<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8aebae8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432"><num value="11432">§ 11432.</num><heading> Grants for State and local activities for the education of homeless children and youths</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebae9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/a"><num value="a" class="bold">(a)</num><heading class="bold"> General authority</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary is authorized to make grants to States in accordance with the provisions of this section to enable such States to carry out the activities described in subsections (d) through (g).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebaea-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grants from allotments</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall make the grants to States from the allotments made under subsection (c)(1).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebaeb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c"><num value="c" class="bold">(c)</num><heading class="bold"> Allocation and reservations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebaec-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Allocation</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8aebaed-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1/A"><num value="A">(A)</num><chapeau> Subject to subparagraph (B), the Secretary is authorized to allot to each State an amount that bears the same ratio to the amount appropriated for such year under <ref href="/us/usc/t42/s11435">section 11435 of this title</ref> that remains after the Secretary reserves funds under paragraph (2) and uses funds to carry out section 11434(d) and (h) of this title, as the amount allocated under section 1122 of the Elementary and Secondary Education Act of 1965 [<ref href="/us/usc/t20/s6332">20 U.S.C. 6332</ref>] to the State for that year bears to the total amount allocated under section 1122 of such Act to all States for that year, except that no State shall receive less than the greater of—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idd8aebaee-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1/A/i"><num value="i">(i)</num><content> $150,000;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd8aebaef-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1/A/ii"><num value="ii">(ii)</num><content> one-fourth of 1 percent of the amount appropriated under <ref href="/us/usc/t42/s11435">section 11435 of this title</ref> for that year; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd8aebaf0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1/A/iii"><num value="iii">(iii)</num><content> the amount such State received under this section for fiscal year 2001.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8aebaf1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/1/B"><num value="B">(B)</num><content> If there are insufficient funds in a fiscal year to allot to each State the minimum amount under subparagraph (A), the Secretary shall ratably reduce the allotments to all States based on the proportionate share that each State received under this subsection for the preceding fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebaf2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reservations</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8aebaf3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/2/A"><num value="A">(A)</num><content> The Secretary is authorized to reserve 0.1 percent of the amount appropriated for each fiscal year under <ref href="/us/usc/t42/s11435">section 11435 of this title</ref> to be allocated by the Secretary among the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands, according to their respective need for assistance under this part, as determined by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8aebaf4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/2/B"><num value="B">(B)</num><clause style="-uslm-lc:I12" class="indent1" id="idd8aebaf5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/2/B/i"><num value="i">(i)</num><content> The Secretary shall transfer 1 percent of the amount appropriated for each fiscal year under <ref href="/us/usc/t42/s11435">section 11435 of this title</ref> to the Department of the Interior for programs for Indian students served by schools funded by the Secretary of the Interior, as determined under the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s450">25 U.S.C. 450</ref> et seq.),<ref class="footnoteRef" idref="fn003928">1</ref><note type="footnote" id="fn003928"><num>1</num> See References in Text note below.</note> that are consistent with the purposes of the programs described in this part.</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idd8aebaf6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/2/B/ii"><num value="ii">(ii)</num><content> The Secretary and the Secretary of the Interior shall enter into an agreement, consistent with the requirements of this part, for the distribution and use of the funds described in clause (i) under terms that the Secretary determines best meet the purposes of the programs described in this part. Such agreement shall set forth the plans of the Secretary of the Interior for the use of the amounts transferred, including appropriate goals, objectives, and milestones.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebaf7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> State defined</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of this subsection, the term “State” does not include the United States Virgin Islands, Guam, American Samoa, or the Commonwealth of the Northern Mariana Islands.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebaf8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d"><num value="d" class="bold">(d)</num><heading class="bold"> Activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Grants under this section shall be used for the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebaf9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/1"><num value="1">(1)</num><content> To carry out the policies set forth in <ref href="/us/usc/t42/s11431">section 11431 of this title</ref> in the State.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebafa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/2"><num value="2">(2)</num><content> To provide services and activities to improve the identification of homeless children and youths (including preschool-aged homeless children) and enable such children and youths to enroll in, attend, and succeed in school, including, if appropriate, in preschool programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebafb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/3"><num value="3">(3)</num><content> To establish or designate in the State educational agency an Office of the Coordinator for Education of Homeless Children and Youths that can sufficiently carry out the duties described for the Office in this part in accordance with subsection (f).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebafc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/4"><num value="4">(4)</num><content> To prepare and carry out the State plan described in subsection (g).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebafd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/5"><num value="5">(5)</num><chapeau> To develop and implement professional development programs for liaisons designated under subsection (g)(1)(J)(ii) and other local educational agency personnel—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebafe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/5/A"><num value="A">(A)</num><content> to improve their identification of homeless children and youths; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebaff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/d/5/B"><num value="B">(B)</num><content> to heighten the awareness of the liaisons and personnel of, and their capacity to respond to, specific needs in the education of homeless children and youths.