<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacf1631e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702"><num value="10702">§ 10702.</num><heading> Establishment of Institute; duties</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf1631f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment; purpose; incorporation; powers</heading><content><p style="-uslm-lc:I11" class="indent0">There is established a private nonprofit corporation which shall be known as the State Justice Institute. The purpose of the Institute shall be to further the development and adoption of improved judicial administration in State courts in the United States. The Institute may be incorporated in any State pursuant to <ref href="/us/usc/t42/s10703/a/6">section 10703(a)(6) of this title</ref>. To the extent consistent with the provisions of this chapter, the Institute may exercise the powers conferred upon a nonprofit corporation by the laws of the State in which it is incorporated.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf16320-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I11" class="indent0">The Institute shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idacf16321-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/1"><num value="1">(1)</num><chapeau> direct a national program of assistance designed to assure each person ready access to a fair and effective system of justice by providing funds to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacf16322-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/1/A"><num value="A">(A)</num><content> State courts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacf16323-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/1/B"><num value="B">(B)</num><content> national organizations which support and are supported by State courts; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacf16324-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/1/C"><num value="C">(C)</num><content> any other nonprofit organization that will support and achieve the purposes of this chapter;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacf16325-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/2"><num value="2">(2)</num><content> foster coordination and cooperation with the Federal judiciary in areas of mutual concern;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacf16326-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/3"><num value="3">(3)</num><content> promote recognition of the importance of the separation of powers doctrine to an independent judiciary; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacf16327-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/b/4"><num value="4">(4)</num><content> encourage education for judges and support personnel of State court systems through national and State organizations, including universities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf16328-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duplication of functions; responsibility of State agencies</heading><content><p style="-uslm-lc:I11" class="indent0">The Institute shall not duplicate functions adequately performed by existing nonprofit organizations and shall promote, on the part of agencies of State judicial administration, responsibility for the success and effectiveness of State court improvement programs supported by Federal funding.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf16329-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/d"><num value="d" class="bold">(d)</num><heading class="bold"> Maintenance of offices in State of incorporation; agent for receipt of service of process</heading><content><p style="-uslm-lc:I11" class="indent0">The Institute shall maintain its principal offices in the State in which it is incorporated and shall maintain therein a designated agent to accept service of process for the Institute. Notice to or service upon the agent shall be deemed notice to or service upon the Institute.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf1632a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/e"><num value="e" class="bold">(e)</num><heading class="bold"> Tax status of Institute and programs assisted thereby</heading><content><p style="-uslm-lc:I11" class="indent0">The Institute, and any program assisted by the Institute, shall be eligible to be treated as an organization described in <ref href="/us/usc/t26/s170/c/2/B">section 170(c)(2)(B) of title 26</ref> and as an organization described in <ref href="/us/usc/t26/s501/c/3">section 501(c)(3) of title 26</ref> which is exempt from taxation under <ref href="/us/usc/t26/s501/a">section 501(a) of title 26</ref>. If such treatments are conferred in accordance with the provisions of title 26, the Institute, and programs assisted by the Institute, shall be subject to all provisions of title 26 relevant to the conduct of organizations exempt from taxation.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacf1632b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s10702/f"><num value="f" class="bold">(f)</num><heading class="bold"> Rules, regulations, etc.; notice and comment</heading><content><p style="-uslm-lc:I11" class="indent0">The Institute shall afford notice and reasonable opportunity for comment to interested parties prior to issuing rules, regulations, guidelines, and instructions under this chapter, and it shall publish in the Federal Register all rules, regulations, guidelines, and instructions.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> develop training materials to assist—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> battered women, operators of domestic violence shelters, battered women’s advocates, and attorneys to use such expert testimony in appropriate cases, particularly appropriate cases involving indigent women defendants, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> individuals with expertise in the experiences of battered women to develop skills appropriate to providing such expert testimony, and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> disseminate such information and such training materials, and provide related technical assistance, to battered women, such operators, such advocates, such attorneys, and such individuals.</content>
