L. 100–203, title V, § 5041, Dec. 22, 1987, 101 Stat. 1330–244.)","seq_in_title":6100,"parent_identifier":"/us/usc/t42/ch108/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108","level":"chapter","num":"CHAPTER 108—","heading":"NUCLEAR WASTE POLICY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"NUCLEAR WASTE NEGOTIATOR","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f2d88dc-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243\"><num value=\"10243\">§ 10243.</num><heading> Duties of Negotiator</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f2d88dd-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Negotiations with potential hosts</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2d88de-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/1\"><num value=\"1\">(1)</num><chapeau> The Negotiator shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2d88df-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/1/A\"><num value=\"A\">(A)</num><chapeau> seek to enter into negotiations on behalf of the United States, with—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8f2d88e0-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/1/A/i\"><num value=\"i\">(i)</num><content> the Governor of any State in which a potential site is located; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8f2d88e1-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> the governing body of any Indian tribe on whose reservation a potential site is located; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2d88e2-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/1/B\"><num value=\"B\">(B)</num><content> attempt to reach a proposed agreement between the United States and any such State or Indian tribe specifying the terms and conditions under which such State or tribe would agree to host a repository or monitored retrievable storage facility within such State or reservation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2d88e3-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/a/2\"><num value=\"2\">(2)</num><content> In any case in which State law authorizes any person or entity other than the Governor to negotiate a proposed agreement under this section on behalf of the State, any reference in this subchapter to the Governor shall be considered to refer instead to such other person or entity.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f2d88e4-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Consultation with affected States, subdivisions of States, and tribes</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In addition to entering into negotiations under subsection (a), the Negotiator shall consult with any State, affected unit of local government, or any Indian tribe that the Negotiator determines may be affected by the siting of a repository or monitored retrievable storage facility and may include in any proposed agreement such terms and conditions relating to the interest of such States, affected units of local government, or Indian tribes as the Negotiator determines to be reasonable and appropriate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f2d88e5-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Consultation with other Federal agencies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Negotiator may solicit and consider the comments of the Secretary, the Nuclear Regulatory Commission, or any other Federal agency on the suitability of any potential site for site characterization. Nothing in this subsection shall be construed to require the Secretary, the Nuclear Regulatory Commission, or any other Federal agency to make a finding that any such site is suitable for site characterization.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f2d88e6-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Proposed agreement</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2d88e7-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/1\"><num value=\"1\">(1)</num><content> The Negotiator shall submit to the Congress any proposed agreement between the United States and a State or Indian tribe negotiated under subsection (a) and an environmental assessment prepared under <ref href=\"/us/usc/t42/s10244/a\">section 10244(a) of this title</ref> for the site concerned.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2daff8-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/2\"><num value=\"2\">(2)</num><content> Any such proposed agreement shall contain such terms and conditions (including such financial and institutional arrangements) as the Negotiator and the host State or Indian tribe determine to be reasonable and appropriate and shall contain such provisions as are necessary to preserve any right to participation or compensation of such State, affected unit of local government, or Indian tribe under sections 10136(c), 10137, and 10138(b) of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2daff9-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2daffa-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/3/A\"><num value=\"A\">(A)</num><content> No proposed agreement entered into under this section shall have legal effect unless enacted into Federal law.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2daffb-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/3/B\"><num value=\"B\">(B)</num><content> A State or Indian tribe shall enter into an agreement under this section in accordance with the laws of such State or tribe. Nothing in this section may be construed to prohibit the disapproval of a proposed agreement between a State and the United States under this section by a referendum or an act of the legislature of such State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8f2daffc-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10243/d/4\"><num value=\"4\">(4)</num><content> Notwithstanding any proposed agreement under this section, the Secretary may construct a repository or monitored retrievable storage facility at a site agreed to under this subchapter only if authorized by the Nuclear Regulatory Commission in accordance with the Atomic Energy Act of 1954 [<ref href=\"/us/usc/t42/s2011\">42 U.S.C. 2011</ref> et seq.], title II of the Energy Reorganization Act of 1982 (<ref href=\"/us/usc/t42/s5841\">42 U.S.C. 5841</ref> et seq.) and any other law applicable to authorization of such construction.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8f2daffd-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/97/425/tIV/s403\">Pub.
