L. 111–320, title II, § 201, Dec. 20, 2010, 124 Stat. 3487.)","seq_in_title":6146,"parent_identifier":"/us/usc/t42/ch110","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch110","level":"chapter","num":"CHAPTER 110—","heading":"FAMILY VIOLENCE PREVENTION AND SERVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idacee07da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404\"><num value=\"10404\">§ 10404.</num><heading> Authority of Secretary</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacee07db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authorities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In order to carry out the provisions of this chapter, the Secretary is authorized to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a/1\"><num value=\"1\">(1)</num><content> appoint and fix the compensation of such personnel as are necessary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a/2\"><num value=\"2\">(2)</num><content> procure, to the extent authorized by <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref>, such temporary and intermittent services of experts and consultants as are necessary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a/3\"><num value=\"3\">(3)</num><content> make grants to eligible entities or enter into contracts with for-profit or nonprofit nongovernmental entities and establish reporting requirements for such grantees and contractors;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a/4\"><num value=\"4\">(4)</num><content> prescribe such regulations and guidance as are reasonably necessary in order to carry out the objectives and provisions of this chapter, including regulations and guidance on implementing new grant conditions established or provisions modified by amendments made to this chapter by the CAPTA Reauthorization Act of 2010, to ensure accountability and transparency of the actions of grantees and contractors, or as determined by the Secretary to be reasonably necessary to carry out this chapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/a/5\"><num value=\"5\">(5)</num><content> coordinate programs within the Department of Health and Human Services, and seek to coordinate those programs with programs administered by other Federal agencies, that involve or affect efforts to prevent family violence, domestic violence, and dating violence or the provision of assistance for adult and youth victims of family violence, domestic violence, or dating violence.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacee07e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Administration</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/1\"><num value=\"1\">(1)</num><content> assign 1 or more employees of the Department of Health and Human Services to carry out the provisions of this chapter, including carrying out evaluation and monitoring under this chapter, which employees shall, prior to such appointment, have expertise in the field of family violence and domestic violence prevention and services and, to the extent practicable, have expertise in the field of dating violence;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/2\"><num value=\"2\">(2)</num><content> provide technical assistance in the conduct of programs for the prevention and treatment of family violence, domestic violence, and dating violence;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee07e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/3\"><num value=\"3\">(3)</num><chapeau> provide for and coordinate research into the most effective approaches to the intervention in and prevention of family violence, domestic violence, and dating violence, by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacee07e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/3/A\"><num value=\"A\">(A)</num><content> consulting with experts and program providers within the family violence, domestic violence, and dating violence field to identify gaps in research and knowledge, establish research priorities, and disseminate research findings;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacee2ef6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/3/B\"><num value=\"B\">(B)</num><content> collecting and reporting data on the provision of family violence, domestic violence, and dating violence services, including assistance and programs supported by Federal funds made available under this chapter and by other governmental or nongovernmental sources of funds; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacee2ef7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/3/C\"><num value=\"C\">(C)</num><content> coordinating family violence, domestic violence, and dating violence research efforts within the Department of Health and Human Services with relevant research administered or carried out by other Federal agencies and other researchers, including research on the provision of assistance for adult and youth victims of family violence, domestic violence, or dating violence; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacee2ef8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/b/4\"><num value=\"4\">(4)</num><content> support the development and implementation of effective policies, protocols, and programs within the Department and at other Federal agencies that address the safety and support needs of adult and youth victims of family violence, domestic violence, or dating violence.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacee2ef9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10404/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Reports</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Every 2 years, the Secretary shall review and evaluate the activities conducted by grantees, subgrantees, and contractors under this chapter and the effectiveness of the programs administered pursuant to this chapter, and submit a report containing the evaluation to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate. Such report shall also include a summary of the documentation provided to the Secretary through performance reports submitted under <ref href=\"/us/usc/t42/s10406/d\">section 10406(d) of this title</ref>.
