L. 110–325, § 6(a)(2), (3), Sept. 25, 2008, 122 Stat. 3558.)","seq_in_title":6463,"parent_identifier":"/us/usc/t42/ch126/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126","level":"chapter","num":"CHAPTER 126—","heading":"EQUAL OPPORTUNITY FOR INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch126/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"MISCELLANEOUS PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad1a47a3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210\"><num value=\"12210\">§ 12210.</num><heading> Illegal use of drugs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1a47a4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter, the term “individual with a disability” does not include an individual who is currently engaging in the illegal use of drugs, when the covered entity acts on the basis of such use.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1a47a5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Rules of construction</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in subsection (a) shall be construed to exclude as an individual with a disability an individual who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a47a6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/b/1\"><num value=\"1\">(1)</num><content> has successfully completed a supervised drug rehabilitation program and is no longer engaging in the illegal use of drugs, or has otherwise been rehabilitated successfully and is no longer engaging in such use;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a47a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/b/2\"><num value=\"2\">(2)</num><content> is participating in a supervised rehabilitation program and is no longer engaging in such use; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a6eb8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/b/3\"><num value=\"3\">(3)</num><content> is erroneously regarded as engaging in such use, but is not engaging in such use;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">except that it shall not be a violation of this chapter for a covered entity to adopt or administer reasonable policies or procedures, including but not limited to drug testing, designed to ensure that an individual described in paragraph (1) or (2) is no longer engaging in the illegal use of drugs; however, nothing in this section shall be construed to encourage, prohibit, restrict, or authorize the conducting of testing for the illegal use of drugs.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1a6eb9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Health and other services</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding subsection (a) and <ref href=\"/us/usc/t42/s12211/b/3\">section 12211(b)(3) of this title</ref>, an individual shall not be denied health services, or services provided in connection with drug rehabilitation, on the basis of the current illegal use of drugs if the individual is otherwise entitled to such services.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1a6eba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> “Illegal use of drugs” defined</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad1a6ebb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “illegal use of drugs” means the use of drugs, the possession or distribution of which is unlawful under the Controlled Substances Act [<ref href=\"/us/usc/t21/s801\">21 U.S.C. 801</ref> et seq.]. Such term does not include the use of a drug taken under supervision by a licensed health care professional, or other uses authorized by the Controlled Substances Act or other provisions of Federal law.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad1a6ebc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12210/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Drugs</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “drug” means a controlled substance, as defined in schedules I through V of section 202 of the Controlled Substances Act [<ref href=\"/us/usc/t21/s812\">21 U.S.C. 812</ref>].</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad1a6ebd-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/101/336/tV/s511\">Pub.
