L. 111–11, title IX, § 9508, Mar. 30, 2009, 123 Stat. 1343.)","seq_in_title":6140,"parent_identifier":"/us/usc/t42/ch109B","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch109B","level":"chapter","num":"CHAPTER 109B—","heading":"SECURE WATER","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaced4407-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368\"><num value=\"10368\">§ 10368.</num><heading> National water availability and use assessment program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaced4408-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, in coordination with the Advisory Committee and State and local water resource agencies, shall establish a national assessment program to be known as the “national water availability and use assessment program”—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced4409-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/1\"><num value=\"1\">(1)</num><content> to provide a more accurate assessment of the status of the water resources of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced440a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/2\"><num value=\"2\">(2)</num><content> to assist in the determination of the quantity of water that is available for beneficial uses;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced440b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/3\"><num value=\"3\">(3)</num><content> to assist in the determination of the quality of the water resources of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced440c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/4\"><num value=\"4\">(4)</num><content> to identify long-term trends in water availability;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced440d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/5\"><num value=\"5\">(5)</num><content> to use each long-term trend described in paragraph (4) to provide a more accurate assessment of the change in the availability of water in the United States; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced440e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/a/6\"><num value=\"6\">(6)</num><content> to develop the basis for an improved ability to forecast the availability of water for future economic, energy production, and environmental uses.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaced440f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Program elements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced4410-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Water use</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out the assessment program, the Secretary shall conduct any appropriate activity to carry out an ongoing assessment of water use in hydrologic accounting units and major aquifer systems located in the United States, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b21-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/1/A\"><num value=\"A\">(A)</num><content> the maintenance of a comprehensive national water use inventory to enhance the level of understanding with respect to the effects of spatial and temporal patterns of water use on the availability and sustainable use of water resources;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b22-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/1/B\"><num value=\"B\">(B)</num><content> the incorporation of water use science principles, with an emphasis on applied research and statistical estimation techniques in the assessment of water use;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b23-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/1/C\"><num value=\"C\">(C)</num><content> the integration of any dataset maintained by any other Federal or State agency into the dataset maintained by the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b24-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/1/D\"><num value=\"D\">(D)</num><content> a focus on the scientific integration of any data relating to water use, water flow, or water quality to generate relevant information relating to the impact of human activity on water and ecological resources.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced6b25-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Water availability</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out the assessment program, the Secretary shall conduct an ongoing assessment of water availability by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b26-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A\"><num value=\"A\">(A)</num><chapeau> developing and evaluating nationally consistent indicators that reflect each status and trend relating to the availability of water resources in the United States, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b27-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/i\"><num value=\"i\">(i)</num><content> surface water indicators, such as streamflow and surface water storage measures (including lakes, reservoirs, perennial snowfields, and glaciers);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b28-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii\"><num value=\"ii\">(ii)</num><chapeau> groundwater indicators, including groundwater level measurements and changes in groundwater levels due to—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b29-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/I\"><num value=\"I\">(I)</num><content> natural recharge;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/II\"><num value=\"II\">(II)</num><content> withdrawals;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/III\"><num value=\"III\">(III)</num><content> saltwater intrusion;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/IV\"><num value=\"IV\">(IV)</num><content> mine dewatering;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/V\"><num value=\"V\">(V)</num><content> land drainage;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/VI\"><num value=\"VI\">(VI)</num><content> artificial recharge; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaced6b2f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/ii/VII\"><num value=\"VII\">(VII)</num><content> other relevant factors, as determined by the Secretary; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b30-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/A/iii\"><num value=\"iii\">(iii)</num><content> impaired surface water and groundwater supplies that are known, accessible, and used to meet ongoing water demands;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b31-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/B\"><num value=\"B\">(B)</num><chapeau> maintaining a national database of water availability data that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b32-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/B/i\"><num value=\"i\">(i)</num><content> is comprised of maps, reports, and other forms of interpreted data;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b33-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> provides electronic access to the archived data of the national database; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaced6b34-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/B/iii\"><num value=\"iii\">(iii)</num><content> provides for real-time data collection; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b35-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/b/2/C\"><num value=\"C\">(C)</num><content> developing and applying predictive modeling tools that integrate groundwater, surface water, and ecological systems.