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebb00-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e"><num value="e" class="bold">(e)</num><heading class="bold"> State and local subgrants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebb01-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Minimum disbursements by States</heading><content><p style="-uslm-lc:I12" class="indent1">From the sums made available each year to a State through grants under subsection (a) to carry out this part, the State educational agency shall distribute not less than 75 percent in subgrants to local educational agencies for the purposes of carrying out <ref href="/us/usc/t42/s11433">section 11433 of this title</ref>, except that States funded at the minimum level set forth in subsection (c)(1) shall distribute not less than 50 percent in subgrants to local educational agencies for the purposes of carrying out <ref href="/us/usc/t42/s11433">section 11433 of this title</ref>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebb02-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use by State educational agency</heading><content><p style="-uslm-lc:I12" class="indent1">A State educational agency may use the grant funds remaining after the State educational agency distributes subgrants under paragraph (1) to conduct activities under subsection (f) directly or through grants or contracts.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebb03-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Prohibition on segregating homeless students</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb04-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B) and <ref href="/us/usc/t42/s11433/a/2/B/ii">section 11433(a)(2)(B)(ii) of this title</ref>, in providing a free public education to a homeless child or youth, no State receiving funds under this part shall segregate such child or youth in a separate school, or in a separate program within a school, based on such child’s or youth’s status as homeless.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb05-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception</heading><chapeau style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), paragraphs (1)(J)(i) and (3) of subsection (g), <ref href="/us/usc/t42/s11433/a/2">section 11433(a)(2) of this title</ref>, and any other provision of this part relating to the placement of homeless children or youths in schools, a State that has a separate school for homeless children or youths that was operated in fiscal year 2000 in a covered county shall be eligible to receive funds under this part for programs carried out in such school if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8aebb06-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/B/i"><num value="i">(i)</num><content> the school meets the requirements of subparagraph (C);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb07-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/B/ii"><num value="ii">(ii)</num><content> any local educational agency serving a school that the homeless children and youths enrolled in the separate school are eligible to attend meets the requirements of subparagraph (E); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb08-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/B/iii"><num value="iii">(iii)</num><content> the State is otherwise eligible to receive funds under this part.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb09-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> School requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">For the State to be eligible under subparagraph (B) to receive funds under this part, the school described in such subparagraph shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8aebb0a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i"><num value="i">(i)</num><chapeau> provide written notice, at the time any child or youth seeks enrollment in such school, and at least twice annually while the child or youth is enrolled in such school, to the parent or guardian of the child or youth (or, in the case of an unaccompanied youth, the youth) that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb0b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/I"><num value="I">(I)</num><content> shall be signed by the parent or guardian (or, in the case of an unaccompanied youth, the youth);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb0c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/II"><num value="II">(II)</num><content> sets forth the general rights provided under this part;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb0d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/III"><num value="III">(III)</num><chapeau> specifically states—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="idd8aebb0e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/III/aa"><num value="aa">(aa)</num><content> the choice of schools homeless children and youths are eligible to attend, as provided in subsection (g)(3)(A);</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="idd8aebb0f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/III/bb"><num value="bb">(bb)</num><content> that no homeless child or youth is required to attend a separate school for homeless children or youths;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="idd8aebb10-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/III/cc"><num value="cc">(cc)</num><content> that homeless children and youths shall be provided comparable services described in subsection (g)(4), including transportation services, educational services, and meals through school meals programs; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="idd8aebb11-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/III/dd"><num value="dd">(dd)</num><content> that homeless children and youths should not be stigmatized by school personnel; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb12-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/i/IV"><num value="IV">(IV)</num><content> provides contact information for the local liaison for homeless children and youths and the State Coordinator for Education of Homeless Children and Youths;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb13-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/ii"><num value="ii">(ii)</num><subclause style="-uslm-lc:I14" class="indent3" id="idd8aebb14-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/ii/I"><num value="I">(I)</num><content> provide assistance to the parent or guardian of each homeless child or youth (or, in the case of an unaccompanied youth, the youth) to exercise the right to attend the parent’s or guardian’s (or youth’s) choice of schools, as provided in subsection (g)(3)(A); and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd8aebb15-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/ii/II"><num value="II">(II)</num><content> coordinate with the local educational agency with jurisdiction for the school selected by the parent or guardian (or youth), to provide transportation and other necessary services;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb16-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/iii"><num value="iii">(iii)</num><content> ensure that the parent or guardian (or, in the case of an unaccompanied youth, the youth) shall receive the information required by this subparagraph in a manner and form understandable to such parent or guardian (or youth), including, if necessary and to the extent feasible, in the native language of such parent or guardian (or youth); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb17-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/iv"><num value="iv">(iv)</num><chapeau> demonstrate in the school’s application for funds under this part that such school—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb18-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/iv/I"><num value="I">(I)</num><content> is complying with clauses (i) and (ii); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb19-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/C/iv/II"><num value="II">(II)</num><content> is meeting (as of the date of submission of the application) the same Federal and State standards, regulations, and mandates as other public schools in the State (such as complying with section 1111 of the Elementary and Secondary Education Act of 1965 [<ref href="/us/usc/t20/s6311">20 U.S.C. 6311</ref>] and providing a full range of education and related services, including services applicable to students with disabilities).