<chapeau style="-uslm-lc:I11" class="indent0">As used in this subchapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad14547e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/1"><num value="1" class="bold">(1)</num><heading class="bold"> Commission</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Commission” means the Equal Employment Opportunity Commission established by <ref href="/us/usc/t42/s2000e–4">section 2000e–4 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad14547f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/2"><num value="2" class="bold">(2)</num><heading class="bold"> Covered entity</heading><content><p style="-uslm-lc:I12" class="indent1">The term “covered entity” means an employer, employment agency, labor organization, or joint labor-management committee.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad145480-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/3"><num value="3" class="bold">(3)</num><heading class="bold"> Direct threat</heading><content><p style="-uslm-lc:I12" class="indent1">The term “direct threat” means a significant risk to the health or safety of others that cannot be eliminated by reasonable accommodation.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad145481-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/4"><num value="4" class="bold">(4)</num><heading class="bold"> Employee</heading><content><p style="-uslm-lc:I12" class="indent1">The term “employee” means an individual employed by an employer. With respect to employment in a foreign country, such term includes an individual who is a citizen of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad145482-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/5"><num value="5" class="bold">(5)</num><heading class="bold"> Employer</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad145483-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “employer” means a person engaged in an industry affecting commerce who has 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year, and any agent of such person, except that, for two years following the effective date of this subchapter, an employer means a person engaged in an industry affecting commerce who has 25 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding year, and any agent of such person.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad145484-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exceptions</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “employer” does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad145485-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/5/B/i"><num value="i">(i)</num><content> the United States, a corporation wholly owned by the government of the United States, or an Indian tribe; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad145486-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/5/B/ii"><num value="ii">(ii)</num><content> a bona fide private membership club (other than a labor organization) that is exempt from taxation under <ref href="/us/usc/t26/s501/c">section 501(c) of title 26</ref>.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad145487-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/6"><num value="6" class="bold">(6)</num><heading class="bold"> Illegal use of drugs</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad145488-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “illegal use of drugs” means the use of drugs, the possession or distribution of which is unlawful under the Controlled Substances Act [<ref href="/us/usc/t21/s801">21 U.S.C. 801</ref> et seq.]. Such term does not include the use of a drug taken under supervision by a licensed health care professional, or other uses authorized by the Controlled Substances Act or other provisions of Federal law.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad145489-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Drugs</heading><content><p style="-uslm-lc:I13" class="indent2">The term “drug” means a controlled substance, as defined in schedules I through V of section 202 of the Controlled Substances Act [<ref href="/us/usc/t21/s812">21 U.S.C. 812</ref>].</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad14548a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/7"><num value="7" class="bold">(7)</num><heading class="bold"> Person, etc.</heading><content><p style="-uslm-lc:I12" class="indent1">The terms “person”, “labor organization”, “employment agency”, “commerce”, and “industry affecting commerce”, shall have the same meaning given such terms in <ref href="/us/usc/t42/s2000e">section 2000e of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad14548b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/8"><num value="8" class="bold">(8)</num><heading class="bold"> Qualified individual</heading><content><p style="-uslm-lc:I12" class="indent1">The term “qualified individual” means an individual who, with or without reasonable accommodation, can perform the essential functions of the employment position that such individual holds or desires. For the purposes of this subchapter, consideration shall be given to the employer’s judgment as to what functions of a job are essential, and if an employer has prepared a written description before advertising or interviewing applicants for the job, this description shall be considered evidence of the essential functions of the job.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad14548c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/9"><num value="9" class="bold">(9)</num><heading class="bold"> Reasonable accommodation</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “reasonable accommodation” may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad14548d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/9/A"><num value="A">(A)</num><content> making existing facilities used by employees readily accessible to and usable by individuals with disabilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad14548e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/9/B"><num value="B">(B)</num><content> job restructuring, part-time or modified work schedules, reassignment to a vacant position, acquisition or modification of equipment or devices, appropriate adjustment or modifications of examinations, training materials or policies, the provision of qualified readers or interpreters, and other similar accommodations for individuals with disabilities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad147b9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10"><num value="10" class="bold">(10)</num><heading class="bold"> Undue hardship</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad147ba0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “undue hardship” means an action requiring significant difficulty or expense, when considered in light of the factors set forth in subparagraph (B).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad147ba1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/B"><num value="B" class="bold">(B)</num><heading class="bold"> Factors to be considered</heading><chapeau style="-uslm-lc:I13" class="indent2">In determining whether an accommodation would impose an undue hardship on a covered entity, factors to be considered include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad147ba2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/B/i"><num value="i">(i)</num><content> the nature and cost of the accommodation needed under this chapter;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad147ba3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/B/ii"><num value="ii">(ii)</num><content> the overall financial resources of the facility or facilities involved in the provision of the reasonable accommodation; the number of persons employed at such facility; the effect on expenses and resources, or the impact otherwise of such accommodation upon the operation of the facility;</content>

<clause style="-uslm-lc:I14" class="indent3" id="idad147ba4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/B/iii"><num value="iii">(iii)</num><content> the overall financial resources of the covered entity; the overall size of the business of a covered entity with respect to the number of its employees; the number, type, and location of its facilities; and</content>

<clause style="-uslm-lc:I14" class="indent3" id="idad147ba5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12111/10/B/iv"><num value="iv">(iv)</num><content> the type of operation or operations of the covered entity, including the composition, structure, and functions of the workforce of such entity; the geographic separateness, administrative, or fiscal relationship of the facility or facilities in question to the covered entity.</content>
