standards for radiation protection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Nuclear Regulatory Commission Requirements and Criteria.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Modifications</inline>.—</heading><content>Not later than 1 year after the Administrator promulgates standards under subsection (a), the Nuclear Regulatory Commission shall, by rule, modify its technical requirements and criteria under section 121(b) of the Nuclear Waste Policy Act of 1982 (<ref href=\"/us/usc/t42/s10141/b\">42 U.S.C. 10141(b)</ref>), as necessary, to be consistent with the Administrator’s standards promulgated under subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Required assumptions</inline>.—</heading><chapeau>The Commission’s requirements and criteria shall assume, to the extent consistent with the findings and recommendations of the National Academy of Sciences, that, following repository closure, the inclusion of engineered barriers and the Secretary’s post-closure oversight of the Yucca Mountain site, in accordance with subsection (c), shall be sufficient to—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> prevent any activity at the site that poses an unreasonable risk of breaching the repository’s engineered or geologic barriers; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> prevent any increase in the exposure of individual members of the public to radiation beyond allowable limits.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Post-Closure Oversight</inline>.—</heading><chapeau>Following repository closure, the Secretary of Energy shall continue to oversee the Yucca Mountain site to prevent any activity at the site that poses an unreasonable risk of—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> breaching the repository’s engineered or geologic barriers;