</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb1a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> School ineligibility</heading><content><p style="-uslm-lc:I13" class="indent2">A separate school described in subparagraph (B) that fails to meet the standards, regulations, and mandates described in subparagraph (C)(iv)(II) shall not be eligible to receive funds under this part for programs carried out in such school after the first date of such failure.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb1b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Local educational agency requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">For the State to be eligible to receive the funds described in subparagraph (B), the local educational agency described in subparagraph (B)(ii) shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8aebb1c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/i"><num value="i">(i)</num><chapeau> implement a coordinated system for ensuring that homeless children and youths—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb1d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/i/I"><num value="I">(I)</num><content> are advised of the choice of schools provided in subsection (g)(3)(A);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb1e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/i/II"><num value="II">(II)</num><content> are immediately enrolled, in accordance with subsection (g)(3)(C), in the school selected under subsection (g)(3)(A); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb1f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/i/III"><num value="III">(III)</num><content> are promptly provided necessary services described in subsection (g)(4), including transportation, to allow homeless children and youths to exercise their choices of schools under subsection (g)(3)(A);</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb20-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/ii"><num value="ii">(ii)</num><chapeau> document that written notice has been provided—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb21-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/ii/I"><num value="I">(I)</num><content> in accordance with subparagraph (C)(i) for each child or youth enrolled in a separate school under subparagraph (B); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb22-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/ii/II"><num value="II">(II)</num><content> in accordance with subsection (g)(6)(A)(vi);</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb23-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/iii"><num value="iii">(iii)</num><content> prohibit schools within the agency’s jurisdiction from referring homeless children or youths to, or requiring homeless children and youths to enroll in or attend, a separate school described in subparagraph (B);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb24-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/iv"><num value="iv">(iv)</num><content> identify and remove any barriers that exist in schools within the agency’s jurisdiction that may have contributed to the creation or existence of separate schools described in subparagraph (B); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb25-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/v"><num value="v">(v)</num><chapeau> not use funds received under this part to establish—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb26-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/v/I"><num value="I">(I)</num><content> new or additional separate schools for homeless children or youths; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb27-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/E/v/II"><num value="II">(II)</num><content> new or additional sites for separate schools for homeless children or youths, other than the sites occupied by the schools described in subparagraph (B) in fiscal year 2000.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb28-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F"><num value="F" class="bold">(F)</num><heading class="bold"> Report</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8aebb29-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/i"><num value="i" class="bold">(i)</num><heading class="bold"> Preparation</heading><chapeau style="-uslm-lc:I14" class="indent3">The Secretary shall prepare a report on the separate schools and local educational agencies described in subparagraph (B) that receive funds under this part in accordance with this paragraph. The report shall contain, at a minimum, information on—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb2a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/i/I"><num value="I">(I)</num><content> compliance with all requirements of this paragraph;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb2b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/i/II"><num value="II">(II)</num><content> barriers to school access in the school districts served by the local educational agencies;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb2c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/i/III"><num value="III">(III)</num><content> the progress the separate schools are making in integrating homeless children and youths into the mainstream school environment, including the average length of student enrollment in such schools; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb2d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/i/IV"><num value="IV">(IV)</num><content> the progress the separate schools are making in helping all students meet the challenging State academic standards.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8aebb2e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Compliance with information requests</heading><content><p style="-uslm-lc:I14" class="indent3">For purposes of enabling the Secretary to prepare the report, the separate schools and local educational agencies shall cooperate with the Secretary and the State Coordinator for Education of Homeless Children and Youths established in the State under subsection (d)(3), and shall comply with any requests for information by the Secretary and State Coordinator for such State.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8aebb2f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Submission</heading><chapeau style="-uslm-lc:I14" class="indent3">The Secretary shall submit the report described in clause (i) to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb30-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/iii/I"><num value="I">(I)</num><content> the President;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb31-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/iii/II"><num value="II">(II)</num><content> the Committee on Education and the Workforce of the House of Representatives; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8aebb32-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/F/iii/III"><num value="III">(III)</num><content> the Committee on Health, Education, Labor, and Pensions of the Senate.