L. 100–203, title V, § 5041, Dec. 22, 1987, 101 Stat. 1330–247.)","seq_in_title":6105,"parent_identifier":"/us/usc/t42/ch108/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108","level":"chapter","num":"CHAPTER 108—","heading":"NUCLEAR WASTE POLICY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch108/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"NUCLEAR WASTE NEGOTIATOR","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f2dfe4d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248\"><num value=\"10248\">§ 10248.</num><heading> Administrative powers of Negotiator</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out his functions under this subchapter, the Negotiator may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe4e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/1\"><num value=\"1\">(1)</num><content> appoint such officers and employees as he determines to be necessary and prescribe their duties;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe4f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/2\"><num value=\"2\">(2)</num><content> obtain services as authorized by <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref>, at rates not to exceed the rate prescribed for grade GS–18 of the General Schedule by <ref href=\"/us/usc/t5/s5332\">section 5332 of title 5</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe50-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/3\"><num value=\"3\">(3)</num><content> promulgate such rules and regulations as may be necessary to carry out such functions;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe51-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/4\"><num value=\"4\">(4)</num><content> utilize the services, personnel, and facilities of other Federal agencies (subject to the consent of the head of any such agency);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe52-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/5\"><num value=\"5\">(5)</num><content> for purposes of performing administrative functions under this subchapter, and to the extent funds are appropriated, enter into and perform such contracts, leases, cooperative agreements, or other transactions as may be necessary and on such terms as the Negotiator determines to be appropriate, with any agency or instrumentality of the United States, or with any public or private person or entity;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe53-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/6\"><num value=\"6\">(6)</num><content> accept voluntary and uncompensated services, notwithstanding the provisions of <ref href=\"/us/usc/t31/s1342\">section 1342 of title 31</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe54-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/7\"><num value=\"7\">(7)</num><content> adopt an official seal, which shall be judicially noticed;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe55-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/8\"><num value=\"8\">(8)</num><content> use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe56-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/9\"><num value=\"9\">(9)</num><content> hold such hearings as are necessary to determine the views of interested parties and the general public; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8f2dfe57-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s10248/10\"><num value=\"10\">(10)</num><content> appoint advisory committees under the Federal Advisory Committee Act (5 U.S.C.
