<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd896c649-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408"><num value="10408">§ 10408.</num><heading> Subgrants and uses of funds</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd896c64a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/a"><num value="a" class="bold">(a)</num><heading class="bold"> Subgrants</heading><content><p style="-uslm-lc:I11" class="indent0">A State that receives a grant under <ref href="/us/usc/t42/s10406/a">section 10406(a) of this title</ref> shall use grant funds described in <ref href="/us/usc/t42/s10406/b/2">section 10406(b)(2) of this title</ref> to provide subgrants to eligible entities for programs and projects within such State, that is <ref class="footnoteRef" idref="fn003887">1</ref><note type="footnote" id="fn003887"><num>1</num> So in original. Probably should be “are”.</note> designed to prevent incidents of family violence, domestic violence, and dating violence by providing immediate shelter and supportive services for adult and youth victims of family violence, domestic violence, or dating violence (and their dependents), and that may provide prevention services to prevent future incidents of family violence, domestic violence, and dating violence.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd896c64b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b"><num value="b" class="bold">(b)</num><heading class="bold"> Use of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd896c64c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Funds awarded to eligible entities under subsection (a) shall be used to provide shelter, supportive services, or prevention services to adult and youth victims of family violence, domestic violence, or dating violence, and their dependents, which may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c64d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/A"><num value="A">(A)</num><content> provision, on a regular basis, of immediate shelter and related supportive services to adult and youth victims of family violence, domestic violence, or dating violence, and their dependents, including paying for the operating and administrative expenses of the facilities for such shelter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c64e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/B"><num value="B">(B)</num><content> assistance in developing safety plans, and supporting efforts of victims of family violence, domestic violence, or dating violence to make decisions related to their ongoing safety and well-being;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c64f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/C"><num value="C">(C)</num><content> provision of individual and group counseling, peer support groups, and referral to community-based services to assist family violence, domestic violence, and dating violence victims, and their dependents, in recovering from the effects of the violence;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c650-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/D"><num value="D">(D)</num><content> provision of services, training, technical assistance, and outreach to increase awareness of family violence, domestic violence, and dating violence and increase the accessibility of family violence, domestic violence, and dating violence services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c651-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/E"><num value="E">(E)</num><content> provision of culturally and linguistically appropriate services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c652-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/F"><num value="F">(F)</num><content> provision of services for children exposed to family violence, domestic violence, or dating violence, including age-appropriate counseling, supportive services, and services for the nonabusing parent that support that parent’s role as a caregiver, which may, as appropriate, include services that work with the nonabusing parent and child together;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c653-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G"><num value="G">(G)</num><chapeau> provision of advocacy, case management services, and information and referral services, concerning issues related to family violence, domestic violence, or dating violence intervention and prevention, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd896c654-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/i"><num value="i">(i)</num><content> assistance in accessing related Federal and State financial assistance programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd896c655-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/ii"><num value="ii">(ii)</num><content> legal advocacy to assist victims and their dependents;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd896c656-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/iii"><num value="iii">(iii)</num><content> medical advocacy, including provision of referrals for appropriate health care services (including mental health, alcohol, and drug abuse treatment), but which shall not include reimbursement for any health care services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd896c657-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/iv"><num value="iv">(iv)</num><content> assistance locating and securing safe and affordable permanent housing and homelessness prevention services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd896c658-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/v"><num value="v">(v)</num><content> provision of transportation, child care, respite care, job training and employment services, financial literacy services and education, financial planning, and related economic empowerment services; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd896c659-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/G/vi"><num value="vi">(vi)</num><content> parenting and other educational services for victims and their dependents; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c65a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/1/H"><num value="H">(H)</num><content> prevention services, including outreach to underserved populations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd896c65b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Shelter and supportive services</heading><content><p style="-uslm-lc:I12" class="indent1">Not less than 70 percent of the funds distributed by a State under subsection (a) shall be distributed to entities for the primary purpose of providing immediate shelter and supportive services to adult and youth victims of family violence, domestic violence, or dating violence, and their dependents, as described in paragraph (1)(A). Not less than 25 percent of the funds distributed by a State under subsection (a) shall be distributed to entities for the purpose of providing supportive services and prevention services as described in subparagraphs (B) through (H) of paragraph (1).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd896c65c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/c"><num value="c" class="bold">(c)</num><heading class="bold"> Eligible entities</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible to receive a subgrant from a State under this section, an entity shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd896c65d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/c/1"><num value="1">(1)</num><content> a local public agency, or a nonprofit private organization (including faith-based and charitable organizations, community-based organizations, tribal organizations, and voluntary associations), that assists victims of family violence, domestic violence, or dating violence, and their dependents, and has a documented history of effective work concerning family violence, domestic violence, or dating violence; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd896c65e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/c/2"><num value="2">(2)</num><chapeau> a partnership of 2 or more agencies or organizations that includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c65f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/c/2/A"><num value="A">(A)</num><content> an agency or organization described in paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd896c660-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/c/2/B"><num value="B">(B)</num><content> an agency or organization that has a demonstrated history of serving populations in their communities, including providing culturally appropriate services.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd896c661-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/d"><num value="d" class="bold">(d)</num><heading class="bold"> Conditions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd896c662-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Direct payments to victims or dependants</heading><content><p style="-uslm-lc:I12" class="indent1">No funds provided under this chapter may be used as direct payment to any victim of family violence, domestic violence, or dating violence, or to any dependent of such victim.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd896c663-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s10408/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Voluntarily accepted services</heading><content><p style="-uslm-lc:I12" class="indent1">Receipt of supportive services under this chapter shall be voluntary. No condition may be applied for the receipt of emergency shelter as described in subsection (b)(1)(A).</p>