</content>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8aebb33-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/G"><num value="G" class="bold">(G)</num><heading class="bold"> Definition</heading><chapeau style="-uslm-lc:I13" class="indent2">For purposes of this paragraph, the term “covered county” means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8aebb34-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/e/3/G/i"><num value="i">(i)</num><content> San Joaquin County, California;</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebb38-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f"><num value="f" class="bold">(f)</num><heading class="bold"> Functions of the Office of the Coordinator</heading><chapeau style="-uslm-lc:I11" class="indent0">The Coordinator for Education of Homeless Children and Youths established in each State shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb39-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1"><num value="1">(1)</num><chapeau> gather and make publicly available reliable, valid, and comprehensive information on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb3a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1/A"><num value="A">(A)</num><content> the number of homeless children and youths identified in the State, which shall be posted annually on the State educational agency’s website;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb3b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1/B"><num value="B">(B)</num><content> the nature and extent of the problems homeless children and youths have in gaining access to public preschool programs and to public elementary schools and secondary schools;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb3c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1/C"><num value="C">(C)</num><content> the difficulties in identifying the special needs and barriers to the participation and achievement of such children and youths;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb3d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1/D"><num value="D">(D)</num><content> any progress made by the State educational agency and local educational agencies in the State in addressing such problems and difficulties; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb3e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/1/E"><num value="E">(E)</num><content> the success of the programs under this part in identifying homeless children and youths and allowing such children and youths to enroll in, attend, and succeed in, school;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb3f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/2"><num value="2">(2)</num><content> develop and carry out the State plan described in subsection (g);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb40-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/3"><num value="3">(3)</num><content> collect data for and transmit to the Secretary, at such time and in such manner as the Secretary may reasonably require, a report containing information necessary to assess the educational needs of homeless children and youths within the State, including data necessary for the Secretary to fulfill the responsibilities under <ref href="/us/usc/t42/s11434/h">section 11434(h) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb41-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4"><num value="4">(4)</num><chapeau> in order to improve the provision of comprehensive education and related services to homeless children and youths and their families, coordinate activities and collaborate with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb42-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4/A"><num value="A">(A)</num><content> educators, including teachers, special education personnel, administrators, and child development and preschool program personnel;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb43-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4/B"><num value="B">(B)</num><content> providers of services to homeless children and youths and their families, including public and private child welfare and social services agencies, law enforcement agencies, juvenile and family courts, agencies providing mental health services, domestic violence agencies, child care providers, runaway and homeless youth centers, and providers of services and programs funded under the Runaway and Homeless Youth Act (<ref href="/us/usc/t42/s5701">42 U.S.C. 5701</ref> et seq.); <sup>1</sup></content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb44-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4/C"><num value="C">(C)</num><content> providers of emergency, transitional, and permanent housing to homeless children and youths, and their families, including public housing agencies, shelter operators, operators of transitional housing facilities, and providers of transitional living programs for homeless youths;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb45-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4/D"><num value="D">(D)</num><content> local educational agency liaisons designated under subsection (g)(1)(J)(ii) for homeless children and youths; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb46-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/4/E"><num value="E">(E)</num><content> community organizations and groups representing homeless children and youths and their families;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb47-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/5"><num value="5">(5)</num><content> provide technical assistance to and conduct monitoring of local educational agencies in coordination with local educational agency liaisons designated under subsection (g)(1)(J)(ii), to ensure that local educational agencies comply with the requirements of subsection (e)(3) and paragraphs (3) through (7) of subsection (g);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb48-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/6"><num value="6">(6)</num><content> provide professional development opportunities for local educational agency personnel and the local educational agency liaison designated under subsection (g)(1)(J)(ii) to assist such personnel and liaison in identifying and meeting the needs of homeless children and youths, and provide training on the definitions of terms related to homelessness specified in sections 11302, 11360, and 11434a of this title to the liaison; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8aebb49-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/f/7"><num value="7">(7)</num><content> respond to inquiries from parents and guardians of homeless children and youths, and (in the case of unaccompanied youths) such youths, to ensure that each child or youth who is the subject of such an inquiry receives the full protections and services provided by this part.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8aebb4a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g"><num value="g" class="bold">(g)</num><heading class="bold"> State plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8aebb4b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">For any State desiring to receive a grant under this part, the State educational agency shall submit to the Secretary a plan to provide for the education of homeless children and youths within the State. Such plan shall include the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb4c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/A"><num value="A">(A)</num><content> A description of how such children and youths are (or will be) given the opportunity to meet the same challenging State academic standards as all students are expected to meet.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb4d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/B"><num value="B">(B)</num><content> A description of the procedures the State educational agency will use to identify such children and youths in the State and to assess their needs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb4e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/C"><num value="C">(C)</num><content> A description of procedures for the prompt resolution of disputes regarding the educational placement of homeless children and youths.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb4f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/D"><num value="D">(D)</num><content> A description of programs for school personnel (including liaisons designated under subparagraph (J)(ii), principals and other school leaders, attendance officers, teachers, enrollment personnel, and specialized instructional support personnel) to heighten the awareness of such school personnel of the specific needs of homeless children and youths, including such children and youths who are runaway and homeless youths.