L. 101–336, title II, § 221, July 26, 1990, 104 Stat. 338.)","seq_in_title":6429,"parent_identifier":"/us/usc/t42/ch126/schII/ptB/spti","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126","level":"chapter","num":"CHAPTER 126—","heading":"EQUAL OPPORTUNITY FOR INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"PUBLIC SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126/schII/ptB","level":"part","num":"Part B—","heading":"Actions Applicable to Public Transportation Provided by Public Entities Considered Discriminatory","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126/schII/ptB/spti","level":"subpart","num":"subpart i—","heading":"public transportation other than by aircraft or certain rail operations","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8f5c88b2-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141\"><num value=\"12141\">§ 12141.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this subpart:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5c88b3-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Demand responsive system</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “demand responsive system” means any system of providing designated public transportation which is not a fixed route system.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5c88b4-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Designated public transportation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “designated public transportation” means transportation (other than public school transportation) by bus, rail, or any other conveyance (other than transportation by aircraft or intercity or commuter rail transportation (as defined in <ref href=\"/us/usc/t42/s12161\">section 12161 of this title</ref>)) that provides the general public with general or special service (including charter service) on a regular and continuing basis.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5c88b5-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Fixed route system</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “fixed route system” means a system of providing designated public transportation on which a vehicle is operated along a prescribed route according to a fixed schedule.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5caec6-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Operates</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “operates”, as used with respect to a fixed route system or demand responsive system, includes operation of such system by a person under a contractual or other arrangement or relationship with a public entity.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5caec7-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Public school transportation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “public school transportation” means transportation by schoolbus vehicles of schoolchildren, personnel, and equipment to and from a public elementary or secondary school and school-related activities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8f5caec8-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12141/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Secretary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Secretary” means the Secretary of Transportation.</p>\n</content>\n</paragraph>\n<sourceCredit id=\"id8f5caec9-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/101/336/tII/s221\">Pub. L. 101–336, title II, § 231</ref>, <date date=\"1990-07-26\">July 26, 1990</date>, <ref href=\"/us/stat/104/346\">104 Stat. 346</ref>, provided that:<quotedContent origin=\"/us/pl/101/336/tII/s231\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">General Rule</inline>.—</heading><content>Except as provided in subsection (b), this part [part I (§§ 221–231) of subtitle B of title II of <ref href=\"/us/pl/101/336\">Pub.
