L. 105–33, title V, § 5402(a), Aug. 5, 1997, 111 Stat. 603.)","seq_in_title":1685,"parent_identifier":"/us/usc/t42/ch7/schIX","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schIX","level":"subchapter","num":"SUBCHAPTER IX—","heading":"EMPLOYMENT SECURITY ADMINISTRATIVE FINANCING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida6eae0b4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102\"><num value=\"1102\">§ 1102.</num><heading> Transfers between Federal unemployment account and employment security administration account</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6eae0b5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Determination of excess; amount transferred</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the Secretary of the Treasury determines pursuant to <ref href=\"/us/usc/t42/s1101/f\">section 1101(f) of this title</ref> that there is an excess in the employment security administration account as of the close of any fiscal year and the entire amount of such excess is not retained in the employment security administration account or transferred to the extended unemployment compensation account as provided in <ref href=\"/us/usc/t42/s1101/f/3\">section 1101(f)(3) of this title</ref>, there shall be transferred (as of the beginning of the succeeding fiscal year) to the Federal unemployment account the balance of such excess or so much thereof as is required to increase the amount in the Federal unemployment account to whichever of the following is the greater:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6eae0b6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102/a/1\"><num value=\"1\">(1)</num><content> $550 million, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6eae0b7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102/a/2\"><num value=\"2\">(2)</num><content> the amount (determined by the Secretary of Labor and certified by him to the Secretary of the Treasury) equal to 0.5 percent of the total wages subject (determined without any limitation on amount) to contributions under all State unemployment compensation laws for the calendar year ending during the fiscal year for which the excess is determined.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6eae0b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Unemployment account excesses</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The amount, if any, by which the amount in the Federal unemployment account as of the close of any fiscal year exceeds the greater of the amounts specified in paragraphs (1) and (2) of subsection (a) shall be transferred to the employment security administration account as of the close of such fiscal year.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6eae0b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1102/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Report to Congress</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the Secretary of Labor has reason to believe that in the next fiscal year the employment security administration account will reach the limit provided for such account in <ref href=\"/us/usc/t42/s1101/f/3/A\">section 1101(f)(3)(A) of this title</ref>, and the Federal unemployment account will reach the limit provided for such account in subsection (a), and the extended unemployment compensation account will reach the limit provided for such account in <ref href=\"/us/usc/t42/s1105/b/2\">section 1105(b)(2) of this title</ref>, he shall, after consultation with the Secretary of the Treasury, so report to the Congress with a recommendation for appropriate action by the Congress.</p>\n</content>\n</subsection>\n<sourceCredit id=\"ida6eae0ba-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1935-08-14/ch531\">Aug. 14, 1935, ch. 531</ref>, title IX, § 902, as added <ref href=\"/us/act/1954-08-05/ch657/s2\">Aug. 5, 1954, ch. 657, § 2</ref>, <ref href=\"/us/stat/68/669\">68 Stat. 669</ref>; amended <ref href=\"/us/pl/86/778/tV/s521\">Pub.