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb50-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/E"><num value="E">(E)</num><content> A description of procedures that ensure that homeless children and youths who meet the relevant eligibility criteria are able to participate in Federal, State, or local nutrition programs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8aebb51-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/F"><num value="F">(F)</num><chapeau> A description of procedures that ensure that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8aebb52-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/F/i"><num value="i">(i)</num><content> homeless children have access to public preschool programs, administered by the State educational agency or local educational agency, as provided to other children in the State;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb53-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/F/ii"><num value="ii">(ii)</num><content> youths described in <ref href="/us/usc/t42/s11434a/2">section 11434a(2) of this title</ref> and youths separated from public schools are identified and accorded equal access to appropriate secondary education and support services, including by identifying and removing barriers that prevent youths described in this clause from receiving appropriate credit for full or partial coursework satisfactorily completed while attending a prior school, in accordance with State, local, and school policies; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8aebb54-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/F/iii"><num value="iii">(iii)</num><content> homeless children and youths who meet the relevant eligibility criteria do not face barriers to accessing academic and extracurricular activities, including magnet school, summer school, career and technical education, advanced placement, online learning, and charter school programs, if such programs are available at the State and local levels.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b10445-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/G"><num value="G">(G)</num><content> Strategies to address problems identified in the report provided to the Secretary under subsection (f)(3).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b10446-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H"><num value="H">(H)</num><chapeau> Strategies to address other problems with respect to the education of homeless children and youths, including problems resulting from enrollment delays that are caused by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b10447-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H/i"><num value="i">(i)</num><content> requirements of immunization and other required health records;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10448-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H/ii"><num value="ii">(ii)</num><content> residency requirements;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10449-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H/iii"><num value="iii">(iii)</num><content> lack of birth certificates, school records, or other documentation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1044a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H/iv"><num value="iv">(iv)</num><content> guardianship issues; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1044b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/H/v"><num value="v">(v)</num><content> uniform or dress code requirements.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b1044c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/I"><num value="I">(I)</num><content> A demonstration that the State educational agency and local educational agencies in the State have developed, and shall review and revise, policies to remove barriers to the identification of homeless children and youths, and the enrollment and retention of homeless children and youths in schools in the State, including barriers to enrollment and retention due to outstanding fees or fines, or absences.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b1044d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J"><num value="J">(J)</num><chapeau> Assurances that the following will be carried out:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1044e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/i"><num value="i">(i)</num><content> The State educational agency and local educational agencies in the State will adopt policies and practices to ensure that homeless children and youths are not stigmatized or segregated on the basis of their status as homeless.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1044f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/ii"><num value="ii">(ii)</num><content> The local educational agencies will designate an appropriate staff person, able to carry out the duties described in paragraph (6)(A), who may also be a coordinator for other Federal programs, as a local educational agency liaison for homeless children and youths.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10450-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/iii"><num value="iii">(iii)</num><chapeau> The State and the local educational agencies in the State will adopt policies and practices to ensure that transportation is provided, at the request of the parent or guardian (or in the case of an unaccompanied youth, the liaison), to and from the school of origin (as determined under paragraph (3)), in accordance with the following, as applicable:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8b10451-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/iii/I"><num value="I">(I)</num><content> If the child or youth continues to live in the area served by the local educational agency in which the school of origin is located, the child’s or youth’s transportation to and from the school of origin shall be provided or arranged by the local educational agency in which the school of origin is located.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b10452-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/iii/II"><num value="II">(II)</num><content> If the child’s or youth’s living arrangements in the area served by the local educational agency of origin terminate and the child or youth, though continuing the child’s or youth’s education in the school of origin, begins living in an area served by another local educational agency, the local educational agency of origin and the local educational agency in which the child or youth is living shall agree upon a method to apportion the responsibility and costs for providing the child or youth with transportation to and from the school of origin. If the local educational agencies are unable to agree upon such method, the responsibility and costs for transportation shall be shared equally.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10453-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/J/iv"><num value="iv">(iv)</num><content> The State and the local educational agencies in the State will adopt policies and practices to ensure participation by liaisons described in clause (ii) in professional development and other technical assistance activities provided pursuant to paragraphs (5) and (6) of subsection (f), as determined appropriate by the Office of the Coordinator.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b10454-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/1/K"><num value="K">(K)</num><content> A description of how youths described in <ref href="/us/usc/t42/s11434a/2">section 11434a(2) of this title</ref> will receive assistance from counselors to advise such youths, and prepare and improve the readiness of such youths for college.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b10455-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Compliance</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10456-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each plan adopted under this subsection shall also describe how the State will ensure that local educational agencies in the State will comply with the requirements of paragraphs (3) through (7).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10457-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Coordination</heading><content><p style="-uslm-lc:I13" class="indent2">Such plan shall indicate what technical assistance the State will furnish to local educational agencies and how compliance efforts will be coordinated with the local educational agency liaisons designated under paragraph (1)(J)(ii).