Probably should be “an”.</note> entity described in subsection (a) of eligibility criteria that screen out or tend to screen out an individual with a disability or any class of individuals with disabilities from fully enjoying the specified public transportation services provided by the entity, unless such criteria can be shown to be necessary for the provision of the services being offered;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c53-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/2\"><num value=\"2\">(2)</num><chapeau> the failure of such entity to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c54-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/2/A\"><num value=\"A\">(A)</num><content> make reasonable modifications consistent with those required under <ref href=\"/us/usc/t42/s12182/b/2/A/ii\">section 12182(b)(2)(A)(ii) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c55-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/2/B\"><num value=\"B\">(B)</num><content> provide auxiliary aids and services consistent with the requirements of <ref href=\"/us/usc/t42/s12182/b/2/A/iii\">section 12182(b)(2)(A)(iii) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c56-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/2/C\"><num value=\"C\">(C)</num><content> remove barriers consistent with the requirements of <ref href=\"/us/usc/t42/s12182/b/2/A\">section 12182(b)(2)(A) of this title</ref> and with the requirements of <ref href=\"/us/usc/t42/s12183/a/2\">section 12183(a)(2) of this title</ref>;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c57-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/3\"><num value=\"3\">(3)</num><content> the purchase or lease by such entity of a new vehicle (other than an automobile, a van with a seating capacity of less than 8 passengers, including the driver, or an over-the-road bus) which is to be used to provide specified public transportation and for which a solicitation is made after the 30th day following the effective date of this section, that is not readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs; except that the new vehicle need not be readily accessible to and usable by such individuals if the new vehicle is to be used solely in a demand responsive system and if the entity can demonstrate that such system, when viewed in its entirety, provides a level of service to such individuals equivalent to the level of service provided to the general public;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c58-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/4\"><num value=\"4\">(4)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c59-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/4/A\"><num value=\"A\">(A)</num><content> the purchase or lease by such entity of an over-the-road bus which does not comply with the regulations issued under <ref href=\"/us/usc/t42/s12186/a/2\">section 12186(a)(2) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c5a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/4/B\"><num value=\"B\">(B)</num><content> any other failure of such entity to comply with such regulations; and <ref class=\"footnoteRef\" idref=\"fn003952\">2</ref><note type=\"footnote\" id=\"fn003952\"><num>2</num> So in original. The word “and” probably should not appear.</note></content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c5b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/5\"><num value=\"5\">(5)</num><content> the purchase or lease by such entity of a new van with a seating capacity of less than 8 passengers, including the driver, which is to be used to provide specified public transportation and for which a solicitation is made after the 30th day following the effective date of this section that is not readily accessible to or usable by individuals with disabilities, including individuals who use wheelchairs; except that the new van need not be readily accessible to and usable by such individuals if the entity can demonstrate that the system for which the van is being purchased or leased, when viewed in its entirety, provides a level of service to such individuals equivalent to the level of service provided to the general public;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c5c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/6\"><num value=\"6\">(6)</num><content> the purchase or lease by such entity of a new rail passenger car that is to be used to provide specified public transportation, and for which a solicitation is made later than 30 days after the effective date of this paragraph, that is not readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd8bf5c5d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/b/7\"><num value=\"7\">(7)</num><content> the remanufacture by such entity of a rail passenger car that is to be used to provide specified public transportation so as to extend its usable life for 10 years or more, or the purchase or lease by such entity of such a rail car, unless the rail car, to the maximum extent feasible, is made readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd8bf5c5e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Historical or antiquated cars</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8bf5c5f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To the extent that compliance with subsection (b)(2)(C) or (b)(7) would significantly alter the historic or antiquated character of a historical or antiquated rail passenger car, or a rail station served exclusively by such cars, or would result in violation of any rule, regulation, standard, or order issued by the Secretary of Transportation under the Federal Railroad Safety Act of 1970, such compliance shall not be required.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8bf5c60-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Definition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">As used in this subsection, the term “historical or antiquated rail passenger car” means a rail passenger car—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c61-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2/A\"><num value=\"A\">(A)</num><content> which is not less than 30 years old at the time of its use for transporting individuals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c62-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2/B\"><num value=\"B\">(B)</num><content> the manufacturer of which is no longer in the business of manufacturing rail passenger cars; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd8bf5c63-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2/C\"><num value=\"C\">(C)</num><chapeau> which—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8bf5c64-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2/C/i\"><num value=\"i\">(i)</num><content> has a consequential association with events or persons significant to the past; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8bf5c65-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s12184/c/2/C/ii\"><num value=\"ii\">(ii)</num><content> embodies, or is being restored to embody, the distinctive characteristics of a type of rail passenger car used in the past, or to represent a time period which has passed.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idd8bf5c66-406b-11eb-bd25-fd7436c081d8\">(<ref href=\"/us/pl/101/336/tIII/s304\">Pub.
