<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8f2e2581-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262"><num value="10262">§ 10262.</num><heading> Nuclear Waste Technical Review Board</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8f2e2582-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established a Nuclear Waste Technical Review Board that shall be an independent establishment within the executive branch.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8f2e2583-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b"><num value="b" class="bold">(b)</num><heading class="bold"> Members</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8f2e2584-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/1"><num value="1">(1)</num><content> The Board shall consist of 11 members who shall be appointed by the President not later than 90 days after <date date="1987-12-22">December 22, 1987</date>, from among persons nominated by the National Academy of Sciences in accordance with paragraph (3).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8f2e2585-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/2"><num value="2">(2)</num><content> The President shall designate a member of the Board to serve as chairman.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8f2e2586-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id8f2e2587-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/A"><num value="A">(A)</num><content> The National Academy of Sciences shall, not later than 90 days after <date date="1987-12-22">December 22, 1987</date>, nominate not less than 22 persons for appointment to the Board from among persons who meet the qualifications described in subparagraph (C).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id8f2e2588-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/B"><num value="B">(B)</num><content> The National Academy of Sciences shall nominate not less than 2 persons to fill any vacancy on the Board from among persons who meet the qualifications described in subparagraph (C).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id8f2e2589-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C"><num value="C">(C)</num><clause style="-uslm-lc:I11" class="indent0" id="id8f2e258a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/i"><num value="i">(i)</num><chapeau> Each person nominated for appointment to the Board shall be—</chapeau><subclause style="-uslm-lc:I12" class="indent1" id="id8f2e4c9b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/i/I"><num value="I">(I)</num><content> eminent in a field of science or engineering, including environmental sciences; and</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="id8f2e4c9c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/i/II"><num value="II">(II)</num><content> selected solely on the basis of established records of distinguished service.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id8f2e4c9d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/ii"><num value="ii">(ii)</num><content> The membership of the Board shall be representative of the broad range of scientific and engineering disciplines related to activities under this subchapter.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id8f2e4c9e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/iii"><num value="iii">(iii)</num><chapeau> No person shall be nominated for appointment to the Board who is an employee of—</chapeau><subclause style="-uslm-lc:I12" class="indent1" id="id8f2e4c9f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/iii/I"><num value="I">(I)</num><content> the Department of Energy;</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="id8f2e4ca0-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/iii/II"><num value="II">(II)</num><content> a national laboratory under contract with the Department of Energy; or</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="id8f2e4ca1-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/3/C/iii/III"><num value="III">(III)</num><content> an entity performing high-level radioactive waste or spent nuclear fuel activities under contract with the Department of Energy.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8f2e4ca2-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/4"><num value="4">(4)</num><content> Any vacancy on the Board shall be filled by the nomination and appointment process described in paragraphs (1) and (3).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8f2e4ca3-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10262/b/5"><num value="5">(5)</num><content> Members of the Board shall be appointed for terms of 4 years, each such term to commence 120 days after <date date="1987-12-22">December 22, 1987</date>, except that of the 11 members first appointed to the Board, 5 shall serve for 2 years and 6 shall serve for 4 years, to be designated by the President at the time of appointment.</content>
