L. 99–499, title III, § 329, Oct. 17, 1986, 100 Stat. 1757.)","seq_in_title":6241,"parent_identifier":"/us/usc/t42/ch116/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch116","level":"chapter","num":"CHAPTER 116—","heading":"EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch116/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f3fd813-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049\"><num value=\"11049\">§ 11049.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter—</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd814-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Administrator</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Administrator” means the Administrator of the Environmental Protection Agency.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd815-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Environment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “environment” includes water, air, and land and the interrelationship which exists among and between water, air, and land and all living things.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd816-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Extremely hazardous substance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “extremely hazardous substance” means a substance on the list described in <ref href=\"/us/usc/t42/s11002/a/2\">section 11002(a)(2) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd817-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Facility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “facility” means all buildings, equipment, structures, and other stationary items which are located on a single site or on contiguous or adjacent sites and which are owned or operated by the same person (or by any person which controls, is controlled by, or under common control with, such person). For purposes of <ref href=\"/us/usc/t42/s11004\">section 11004 of this title</ref>, the term includes motor vehicles, rolling stock, and aircraft.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd818-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Hazardous chemical</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “hazardous chemical” has the meaning given such term by <ref href=\"/us/usc/t42/s11021/e\">section 11021(e) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd819-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Material safety data sheet</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “material safety data sheet” means the sheet required to be developed under section 1910.1200(g) of title 29 of the Code of Federal Regulations, as that section may be amended from time to time.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd81a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Person</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “person” means any individual, trust, firm, joint stock company, corporation (including a government corporation), partnership, association, State, municipality, commission, political subdivision of a State, or interstate body.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd81b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Release</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “release” means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment (including the abandonment or discarding of barrels, containers, and other closed receptacles) of any hazardous chemical, extremely hazardous substance, or toxic chemical.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd81c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, the Northern Mariana Islands, and any other territory or possession over which the United States has jurisdiction.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f3fd81d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11049/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Toxic chemical</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “toxic chemical” means a substance on the list described in <ref href=\"/us/usc/t42/s11023/c\">section 11023(c) of this title</ref>.</p>\n</content>\n</paragraph>\n<sourceCredit id=\"id8f3fd81e-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/99/499/tIII/s329\">Pub.