</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b10458-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Local educational agency requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10459-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The local educational agency serving each child or youth to be assisted under this part shall, according to the child’s or youth’s best interest—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1045a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/A/i"><num value="i">(i)</num><chapeau> continue the child’s or youth’s education in the school of origin for the duration of homelessness—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8b1045b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/A/i/I"><num value="I">(I)</num><content> in any case in which a family becomes homeless between academic years or during an academic year; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b1045c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/A/i/II"><num value="II">(II)</num><content> for the remainder of the academic year, if the child or youth becomes permanently housed during an academic year; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1045d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/A/ii"><num value="ii">(ii)</num><content> enroll the child or youth in any public school that nonhomeless students who live in the attendance area in which the child or youth is actually living are eligible to attend.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1045e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> School stability</heading><chapeau style="-uslm-lc:I13" class="indent2">In determining the best interest of the child or youth under subparagraph (A), the local educational agency shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1045f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/B/i"><num value="i">(i)</num><content> presume that keeping the child or youth in the school of origin is in the child’s or youth’s best interest, except when doing so is contrary to the request of the child’s or youth’s parent or guardian, or (in the case of an unaccompanied youth) the youth;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10460-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/B/ii"><num value="ii">(ii)</num><content> consider student-centered factors related to the child’s or youth’s best interest, including factors related to the impact of mobility on achievement, education, health, and safety of homeless children and youth, giving priority to the request of the child’s or youth’s parent or guardian or (in the case of an unaccompanied youth) the youth;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10461-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/B/iii"><num value="iii">(iii)</num><content> if, after conducting the best interest determination based on consideration of the presumption in clause (i) and the student-centered factors in clause (ii), the local educational agency determines that it is not in the child’s or youth’s best interest to attend the school of origin or the school requested by the parent or guardian, or (in the case of an unaccompanied youth) the youth, provide the child’s or youth’s parent or guardian or the unaccompanied youth with a written explanation of the reasons for its determination, in a manner and form understandable to such parent, guardian, or unaccompanied youth, including information regarding the right to appeal under subparagraph (E); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10462-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/B/iv"><num value="iv">(iv)</num><content> in the case of an unaccompanied youth, ensure that the local educational agency liaison designated under paragraph (1)(J)(ii) assists in placement or enrollment decisions under this subparagraph, gives priority to the views of such unaccompanied youth, and provides notice to such youth of the right to appeal under subparagraph (E).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10463-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Immediate enrollment</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8b10464-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">The school selected in accordance with this paragraph shall immediately enroll the homeless child or youth, even if the child or youth—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8b10465-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C/i/I"><num value="I">(I)</num><content> is unable to produce records normally required for enrollment, such as previous academic records, records of immunization and other required health records, proof of residency, or other documentation; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b10466-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C/i/II"><num value="II">(II)</num><content> has missed application or enrollment deadlines during any period of homelessness.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8b10467-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Relevant academic records</heading><content><p style="-uslm-lc:I14" class="indent3">The enrolling school shall immediately contact the school last attended by the child or youth to obtain relevant academic and other records.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8b10468-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Relevant health records</heading><content><p style="-uslm-lc:I14" class="indent3">If the child or youth needs to obtain immunizations or other required health records, the enrolling school shall immediately refer the parent or guardian of the child or youth, or (in the case of an unaccompanied youth) the youth, to the local educational agency liaison designated under paragraph (1)(J)(ii), who shall assist in obtaining necessary immunizations or screenings, or immunization or other required health records, in accordance with subparagraph (D).</p>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10469-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Records</heading><chapeau style="-uslm-lc:I13" class="indent2">Any record ordinarily kept by the school, including immunization or other required health records, academic records, birth certificates, guardianship records, and evaluations for special services or programs, regarding each homeless child or youth shall be maintained—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1046a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/D/i"><num value="i">(i)</num><content> so that the records involved are available, in a timely fashion, when a child or youth enters a new school or school district; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1046b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/D/ii"><num value="ii">(ii)</num><content> in a manner consistent with <ref href="/us/usc/t20/s1232g">section 1232g of title 20</ref>.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1046c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Enrollment disputes</heading><chapeau style="-uslm-lc:I13" class="indent2">If a dispute arises over eligibility, or school selection or enrollment in a school—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1046d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/E/i"><num value="i">(i)</num><content> the child or youth shall be immediately enrolled in the school in which enrollment is sought, pending final resolution of the dispute, including all available appeals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1046e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/E/ii"><num value="ii">(ii)</num><content> the parent or guardian of the child or youth or (in the case of an unaccompanied youth) the youth shall be provided with a written explanation of any decisions related to school selection or enrollment made by the school, the local educational agency, or the State educational agency involved, including the rights of the parent, guardian, or unaccompanied youth to appeal such decisions;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1046f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/E/iii"><num value="iii">(iii)</num><content> the parent, guardian, or unaccompanied youth shall be referred to the local educational agency liaison designated under paragraph (1)(J)(ii), who shall carry out the dispute resolution process as described in paragraph (1)(C) as expeditiously as possible after receiving notice of the dispute; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10470-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/E/iv"><num value="iv">(iv)</num><content> in the case of an unaccompanied youth, the liaison shall ensure that the youth is immediately enrolled in the school in which the youth seeks enrollment pending resolution of such dispute.