<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8b5e7a8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841"><num value="11841">§ 11841.</num><heading> Community youth activity program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7a9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/a"><num value="a" class="bold">(a)</num><heading class="bold"> Block grant program</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary of Health and Human Services shall make grants to eligible States to enable such States to carry out the activities described in subsection (e).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7aa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/b"><num value="b" class="bold">(b)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7ab-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible to receive a grant under this section, a State, acting on its own behalf or on behalf of a person, shall submit to the Secretary an application that contains such information and is in such form as may be required by the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7ac-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Demonstration of need</heading><content><p style="-uslm-lc:I12" class="indent1">In the application submitted under paragraph (1), the State shall demonstrate a need for the activities described in subsection (e) and provide a description of those activities and projects that will receive financial assistance from a grant made under this section to the State.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7ad-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c"><num value="c" class="bold">(c)</num><heading class="bold"> Amount of grant</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7ae-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Minimum amount</heading><content><p style="-uslm-lc:I12" class="indent1">Each State that submits for a fiscal year an application under subsection (b) that meets the requirements of the Secretary shall, subject to the availability of appropriations, receive a grant in an amount determined in accordance with paragraph (3).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7af-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Programs of national significance</heading><content><p style="-uslm-lc:I12" class="indent1">Of amounts appropriated or otherwise available to carry out this section for any fiscal year, the Secretary shall reserve 5 percent to be provided for activities and projects of national significance or projects expected to have a significant impact in preventing the abuse of drugs by youth.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7b0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Specified appropriations</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b5e7b1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Of the aggregate amount appropriated under subsection (g) for any fiscal year and after reserving the amount required by paragraph (2), the Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7b2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A/i"><num value="i">(i)</num><chapeau> allot—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8b5e7b3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A/i/I"><num value="I">(I)</num><content> 25 percent equally among the eligible States if such amount is less than $40,000,000; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd8b5e7b4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A/i/II"><num value="II">(II)</num><content> $250,000 to each eligible State if such amount equals or exceeds $40,000,000;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7b5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A/ii"><num value="ii">(ii)</num><content> allot one-half of 1 percent of such amount on the basis of need among Guam, American Samoa, the Virgin Islands of the United States, the Commonwealth of the Northern Mariana Islands, and the Trust Territory of the Pacific Islands; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7b6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/A/iii"><num value="iii">(iii)</num><content> set aside the remainder to be disbursed as described in subparagraph (B).</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">For purposes of this subparagraph, the term “State” does not include Guam, American Samoa, the Virgin Islands of the United States, the Commonwealth of the Northern Mariana Islands, and the Trust Territory of the Pacific Islands.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8b5e7b7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Remainder</heading><chapeau style="-uslm-lc:I13" class="indent2">Amounts referred to in subparagraph (A)(iii) shall be used by the Secretary to make grants, on a competitive basis and taking into consideration with respect to the States—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7b8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/B/i"><num value="i">(i)</num><content> the highest proportions of school-aged youth are <ref class="footnoteRef" idref="fn003936">1</ref><note type="footnote" id="fn003936"><num>1</num> So in original. Probably should be “who are”.</note> at risk of drug abuse;</content>

<clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7b9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/B/ii"><num value="ii">(ii)</num><content> if a tangible need has been identified by the State involved; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8b5e7ba-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/c/3/B/iii"><num value="iii">(iii)</num><content> if the State involved has proposed the funding of additional projects targeted at the areas of highest need;</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">to carry out the activities and projects that are consistent with the activities described in subsection (e)(1). The activities and projects for which such grants are made shall be selected by the Secretary from among proposed activities and projects submitted to the Secretary by the States. Such grants shall be made to the States for redistribution to the persons on whose behalf the State submitted an application under subsection (b).