<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8bceb9c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/3"><num value="3" class="bold">(3)</num><heading class="bold"> Intercity rail transportation</heading><content><p style="-uslm-lc:I12" class="indent1">The term “intercity rail transportation” means transportation provided by the National Railroad Passenger Corporation.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8bceb9d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/4"><num value="4" class="bold">(4)</num><heading class="bold"> Rail passenger car</heading><content><p style="-uslm-lc:I12" class="indent1">The term “rail passenger car” means, with respect to intercity rail transportation, single-level and bi-level coach cars, single-level and bi-level dining cars, single-level and bi-level sleeping cars, single-level and bi-level lounge cars, and food service cars.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8bceb9e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/5"><num value="5" class="bold">(5)</num><heading class="bold"> Responsible person</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “responsible person” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8bceb9f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/5/A"><num value="A">(A)</num><content> in the case of a station more than 50 percent of which is owned by a public entity, such public entity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8bceba0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/5/B"><num value="B">(B)</num><content> in the case of a station more than 50 percent of which is owned by a private party, the persons providing intercity or commuter rail transportation to such station, as allocated on an equitable basis by regulation by the Secretary of Transportation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8bceba1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/5/C"><num value="C">(C)</num><content> in a case where no party owns more than 50 percent of a station, the persons providing intercity or commuter rail transportation to such station and the owners of the station, other than private party owners, as allocated on an equitable basis by regulation by the Secretary of Transportation.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8bceba2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12161/6"><num value="6" class="bold">(6)</num><heading class="bold"> Station</heading><content><p style="-uslm-lc:I12" class="indent1">The term “station” means the portion of a property located appurtenant to a right-of-way on which intercity or commuter rail transportation is operated, where such portion is used by the general public and is related to the provision of such transportation, including passenger platforms, designated waiting areas, ticketing areas, restrooms, and, where a public entity providing rail transportation owns the property, concession areas, to the extent that such public entity exercises control over the selection, design, construction, or alteration of the property, but such term does not include flag stops.</p>
