<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89e9ba0a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111"><num value="1111">§ 1111.</num><heading> Data exchange standardization for improved interoperability</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89e9ba0b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a"><num value="a" class="bold">(a)</num><heading class="bold"> Data exchange standards</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id89e9ba0c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/1"><num value="1">(1)</num><content> The Secretary of Labor, in consultation with an interagency work group which shall be established by the Office of Management and Budget, and considering State and employer perspectives, shall, by rule, designate a data exchange standard for any category of information required under subchapter III, subchapter XII, or this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id89e9ba0d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/2"><num value="2">(2)</num><content> Data exchange standards designated under paragraph (1) shall, to the extent practicable, be nonproprietary and interoperable.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id89e9ba0e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/3"><num value="3">(3)</num><chapeau> In designating data exchange standards under this subsection, the Secretary of Labor shall, to the extent practicable, incorporate—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9ba0f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/3/A"><num value="A">(A)</num><content> interoperable standards developed and maintained by an international voluntary consensus standards body, as defined by the Office of Management and Budget, such as the International Organization for Standardization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9ba10-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/3/B"><num value="B">(B)</num><content> interoperable standards developed and maintained by intergovernmental partnerships, such as the National Information Exchange Model; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9ba11-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/a/3/C"><num value="C">(C)</num><content> interoperable standards developed and maintained by Federal entities with authority over contracting and financial assistance, such as the Federal Acquisition Regulations Council.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89e9e122-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b"><num value="b" class="bold">(b)</num><heading class="bold"> Data exchange standards for reporting</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id89e9e123-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/1"><num value="1">(1)</num><content> The Secretary of Labor, in consultation with an interagency work group established by the Office of Management and Budget, and considering State and employer perspectives, shall, by rule, designate data exchange standards to govern the reporting required under subchapter III, subchapter XII, or this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id89e9e124-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/2"><num value="2">(2)</num><chapeau> The data exchange standards required by paragraph (1) shall, to the extent practicable—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9e125-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/2/A"><num value="A">(A)</num><content> incorporate a widely accepted, nonproprietary, searchable, computer-readable format;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9e126-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/2/B"><num value="B">(B)</num><content> be consistent with and implement applicable accounting principles; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id89e9e127-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/2/C"><num value="C">(C)</num><content> be capable of being continually upgraded as necessary.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="id89e9e128-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s1111/b/3"><num value="3">(3)</num><content> In designating reporting standards under this subsection, the Secretary of Labor shall, to the extent practicable, incorporate existing nonproprietary standards, such as the eXtensible Markup Language.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> <inline class="small-caps">Data reporting standards</inline>.—</heading><content>The reporting standards required under section 911(b)(1) of such Act [<ref href="/us/usc/t42/s1111/b/1">42 U.S.C. 1111(b)(1)</ref>] (as so added) shall become effective with respect to reports required in the first reporting period, after the effective date of the final rule referred to in paragraph (1) of this subsection, for which the authority for data collection and reporting is established or renewed under the Paperwork Reduction Act [<ref href="/us/usc/t44/s3501">44 U.S.C. 3501</ref> et seq.].”</content>
