L. 105–276, title V, § 586(g), Oct. 21, 1998, 112 Stat. 2649.)","seq_in_title":6400,"parent_identifier":"/us/usc/t42/ch124/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch124","level":"chapter","num":"CHAPTER 124—","heading":"PUBLIC HOUSING DRUG ELIMINATION","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch124/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"PUBLIC AND ASSISTED HOUSING DRUG ELIMINATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f589039-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907\"><num value=\"11907\">§ 11907.</num><heading> Monitoring</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f58903a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall audit and monitor the programs funded under this subchapter to ensure that assistance provided under this subchapter is administered in accordance with the provisions of this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f58903b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Prohibition of funding baseline services</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f58903c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Amounts provided under this subchapter may not be used to reimburse or support any local law enforcement agency or unit of general local government for the provision of services that are included in the baseline of services required to be provided by any such entity pursuant to a local cooperation agreement under <ref href=\"/us/usc/t42/s1437c/e/2\">section 1437c(e)(2) of this title</ref> or any provision of an annual contributions contract for payments in lieu of taxation pursuant to <ref href=\"/us/usc/t42/s1437d/d\">section 1437d(d) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f58903d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Description</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each public housing agency that receives grant amounts under this subchapter shall describe, in the report under <ref href=\"/us/usc/t42/s11906/a\">section 11906(a) of this title</ref>, such baseline of services for the unit of general local government in which the jurisdiction of the agency is located.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f58b74e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s11907/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Enforcement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide for the effective enforcement of this section, which may include the use of on-site monitoring, independent public audit requirements, certification by local law enforcement or local government officials regarding the performance of baseline services referred to in subsection (b), and entering into agreements with the Attorney General to achieve compliance, and verification of compliance, with the provisions of this subchapter.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8f58b74f-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/100/690/tV/s5128\">Pub. L. 105–276</ref>, set out as an Effective Date of 1998 Amendment note under <ref href=\"/us/usc/t42/s1437\">section 1437 of this title</ref>.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id8f58b753-86fb-11e9-b915-8b3e54686b9f\"><heading class=\"centered smallCaps\">Review of Drug Elimination Program Contracts</heading><p><ref href=\"/us/pl/105/276/tV/s587\">Pub. L. 105–276, title V, § 587</ref>, <date date=\"1998-10-21\">Oct. 21, 1998</date>, <ref href=\"/us/stat/112/2650\">112 Stat. 2650</ref>, provided that:<quotedContent origin=\"/us/pl/105/276/tV/s587\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Requirement</inline>.—</heading><chapeau>The Secretary of Housing and Urban Development shall investigate all security contracts awarded by grantees under the Public and Assisted Housing Drug Elimination Act of 1990 (<ref href=\"/us/usc/t42/s11901\">42 U.S.C. 11901</ref> et seq.) that are public housing agencies that own or operate more than 4,500 public housing dwelling units—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> to determine whether the contractors under such contracts have complied with all laws and regulations regarding prohibition of discrimination in hiring practices;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> to determine whether such contracts were awarded in accordance with the applicable laws and regulations regarding the award of such contracts;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> to determine how many such contracts were awarded under emergency contracting procedures; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> to evaluate the effectiveness of the contracts.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>], the Secretary shall complete the investigation required under subsection (a) and submit a report to the Congress regarding the findings under the investigation. With respect to each such contract, the report shall (1) state whether the contract was made and is operating, or was not made or is not operating, in full compliance with applicable laws and regulations, and (2) for each contract that the Secretary determines is in such compliance issue a certification of such compliance by the Secretary of Housing and Urban Development.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Actions</inline>.—</heading><chapeau>For each contract that is described in the report under subsection (b) as not made or not operating in full compliance with applicable laws and regulations, the Secretary of Housing and Urban Development shall promptly take any actions available under law or regulation that are necessary—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> to bring such contract into compliance; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> to terminate the contract.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Effective Date</inline>.—</heading><content>This section shall take effect on the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"served_from":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"content_first_seen":{"label":"116-19","currency_date":"2019-05-31","congress":116,"law_num":19,"excluded_laws":[],"update_num":null,"seq":174,"is_partial":false,"caveat":null,"titles_affected":["25","42"],"ingested_titles":[]},"is_exact":true,"note":null}