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10471-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/F"><num value="F" class="bold">(F)</num><heading class="bold"> Placement choice</heading><content><p style="-uslm-lc:I13" class="indent2">The choice regarding placement shall be made regardless of whether the child or youth lives with the homeless parents or has been temporarily placed elsewhere.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10472-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/G"><num value="G" class="bold">(G)</num><heading class="bold"> Privacy</heading><content><p style="-uslm-lc:I13" class="indent2">Information about a homeless child’s or youth’s living situation shall be treated as a student education record, and shall not be deemed to be directory information, under <ref href="/us/usc/t20/s1232g">section 1232g of title 20</ref>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10473-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/H"><num value="H" class="bold">(H)</num><heading class="bold"> Contact information</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this part shall prohibit a local educational agency from requiring a parent or guardian of a homeless child or youth to submit contact information.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10474-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/I"><num value="I" class="bold">(I)</num><heading class="bold"> School of origin defined</heading><chapeau style="-uslm-lc:I13" class="indent2">In this paragraph:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8b10475-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/I/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The term “school of origin” means the school that a child or youth attended when permanently housed or the school in which the child or youth was last enrolled, including a preschool.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd8b10476-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/3/I/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Receiving school</heading><content><p style="-uslm-lc:I14" class="indent3">When the child or youth completes the final grade level served by the school of origin, as described in clause (i), the term “school of origin” shall include the designated receiving school at the next grade level for all feeder schools.</p>

</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b10477-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Comparable services</heading><chapeau style="-uslm-lc:I12" class="indent1">Each homeless child or youth to be assisted under this part shall be provided services comparable to services offered to other students in the school selected under paragraph (3), including the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b10478-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4/A"><num value="A">(A)</num><content> Transportation services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b10479-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4/B"><num value="B">(B)</num><content> Educational services for which the child or youth meets the eligibility criteria, such as services provided under title I of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6301">20 U.S.C. 6301</ref> et seq.) or similar State or local programs, educational programs for children with disabilities, and educational programs for English learners.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b1047a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4/C"><num value="C">(C)</num><content> Programs in career and technical education.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b1047b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4/D"><num value="D">(D)</num><content> Programs for gifted and talented students.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b1047c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/4/E"><num value="E">(E)</num><content> School nutrition programs.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b1047d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5"><num value="5" class="bold">(5)</num><heading class="bold"> Coordination</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1047e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Each local educational agency serving homeless children and youths that receives assistance under this part shall coordinate—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b1047f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/A/i"><num value="i">(i)</num><content> the provision of services under this part with local social services agencies and other agencies or entities providing services to homeless children and youths and their families, including services and programs funded under the Runaway and Homeless Youth Act (<ref href="/us/usc/t42/s5701">42 U.S.C. 5701</ref> et seq.); <sup>1</sup> and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10480-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/A/ii"><num value="ii">(ii)</num><content> transportation, transfer of school records, and other interdistrict activities, with other local educational agencies.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10481-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Housing assistance</heading><content><p style="-uslm-lc:I13" class="indent2">If applicable, each State educational agency and local educational agency that receives assistance under this part shall coordinate with State and local housing agencies responsible for developing the comprehensive housing affordability strategy described in <ref href="/us/usc/t42/s12705">section 12705 of this title</ref> to minimize educational disruption for children and youths who become homeless.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10482-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Coordination purpose</heading><chapeau style="-uslm-lc:I13" class="indent2">The coordination required under subparagraphs (A) and (B) shall be designed to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b10483-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/C/i"><num value="i">(i)</num><content> ensure that all homeless children and youths are promptly identified;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10484-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/C/ii"><num value="ii">(ii)</num><content> ensure that all homeless children and youths have access to, and are in reasonable proximity to, available education and related support services; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10485-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/C/iii"><num value="iii">(iii)</num><content> raise the awareness of school personnel and service providers of the effects of short-term stays in a shelter and other challenges associated with homelessness.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10486-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/5/D"><num value="D" class="bold">(D)</num><heading class="bold"> Homeless children and youths with disabilities</heading><content><p style="-uslm-lc:I13" class="indent2">For children and youths who are to be assisted both under this part, and under the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.) or <ref href="/us/usc/t29/s794">section 794 of title 29</ref>, each local educational agency shall coordinate the provision of services under this part with the provision of programs for children with disabilities served by that local educational agency and other involved local educational agencies.