<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacfb9c1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225"><num value="11225">§ 11225.</num><heading> The National Alzheimer’s Project</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfb9c1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of Alzheimer’s</heading><content><p style="-uslm-lc:I11" class="indent0">In this Act, the term “Alzheimer’s” means Alzheimer’s disease and related dementias.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfb9c1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established in the Office of the Secretary of Health and Human Services the National Alzheimer’s Project (referred to in this Act as the “Project”).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfb9c1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c"><num value="c" class="bold">(c)</num><heading class="bold"> Purpose of the Project</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Health and Human Services, or the Secretary’s designee, shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/1"><num value="1">(1)</num><content> be responsible for the creation and maintenance of an integrated national plan to overcome Alzheimer’s;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/2"><num value="2">(2)</num><content> provide information and coordination of Alzheimer’s research and services across all Federal agencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/3"><num value="3">(3)</num><content> accelerate the development of treatments that would prevent, halt, or reverse the course of Alzheimer’s;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/4"><num value="4">(4)</num><chapeau> improve the—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacfb9c24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/4/A"><num value="A">(A)</num><content> early diagnosis of Alzheimer’s disease; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfb9c25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/4/B"><num value="B">(B)</num><content> coordination of the care and treatment of citizens with Alzheimer’s;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/5"><num value="5">(5)</num><content> ensure the inclusion of ethnic and racial populations at higher risk for Alzheimer’s or least likely to receive care, in clinical, research, and service efforts with the purpose of decreasing health disparities in Alzheimer’s; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfb9c27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/c/6"><num value="6">(6)</num><content> coordinate with international bodies to integrate and inform the fight against Alzheimer’s globally.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfb9c28-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/d"><num value="d" class="bold">(d)</num><heading class="bold"> Duties of the Secretary</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfb9c29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary of Health and Human Services, or the Secretary’s designee, shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacfb9c2a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/d/1/A"><num value="A">(A)</num><content> oversee the creation and updating of the national plan described in paragraph (2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbc33b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/d/1/B"><num value="B">(B)</num><content> use discretionary authority to evaluate all Federal programs around Alzheimer’s, including budget requests and approvals.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc33c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> National plan</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary of Health and Human Services, or the Secretary’s designee, shall carry out an annual assessment of the Nation’s progress in preparing for the escalating burden of Alzheimer’s, including both implementation steps and recommendations for priority actions based on the assessment.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfbc33d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e"><num value="e" class="bold">(e)</num><heading class="bold"> Advisory Council</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc33e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There is established an Advisory Council on Alzheimer’s Research, Care, and Services (referred to in this Act as the “Advisory Council”).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc33f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Membership</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacfbc340-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Federal members</heading><chapeau style="-uslm-lc:I13" class="indent2">The Advisory Council shall be comprised of the following experts:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacfbc341-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/i"><num value="i">(i)</num><content> A designee of the Centers for Disease Control and Prevention.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc342-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/ii"><num value="ii">(ii)</num><content> A designee of the Administration on Aging.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc343-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/iii"><num value="iii">(iii)</num><content> A designee of the Centers for Medicare &amp; Medicaid Services.</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacfbc344-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/iv"><num value="iv">(iv)</num><content> A designee of the Indian Health Service.</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacfbc348-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/viii"><num value="viii">(viii)</num><content> A designee of the Department of Veterans Affairs.</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacfbc349-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/ix"><num value="ix">(ix)</num><content> A designee of the Food and Drug Administration.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc34a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/A/x"><num value="x">(x)</num><content> A designee of the Agency for Healthcare Research and Quality.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacfbc34b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Non-Federal members</heading><chapeau style="-uslm-lc:I13" class="indent2">In addition to the members outlined in subparagraph (A), the Advisory Council shall include 12 expert members from outside the Federal Government, which shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacfbc34c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/i"><num value="i">(i)</num><content> 2 Alzheimer’s patient advocates;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc34d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/ii"><num value="ii">(ii)</num><content> 2 Alzheimer’s caregivers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc34e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/iii"><num value="iii">(iii)</num><content> 2 health care providers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc34f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/iv"><num value="iv">(iv)</num><content> 2 representatives of State health departments;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc350-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/v"><num value="v">(v)</num><content> 2 researchers with Alzheimer’s-related expertise in basic, translational, clinical, or drug development science; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc351-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/2/B/vi"><num value="vi">(vi)</num><content> 2 voluntary health association representatives, including a national Alzheimer’s disease organization that has demonstrated experience in research, care, and patient services, and a State-based advocacy organization that provides services to families and professionals, including information and referral, support groups, care consultation, education, and safety services.