</continuation>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7bb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d"><num value="d" class="bold">(d)</num><heading class="bold"> Priority</heading><chapeau style="-uslm-lc:I11" class="indent0">In making grants under this section, the Secretary shall give priority to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7bc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/1"><num value="1">(1)</num><content> projects aimed at youth who are not in school or who are at risk of dropping out of school;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7bd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/2"><num value="2">(2)</num><content> projects that seek to reinvolve dropouts in educational programs, involve youth community-based activities, develop training or employment opportunities for dropouts, or provide youth with alternatives to drug abuse;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7be-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/3"><num value="3">(3)</num><content> projects to provide after-school, vacation, and weekend activities designed to give youth opportunities to actively participate in a variety of activities, including youth sports programs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7bf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/4"><num value="4">(4)</num><content> activities and projects that are consistent with activities and projects described in subsection (e)(1) and that include participation by the business community;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7c0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/5"><num value="5">(5)</num><content> projects that provide outreach to individuals of all ages who are at high risk of involvement with drug abuse;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7c1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/6"><num value="6">(6)</num><content> projects targeted to communities with the most serious drug abuse problems to enable such communities to develop programs that coordinate Federal, State, and local efforts to develop comprehensive, long-term, community-wide prevention and education strategies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7c2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/7"><num value="7">(7)</num><chapeau> projects that seek to involve youth who are members of gangs or who may join a gang, in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/7/A"><num value="A">(A)</num><content> educational programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/7/B"><num value="B">(B)</num><content> community-based activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/7/C"><num value="C">(C)</num><content> training or employment opportunities; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/7/D"><num value="D">(D)</num><content> other alternatives to gang involvement;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7c7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/8"><num value="8">(8)</num><chapeau> programs for unsupervised children before and after school, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/8/A"><num value="A">(A)</num><content> education and instruction consistent with part A of title IV of the Elementary and Secondary Education Act of 1965 [<ref href="/us/usc/t20/s7101">20 U.S.C. 7101</ref> et seq.];</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7c9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/8/B"><num value="B">(B)</num><content> athletic activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7ca-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/8/C"><num value="C">(C)</num><content> creative activities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7cb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/8/D"><num value="D">(D)</num><content> other programs designed to reduce the risk of drug abuse; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8b5e7cc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/d/9"><num value="9">(9)</num><content> projects that seek to inform youth regarding the existence and operation of the projects referred to in paragraph (7).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7cd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e"><num value="e" class="bold">(e)</num><heading class="bold"> Activities and projects</heading><chapeau style="-uslm-lc:I11" class="indent0">Financial assistance may be provided with a grant received under subsection (a) <ref class="footnoteRef" idref="fn003937">2</ref><note type="footnote" id="fn003937"><num>2</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7d1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e/1/C"><num value="C">(C)</num><content> community-based organizations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7d2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e/1/D"><num value="D">(D)</num><content> community action agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7d3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e/1/E"><num value="E">(E)</num><content> local or State recreational departments; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8b5e7d4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e/1/F"><num value="F">(F)</num><content> business organizations; and</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">in consultation with local and State health departments and with community health or mental health centers when appropriate. Such assistance may be provided to any entity described in subparagraphs (A) through (F), either individually or in partnerships. Applications for such assistance shall include a description of the method to be used to evaluate the impact the particular service or partnership is designed to have on the drug abuse problem within the community.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8b5e7d5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Other activities and projects</heading><content><p style="-uslm-lc:I12" class="indent1">Such assistance may be provided to carry out projects or activities that are consistent with the activities and projects described in paragraph (1).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7d6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/f"><num value="f" class="bold">(f)</num><heading class="bold"> Project evaluations</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall provide for the evaluation of activities and projects conducted with financial assistance received under this section. Applications for grants under this section shall include a description of the method to be used in evaluating the impact such activities and programs have on the drug abuse problem within the communities in which such activities and projects are carried out.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8b5e7d7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s11841/g"><num value="g" class="bold">(g)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">To carry out this section, there are authorized to be appropriated $40,000,000 for fiscal year 1989, $55,000,000 for fiscal year 1990, $60,000,000 for fiscal year 1991, $66,550,000 for fiscal year 1992, and $73,205,000 for fiscal year 1993.</p>