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaced6b36-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Grant program</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced6b37-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authority of Secretary</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may provide grants to State water resource agencies to assist State water resource agencies in—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b38-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/1/A\"><num value=\"A\">(A)</num><content> developing water use and availability datasets that are integrated with each appropriate dataset developed or maintained by the Secretary; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b39-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/1/B\"><num value=\"B\">(B)</num><content> integrating any water use or water availability dataset of the State water resource agency into each appropriate dataset developed or maintained by the Secretary.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced6b3a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Criteria</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">To be eligible to receive a grant under paragraph (1), a State water resource agency shall demonstrate to the Secretary that the water use and availability dataset proposed to be established or integrated by the State water resource agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b3b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/2/A\"><num value=\"A\">(A)</num><content> is in compliance with each quality and conformity standard established by the Secretary to ensure that the data will be capable of integration with any national dataset; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b3c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/2/B\"><num value=\"B\">(B)</num><content> will enhance the ability of the officials of the State or the State water resource agency to carry out each water management and regulatory responsibility of the officials of the State in accordance with each applicable law of the State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced6b3d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Maximum amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of a grant provided to a State water resource agency under paragraph (1) shall be an amount not more than $250,000.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaced6b3e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Report</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than <date date=\"2012-12-31\">December 31, 2012</date>, and every 5 years thereafter, the Secretary shall submit to the appropriate committees of Congress a report that provides a detailed assessment of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced6b3f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/1\"><num value=\"1\">(1)</num><chapeau> the current availability of water resources in the United States, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b40-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/1/A\"><num value=\"A\">(A)</num><content> historic trends and annual updates of river basin inflows and outflows;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b41-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/1/B\"><num value=\"B\">(B)</num><content> surface water storage;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b42-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/1/C\"><num value=\"C\">(C)</num><content> groundwater reserves; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced6b43-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/1/D\"><num value=\"D\">(D)</num><content> estimates of undeveloped potential resources (including saline and brackish water and wastewater);</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced9254-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/2\"><num value=\"2\">(2)</num><content> significant trends affecting water availability, including each documented or projected impact to the availability of water as a result of global climate change;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced9255-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3\"><num value=\"3\">(3)</num><chapeau> the withdrawal and use of surface water and groundwater by various sectors, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced9256-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3/A\"><num value=\"A\">(A)</num><content> the agricultural sector;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced9257-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3/B\"><num value=\"B\">(B)</num><content> municipalities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced9258-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3/C\"><num value=\"C\">(C)</num><content> the industrial sector;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced9259-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3/D\"><num value=\"D\">(D)</num><content> thermoelectric power generators; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaced925a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/3/E\"><num value=\"E\">(E)</num><content> hydroelectric power generators;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced925b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/4\"><num value=\"4\">(4)</num><content> significant trends relating to each water use sector, including significant changes in water use due to the development of new energy supplies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced925c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/5\"><num value=\"5\">(5)</num><content> significant water use conflicts or shortages that have occurred or are occurring; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaced925d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/d/6\"><num value=\"6\">(6)</num><content> each factor that has caused, or is causing, a conflict or shortage described in paragraph (5).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaced925e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Authorization of appropriations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced925f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is authorized to be appropriated to carry out subsections (a), (b), and (d) $20,000,000 for each of fiscal years 2009 through 2023, to remain available until expended.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaced9260-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10368/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Grant program</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is authorized to be appropriated to carry out subsection (c) $12,500,000 for the period of fiscal years 2009 through 2013, to remain available until expended.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaced9261-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/111/11/tIX/s9508\">Pub.