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b10487-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6"><num value="6" class="bold">(6)</num><heading class="bold"> Local educational agency liaison</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10488-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I13" class="indent2">Each local educational agency liaison for homeless children and youths, designated under paragraph (1)(J)(ii), shall ensure that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b10489-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/i"><num value="i">(i)</num><content> homeless children and youths are identified by school personnel through outreach and coordination activities with other entities and agencies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/ii"><num value="ii">(ii)</num><content> homeless children and youths are enrolled in, and have a full and equal opportunity to succeed in, schools of that local educational agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/iii"><num value="iii">(iii)</num><content> homeless families and homeless children and youths have access to and receive educational services for which such families, children, and youths are eligible, including services through Head Start programs (including Early Head Start programs) under the Head Start Act (<ref href="/us/usc/t42/s9831">42 U.S.C. 9831</ref> et seq.), early intervention services under part C of the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1431">20 U.S.C. 1431</ref> et seq.), and other preschool programs administered by the local educational agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/iv"><num value="iv">(iv)</num><content> homeless families and homeless children and youths receive referrals to health care services, dental services, mental health and substance abuse services, housing services, and other appropriate services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/v"><num value="v">(v)</num><content> the parents or guardians of homeless children and youths are informed of the educational and related opportunities available to their children and are provided with meaningful opportunities to participate in the education of their children;</content>

<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/vi"><num value="vi">(vi)</num><content> public notice of the educational rights of homeless children and youths is disseminated in locations frequented by parents or guardians of such children and youths, and unaccompanied youths, including schools, shelters, public libraries, and soup kitchens, in a manner and form understandable to the parents and guardians of homeless children and youths, and unaccompanied youths;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b1048f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/vii"><num value="vii">(vii)</num><content> enrollment disputes are mediated in accordance with paragraph (3)(E);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10490-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/viii"><num value="viii">(viii)</num><content> the parent or guardian of a homeless child or youth, and any unaccompanied youth, is fully informed of all transportation services, including transportation to the school of origin, as described in paragraph (1)(J)(iii), and is assisted in accessing transportation to the school that is selected under paragraph (3)(A);</content>

<clause style="-uslm-lc:I14" class="indent3" id="idd8b10491-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/ix"><num value="ix">(ix)</num><content> school personnel providing services under this part receive professional development and other support; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b10492-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/x"><num value="x">(x)</num><chapeau> unaccompanied youths—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8b10493-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/x/I"><num value="I">(I)</num><content> are enrolled in school;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b10494-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/x/II"><num value="II">(II)</num><content> have opportunities to meet the same challenging State academic standards as the State establishes for other children and youth, including through implementation of the procedures under paragraph (1)(F)(ii); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b10495-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/A/x/III"><num value="III">(III)</num><content> are informed of their status as independent students under <ref href="/us/usc/t20/s1087vv">section 1087vv of title 20</ref> and that the youths may obtain assistance from the local educational agency liaison to receive verification of such status for purposes of the Free Application for Federal Student Aid described in <ref href="/us/usc/t20/s1090">section 1090 of title 20</ref>.</content>
</subclause>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10496-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Notice</heading><content><p style="-uslm-lc:I13" class="indent2">State Coordinators established under subsection (d)(3) and local educational agencies shall inform school personnel, service providers, advocates working with homeless families, parents and guardians of homeless children and youths, and homeless children and youths of the duties of the local educational agency liaisons, and publish an annually updated list of the liaisons on the State educational agency’s website.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10497-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> Local and State coordination</heading><content><p style="-uslm-lc:I13" class="indent2">Local educational agency liaisons for homeless children and youths shall, as a part of their duties, coordinate and collaborate with State Coordinators and community and school personnel responsible for the provision of education and related services to homeless children and youths. Such coordination shall include collecting and providing to the State Coordinator the reliable, valid, and comprehensive data needed to meet the requirements of paragraphs (1) and (3) of subsection (f).</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b10498-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/6/D"><num value="D" class="bold">(D)</num><heading class="bold"> Homeless status</heading><content><p style="-uslm-lc:I13" class="indent2">A local educational agency liaison designated under paragraph (1)(J)(ii) who receives training described in subsection (f)(6) may affirm, without further agency action by the Department of Housing and Urban Development, that a child or youth who is eligible for and participating in a program provided by the local educational agency, or the immediate family of such a child or youth, who meets the eligibility requirements of this chapter for a program or service authorized under subchapter IV, is eligible for such program or service.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b10499-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/7"><num value="7" class="bold">(7)</num><heading class="bold"> Review and revisions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1049a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each State educational agency and local educational agency that receives assistance under this part shall review and revise any policies that may act as barriers to the identification of homeless children and youths or the enrollment of homeless children and youths in schools that are selected under paragraph (3).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1049b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Consideration</heading><content><p style="-uslm-lc:I13" class="indent2">In reviewing and revising such policies, consideration shall be given to issues concerning transportation, immunization, residency, birth certificates, school records and other documentation, and guardianship.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b1049c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11432/g/7/C"><num value="C" class="bold">(C)</num><heading class="bold"> Special attention</heading><content><p style="-uslm-lc:I13" class="indent2">Special attention shall be given to ensuring the identification, enrollment, and attendance of homeless children and youths who are not currently attending school.</p>
