<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0b41a67f-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002"><num value="12002">§ 12002.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a680-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/1"><num value="1">(1)</num><content> the term “invention” means an invention or discovery that is patented or for which a patent may be obtained under title 35, or any novel variety of plant that is protected or for which plant variety protection may be obtained under the Plant Variety Protection Act (<ref href="/us/usc/t7/s2321">7 U.S.C. 2321</ref> et seq.) and that is conceived or reduced to practice as a result of work under an agreement entered into under this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a681-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2"><num value="2">(2)</num><chapeau> the term “non-Federal person” means an entity located in the United States, the controlling interest (as defined by the Secretary) of which is held by persons of the United States, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a682-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2/A"><num value="A">(A)</num><content> a for-profit business;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a683-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2/B"><num value="B">(B)</num><content> a private foundation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a684-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2/C"><num value="C">(C)</num><content> a nonprofit organization such as a university;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a685-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2/D"><num value="D">(D)</num><content> a trade or professional society; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a686-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/2/E"><num value="E">(E)</num><content> a unit of State or local government;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a687-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/3"><num value="3">(3)</num><content> the term “Secretary” means the Secretary of Energy;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a688-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/4"><num value="4">(4)</num><content> the term “small business”, with respect to a participant in any demonstration and commercial application project under this chapter, means a private firm that does not exceed the numerical size standard promulgated by the Small Business Administration under <ref href="/us/usc/t15/s632/a">section 632(a) of title 15</ref> for the Standard Industrial Classification (SIC) code designated by the Secretary of Energy as the primary business activity to be undertaken in the demonstration and commercial application project;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a689-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/5"><num value="5">(5)</num><chapeau> the term “source reduction” means any practice which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a68a-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/5/A"><num value="A">(A)</num><content> reduces the amount of any hazardous substance, pollutant, or contaminant entering any waste stream or otherwise released into the environment, including fugitive emissions, prior to recycling, treatment, or disposal; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0b41a68b-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/5/B"><num value="B">(B)</num><content> reduces the hazards to the public health and the environment associated with the release of such substances, pollutants, or contaminants,</content>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">including equipment or technology modifications, process or procedure modifications, reformulation or redesign of products, substitution of raw materials, and improvements in housekeeping, maintenance, training, and inventory control, but not including any practice which alters the physical, chemical, or biological characteristics or the volume of a hazardous substance, pollutant, or contaminant through a process or activity which itself is not integral to and necessary for the production of a product or the providing of a service; <ref class="footnoteRef" idref="fn003945">1</ref><note type="footnote" id="fn003945"><num>1</num> So in original. </paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0b41a68c-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s12002/6"><num value="6">(6)</num><content> the term “United States” means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other Commonwealth, territory, or possession of the United States.</content>
