<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6edc6cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108"><num value="1108">§ 1108.</num><heading> Advisory Council on Unemployment Compensation</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6edc6cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than <date date="1992-02-01">February 1, 1992</date>, and every 4th year thereafter, the Secretary of Labor shall establish an advisory council to be known as the Advisory Council on Unemployment Compensation (referred to in this section as the “Council”).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6edc6ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/b"><num value="b" class="bold">(b)</num><heading class="bold"> Function</heading><content><p style="-uslm-lc:I11" class="indent0">It shall be the function of each Council to evaluate the unemployment compensation program, including the purpose, goals, countercyclical effectiveness, coverage, benefit adequacy, trust fund solvency, funding of State administrative costs, administrative efficiency, and any other aspects of the program and to make recommendations for improvement.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6ededdf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c"><num value="c" class="bold">(c)</num><heading class="bold"> Members</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6edede0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Each Council shall consist of 11 members as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/1/A"><num value="A">(A)</num><content> 5 members appointed by the President, to include representatives of business, labor, State government, and the public.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/1/B"><num value="B">(B)</num><content> 3 members appointed by the President pro tempore of the Senate, in consultation with the Chairman and ranking member of the Committee on Finance of the Senate.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/1/C"><num value="C">(C)</num><content> 3 members appointed by the Speaker of the House of Representatives, in consultation with the Chairman and ranking member of the Committee on Ways and Means of the House of Representatives.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6edede4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Qualifications</heading><chapeau style="-uslm-lc:I12" class="indent1">In appointing members under subparagraphs (B) and (C) of paragraph (1), the President pro tempore of the Senate and the Speaker of the House of Representatives shall each appoint—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/2/A"><num value="A">(A)</num><content> 1 representative of the interests of business,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/2/B"><num value="B">(B)</num><content> 1 representative of the interests of labor, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6edede7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/2/C"><num value="C">(C)</num><content> 1 representative of the interests of State governments.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6edede8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Vacancies</heading><content><p style="-uslm-lc:I12" class="indent1">A vacancy in any Council shall be filled in the manner in which the original appointment was made.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6edede9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Chairman</heading><content><p style="-uslm-lc:I12" class="indent1">The President shall appoint the Chairman of the Council from among its members.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6ededea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/d"><num value="d" class="bold">(d)</num><heading class="bold"> Staff and other assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6ededeb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each Council may engage any technical assistance (including actuarial services) required by the Council to carry out its functions under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6ededec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Assistance from Secretary of Labor</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary of Labor shall provide each Council with any staff, office facilities, and other assistance, and any data prepared by the Department of Labor, required by the Council to carry out its functions under this section.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6ededed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/e"><num value="e" class="bold">(e)</num><heading class="bold"> Compensation</heading><chapeau style="-uslm-lc:I11" class="indent0">Each member of any Council—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6ededee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/e/1"><num value="1">(1)</num><content> shall be entitled to receive compensation at the rate of pay for level V of the Executive Schedule under <ref href="/us/usc/t5/s5316">section 5316 of title 5</ref> for each day (including travel time) during which such member is engaged in the actual performance of duties vested in the Council, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6ededef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/e/2"><num value="2">(2)</num><content> while engaged in the performance of such duties away from such member’s home or regular place of business, shall be allowed travel expenses (including per diem in lieu of subsistence) as authorized by <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref> for persons in the Government employed intermittently.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6ededf0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/f"><num value="f" class="bold">(f)</num><heading class="bold"> Report</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6ededf1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than February 1 of the third year following the year in which any Council is required to be established under subsection (a), the Council shall submit to the President and the Congress a report setting forth the findings and recommendations of the Council as a result of its evaluation of the unemployment compensation program under this section.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6ededf2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1108/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report of first Council</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall include in its report required to be submitted by <date date="1995-02-01">February 1, 1995</date>, the Council’s findings and recommendations with respect to determining eligibility for extended unemployment benefits on the basis of unemployment statistics for regions, States, or subdivisions of States.</p>
