L. 114–95, title IX, § 9215(ii), Dec. 10, 2015, 129 Stat. 2175.)","seq_in_title":6144,"parent_identifier":"/us/usc/t42/ch110","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch110","level":"chapter","num":"CHAPTER 110—","heading":"FAMILY VIOLENCE PREVENTION AND SERVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd8947cbe-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402\"><num value=\"10402\">§ 10402.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this chapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cbf-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Alaska Native</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Alaska Native” has the meaning given the term “Native” in <ref href=\"/us/usc/t43/s1602\">section 1602 of title 43</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cc0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Dating violence</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “dating violence” has the meaning given such term in <ref href=\"/us/usc/t42/s12291/a\">section 12291(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cc1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Domestic violence</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “domestic violence” has the meaning given such term in <ref href=\"/us/usc/t42/s12291/a\">section 12291(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cc2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Family violence</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “family violence” means any act or threatened act of violence, including any forceful detention of an individual, that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cc3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4/A\"><num value=\"A\">(A)</num><content> results or threatens to result in physical injury; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cc4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4/B\"><num value=\"B\">(B)</num><chapeau> is committed by a person against another individual (including an elderly individual) to or with whom such person—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8947cc5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4/B/i\"><num value=\"i\">(i)</num><content> is related by blood;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8947cc6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4/B/ii\"><num value=\"ii\">(ii)</num><content> is or was related by marriage or is or was otherwise legally related; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8947cc7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/4/B/iii\"><num value=\"iii\">(iii)</num><content> is or was lawfully residing.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cc8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Indian; Indian tribe; tribal organization</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “Indian”, “Indian tribe”, and “tribal organization” have the meanings given such terms in <ref href=\"/us/usc/t25/s5304\">section 5304 of title 25</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cc9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Native Hawaiian</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Native Hawaiian” has the meaning given the term in <ref href=\"/us/usc/t20/s7517\">section 7517 of title 20</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cca-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Personally identifying information</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “personally identifying information” has the meaning given the term in <ref href=\"/us/usc/t42/s12291/a\">section 12291(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947ccb-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Secretary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Secretary” means the Secretary of Health and Human Services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947ccc-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Shelter</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “shelter” means the provision of temporary refuge and supportive services in compliance with applicable State law (including regulation) governing the provision, on a regular basis, of shelter, safe homes, meals, and supportive services to victims of family violence, domestic violence, or dating violence, and their dependents.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947ccd-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and, except as otherwise provided, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cce-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> State Domestic Violence Coalition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “State Domestic Violence Coalition” means a statewide nongovernmental nonprofit private domestic violence organization that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947ccf-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/11/A\"><num value=\"A\">(A)</num><content> has a membership that includes a majority of the primary-purpose domestic violence service providers in the State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cd0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/11/B\"><num value=\"B\">(B)</num><content> has board membership that is representative of primary-purpose domestic violence service providers, and which may include representatives of the communities in which the services are being provided in the State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cd1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/11/C\"><num value=\"C\">(C)</num><content> has as its purpose to provide education, support, and technical assistance to such service providers to enable the providers to establish and maintain shelter and supportive services for victims of domestic violence and their dependents; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cd2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/11/D\"><num value=\"D\">(D)</num><content> serves as an information clearinghouse, primary point of contact, and resource center on domestic violence for the State and supports the development of polices, protocols, and procedures to enhance domestic violence intervention and prevention in the State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cd3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Supportive services</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “supportive services” means services for adult and youth victims of family violence, domestic violence, or dating violence, and dependents exposed to family violence, domestic violence, or dating violence, that are designed to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cd4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/12/A\"><num value=\"A\">(A)</num><content> meet the needs of such victims of family violence, domestic violence, or dating violence, and their dependents, for short-term, transitional, or long-term safety; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8947cd5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/12/B\"><num value=\"B\">(B)</num><content> provide counseling, advocacy, or assistance for victims of family violence, domestic violence, or dating violence, and their dependents.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cd6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Tribally designated official</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “tribally designated official” means an individual designated by an Indian tribe, tribal organization, or nonprofit private organization authorized by an Indian tribe, to administer a grant under <ref href=\"/us/usc/t42/s10409\">section 10409 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8947cd7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s10402/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Underserved populations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “underserved populations” has the meaning given the term in <ref href=\"/us/usc/t42/s12291/a\">section 12291(a) of this title</ref>.
