<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0b35bffe-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a"><num value="11434a">§ 11434a.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this part:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0b35bfff-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/1"><num value="1">(1)</num><content> The terms “enroll” and “enrollment” include attending classes and participating fully in school activities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b35c000-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2"><num value="2">(2)</num><chapeau> The term “homeless children and youths”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0b35c001-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/A"><num value="A">(A)</num><content> means individuals who lack a fixed, regular, and adequate nighttime residence (within the meaning of <ref href="/us/usc/t42/s11302/a/1">section 11302(a)(1) of this title</ref>); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b35c002-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/B"><num value="B">(B)</num><chapeau> includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0b35c003-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/B/i"><num value="i">(i)</num><content> children and youths who are sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason; are living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations; are living in emergency or transitional shelters; or are abandoned in hospitals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0b35c004-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/B/ii"><num value="ii">(ii)</num><content> children and youths who have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings (within the meaning of section 11302(a)(2)(C) <ref class="footnoteRef" idref="fn003929">1</ref><note type="footnote" id="fn003929"><num>1</num> See References in Text note below.</note> of this title);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0b35c005-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/B/iii"><num value="iii">(iii)</num><content> children and youths who are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0b35c006-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/2/B/iv"><num value="iv">(iv)</num><content> migratory children (as such term is defined in <ref href="/us/usc/t20/s6399">section 6399 of title 20</ref>) who qualify as homeless for the purposes of this part because the children are living in circumstances described in clauses (i) through (iii).</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0b35c007-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/3"><num value="3">(3)</num><content> The terms “local educational agency” and “State educational agency” have the meanings given such terms in <ref href="/us/usc/t20/s7801">section 7801 of title 20</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0b35c008-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/4"><num value="4">(4)</num><content> The term “Secretary” means the Secretary of Education.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0b35c009-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s11434a/5"><num value="5">(5)</num><content> The term “State” means each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico.</content>
