<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8f36fe8e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701"><num value="10701">§ 10701.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter, the term—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8f36fe8f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/1"><num value="1">(1)</num><content> “Board” means the Board of Directors of the Institute;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f36fe90-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/2"><num value="2">(2)</num><content> “Director” means the Executive Director of the Institute;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a1-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/3"><num value="3">(3)</num><content> “Governor” means the Chief Executive Officer of a State;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a2-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/4"><num value="4">(4)</num><content> “Institute” means the State Justice Institute;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a3-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/5"><num value="5">(5)</num><content> “recipient” means any grantee, contractor, or recipient of financial assistance under this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a4-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/6"><num value="6">(6)</num><content> “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and any other territory or possession of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a5-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/7"><num value="7">(7)</num><content> “Supreme Court” means the highest appellate court within a State unless, for the purposes of this chapter, a constitutionally or legislatively established judicial council acts in place of that court; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8f3725a6-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8"><num value="8">(8)</num><chapeau> “domestic violence” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8f3725a7-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/A"><num value="A">(A)</num><chapeau> any action that constitutes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8f3725a8-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/A/i"><num value="i">(i)</num><content> attempting to cause or intentionally, knowingly, or recklessly causing bodily injury or physical illness;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8f3725a9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/A/ii"><num value="ii">(ii)</num><content> rape, sexual assault, or causing involuntary deviate sexual intercourse;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8f3725aa-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/A/iii"><num value="iii">(iii)</num><content> placing by physical menace another in fear of imminent serious bodily injury; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8f3725ab-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/A/iv"><num value="iv">(iv)</num><content> the infliction of false imprisonment;</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">if such action is taken by one of 2 spouses, former spouses, or sexual or intimate partners against the other spouse, former spouse, or partner and the 2 of whom share biological parenthood of, have adopted, are legal custodians of, or are stepparents of a minor child; or</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8f3725ac-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s10701/8/B"><num value="B">(B)</num><content> physically or sexually abusing such minor child if such abuse is inflicted by either of such spouses, former spouses, or partners.</content>
