L. 111–320, title II, § 201, Dec. 20, 2010, 124 Stat. 3507.)","seq_in_title":6156,"parent_identifier":"/us/usc/t42/ch110","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch110","level":"chapter","num":"CHAPTER 110—","heading":"FAMILY VIOLENCE PREVENTION AND SERVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idacf0a016-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414\"><num value=\"10414\">§ 10414.</num><heading> Domestic Violence Prevention Enhancement and Leadership Through Alliances (DELTA)</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0a017-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into cooperative agreements with State Domestic Violence Coalitions for the purposes of establishing, operating, and maintaining local community projects to prevent family violence, domestic violence, and dating violence, including violence committed by and against youth, using a coordinated community response model and through prevention and education programs.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0a018-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Term</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into a cooperative agreement under this section for a period of not more than 5 fiscal years.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0a019-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Conditions on payment</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The provision of payments under a cooperative agreement under this section shall be subject to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a01a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/c/1\"><num value=\"1\">(1)</num><content> annual approval by the Secretary; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a01b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/c/2\"><num value=\"2\">(2)</num><content> the availability of appropriations for each fiscal year to make the payments.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0a01c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be eligible to enter into a cooperative agreement under this section, an organization shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a01d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/1\"><num value=\"1\">(1)</num><content> be a State Domestic Violence Coalition; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a01e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2\"><num value=\"2\">(2)</num><chapeau> include representatives of pertinent sectors of the local community, which may include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a01f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/A\"><num value=\"A\">(A)</num><content> health care providers and State or local health departments;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a020-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/B\"><num value=\"B\">(B)</num><content> the education community;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a021-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/C\"><num value=\"C\">(C)</num><content> the faith-based community;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a022-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/D\"><num value=\"D\">(D)</num><content> the criminal justice system;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a023-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/E\"><num value=\"E\">(E)</num><content> family violence, domestic violence, and dating violence service program advocates;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a024-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/F\"><num value=\"F\">(F)</num><content> human service entities such as State child services divisions;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a025-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/G\"><num value=\"G\">(G)</num><content> business and civic leaders; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0a026-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/d/2/H\"><num value=\"H\">(H)</num><content> other pertinent sectors.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0a027-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Applications</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An organization that desires to enter into a cooperative agreement under this section shall submit to the Secretary an application, in such form and in such manner as the Secretary shall require, that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a028-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/1\"><num value=\"1\">(1)</num><content> demonstrates the capacity of the applicant, who may enter into a partnership with a local family violence, domestic violence, or dating violence service provider or community-based organization, to undertake the project involved;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0a029-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/2\"><num value=\"2\">(2)</num><content> demonstrates that the project will include a coordinated community response to improve and expand prevention strategies through increased communication and coordination among all affected sectors of the local community;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0c73a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/3\"><num value=\"3\">(3)</num><chapeau> includes a complete description of the applicant’s plan for the establishment and implementation of the coordinated community response, including a description of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c73b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/3/A\"><num value=\"A\">(A)</num><content> the method to be used for identification and selection of an administrative committee made up of persons knowledgeable about comprehensive family violence, domestic violence, and dating violence prevention planning to oversee the project, hire staff, assure compliance with the project outline, and secure annual evaluation of the project;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c73c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/3/B\"><num value=\"B\">(B)</num><content> the method to be used for identification and selection of project staff and a project evaluator;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c73d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/3/C\"><num value=\"C\">(C)</num><content> the method to be used for identification and selection of a project council consisting of representatives of the community sectors listed in subsection (d)(2); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c73e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/3/D\"><num value=\"D\">(D)</num><content> the method to be used for identification and selection of a steering committee consisting of representatives of the various community sectors who will chair subcommittees of the project council, each of which will focus on 1 of the sectors;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0c73f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/4\"><num value=\"4\">(4)</num><content> demonstrates that the applicant has experience in providing, or the capacity to provide, prevention-focused training and technical assistance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0c740-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/5\"><num value=\"5\">(5)</num><content> demonstrates that the applicant has the capacity to carry out collaborative community initiatives to prevent family violence, domestic violence, and dating violence; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacf0c741-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/e/6\"><num value=\"6\">(6)</num><content> contains such other information, agreements, and assurances as the Secretary may require.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0c742-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Geographical dispersion</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into cooperative agreements under this section with organizations in States geographically dispersed throughout the Nation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0c743-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Use of funds</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacf0c744-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An organization that enters into a cooperative agreement under subsection (a) shall use the funds made available through the agreement to establish, operate, and maintain comprehensive family violence, domestic violence, and dating violence prevention programming.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacf0c745-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Technical assistance, evaluation and monitoring</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may use a portion of the funds provided under this section to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c746-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/2/A\"><num value=\"A\">(A)</num><content> provide technical assistance;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c747-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/2/B\"><num value=\"B\">(B)</num><content> monitor the performance of organizations carrying out activities under the cooperative agreements; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c748-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/2/C\"><num value=\"C\">(C)</num><content> conduct an independent evaluation of the program carried out under this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacf0c749-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In establishing and operating a project under this section, an eligible organization shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c74a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/A\"><num value=\"A\">(A)</num><content> establish protocols to improve and expand family violence, domestic violence, and dating violence prevention and intervention strategies within affected community sectors described in subsection (d)(2);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c74b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/B\"><num value=\"B\">(B)</num><content> develop comprehensive prevention plans to coordinate prevention efforts with other community sectors;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c74c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/C\"><num value=\"C\">(C)</num><content> provide for periodic evaluation of the project, and analysis to assist in replication of the prevention strategies used in the project in other communities, and submit a report under subsection (h) that contains the evaluation and analysis;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0c74d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D\"><num value=\"D\">(D)</num><chapeau> develop, replicate, or conduct comprehensive, evidence-informed primary prevention programs that reduce risk factors and promote protective factors that reduce the likelihood of family violence, domestic violence, and dating violence, which may include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0c74e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/i\"><num value=\"i\">(i)</num><content> educational workshops and seminars;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0c74f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/ii\"><num value=\"ii\">(ii)</num><content> training programs for professionals;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0c750-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/iii\"><num value=\"iii\">(iii)</num><content> the preparation of informational material;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0ed61-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/iv\"><num value=\"iv\">(iv)</num><content> developmentally appropriate education programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0ed62-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/v\"><num value=\"v\">(v)</num><content> other efforts to increase awareness of the facts about, or to help prevent, family violence, domestic violence, and dating violence; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacf0ed63-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/D/vi\"><num value=\"vi\">(vi)</num><content> the dissemination of information about the results of programs conducted under this subparagraph;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0ed64-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/E\"><num value=\"E\">(E)</num><content> utilize evidence-informed prevention program planning; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacf0ed65-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/g/3/F\"><num value=\"F\">(F)</num><content> recognize, in applicable cases, the needs of underserved populations, racial and linguistic populations, and individuals with disabilities.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacf0ed66-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s10414/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Reports and evaluation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each organization entering into a cooperative agreement under this section shall submit a performance report to the Secretary at such time as shall be reasonably required by the Secretary. Such performance report shall describe activities that have been carried out with the funds made available through the agreement, contain an evaluation of the effectiveness of such activities, and provide such additional information as the Secretary may reasonably require. The Secretary shall make the evaluations received under this subsection publicly available on the Department of Health and Human Services website.