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc352-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Meetings</heading><content><p style="-uslm-lc:I12" class="indent1">The Advisory Council shall meet quarterly and such meetings shall be open to the public.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc353-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Advice</heading><content><p style="-uslm-lc:I12" class="indent1">The Advisory Council shall advise the Secretary of Health and Human Services, or the Secretary’s designee.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc354-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5"><num value="5" class="bold">(5)</num><heading class="bold"> Annual report</heading><chapeau style="-uslm-lc:I12" class="indent1">The Advisory Council shall provide to the Secretary of Health and Human Services, or the Secretary’s designee and Congress—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbc355-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/A"><num value="A">(A)</num><content> an initial evaluation of all federally funded efforts in Alzheimer’s research, clinical care, and institutional-, home-, and community-based programs and their outcomes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbc356-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/B"><num value="B">(B)</num><content> initial recommendations for priority actions to expand, eliminate, coordinate, or condense programs based on the program’s performance, mission, and purpose;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbc357-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/C"><num value="C">(C)</num><chapeau> initial recommendations to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacfbc358-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/C/i"><num value="i">(i)</num><chapeau> reduce the financial impact of Alzheimer’s on—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idacfbc359-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/C/i/I"><num value="I">(I)</num><content> Medicare and other federally funded programs; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idacfbc35a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/C/i/II"><num value="II">(II)</num><content> families living with Alzheimer’s disease; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbc35b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/C/ii"><num value="ii">(ii)</num><content> improve health outcomes; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbc35c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/5/D"><num value="D">(D)</num><content> annually thereafter, an evaluation of the implementation, including outcomes, of the recommendations, including priorities if necessary, through an updated national plan under subsection (d)(2).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacfbc35d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/e/6"><num value="6" class="bold">(6)</num><heading class="bold"> Termination</heading><content><p style="-uslm-lc:I12" class="indent1">The Advisory Council shall terminate on <date date="2025-12-31">December 31, 2025</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfbc35e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/f"><num value="f" class="bold">(f)</num><heading class="bold"> Data sharing</heading><content><p style="-uslm-lc:I11" class="indent0">Agencies both within the Department of Health and Human Services and outside of the Department that have data relating to Alzheimer’s shall share such data with the Secretary of Health and Human Services, or the Secretary’s designee, to enable the Secretary, or the Secretary’s designee, to complete the report described in subsection (g).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfbea6f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g"><num value="g" class="bold">(g)</num><heading class="bold"> Annual report</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Health and Human Services, or the Secretary’s designee, shall submit to Congress—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idacfbea70-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/1"><num value="1">(1)</num><content> an annual report that includes an evaluation of all federally funded efforts in Alzheimer’s research, clinical care, and institutional-, home-, and community-based programs and their outcomes;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfbea71-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/2"><num value="2">(2)</num><content> an evaluation of all federally funded programs based on program performance, mission, and purpose related to Alzheimer’s disease;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfbea72-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3"><num value="3">(3)</num><chapeau> recommendations for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbea73-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/A"><num value="A">(A)</num><chapeau> priority actions based on the evaluation conducted by the Secretary and the Advisory Council to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacfbea74-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/A/i"><num value="i">(i)</num><chapeau> reduce the financial impact of Alzheimer’s on—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idacfbea75-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/A/i/I"><num value="I">(I)</num><content> Medicare and other federally funded programs; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idacfbea76-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/A/i/II"><num value="II">(II)</num><content> families living with Alzheimer’s disease; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idacfbea77-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/A/ii"><num value="ii">(ii)</num><content> improve health outcomes;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbea78-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/B"><num value="B">(B)</num><content> implementation steps; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacfbea79-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/3/C"><num value="C">(C)</num><content> priority actions to improve the prevention, diagnosis, treatment, care, institutional-, home-, and community-based programs of Alzheimer’s disease for individuals with Alzheimer’s disease and their caregivers; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacfbea7a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/g/4"><num value="4">(4)</num><content> an annually updated national plan.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacfbea7b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s11225/h"><num value="h" class="bold">(h)</num><heading class="bold"> Sunset</heading><content><p style="-uslm-lc:I11" class="indent0">The Project shall expire on <date date="2025-12-31">December 31, 2025</date>.</p>
