L. 104–271, title I, § 103(a), Oct. 9, 1996, 110 Stat. 3305.)","seq_in_title":6498,"parent_identifier":"/us/usc/t42/ch128","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch128","level":"chapter","num":"CHAPTER 128—","heading":"HYDROGEN RESEARCH, DEVELOPMENT, AND DEMONSTRATION PROGRAM","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad1dc9fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403\"><num value=\"12403\">§ 12403.</num><heading> Hydrogen research and development</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dc9fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Program</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall conduct a hydrogen research and development program relating to production, storage, transportation, and use of hydrogen, with the goal of enabling the private sector to demonstrate the technical feasibility of using hydrogen for industrial, residential, transportation, and utility applications.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dc9ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Research</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In conducting the program authorized by this section, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1dca00-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/b/1\"><num value=\"1\">(1)</num><content> give particular attention to developing an understanding and resolution of critical technical issues preventing the introduction of hydrogen into the marketplace;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1dca01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/b/2\"><num value=\"2\">(2)</num><content> initiate or accelerate existing research in critical technical issues that will contribute to the development of more economic hydrogen production and use, including, but not limited to, critical technical issues with respect to production (giving priority to those production techniques that use renewable energy resources as their primary source of energy for hydrogen production), liquefaction, transmission, distribution, storage, and use (including use of hydrogen in surface transportation); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1dca02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/b/3\"><num value=\"3\">(3)</num><content> survey private sector hydrogen activities and take steps to ensure that research and development activities under this section do not displace or compete with the privately funded hydrogen research and development activities of United States industry.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Innovative energy technologies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to evaluate any reasonable new or improved technology, including basic research on highly innovative energy technologies, that could lead or contribute to the development of economic hydrogen production, storage, and utilization.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Renewable energy systems; hybrid systems</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to evaluate any reasonable new or improved technology that could lead or contribute to, or demonstrate the use of, advanced renewable energy systems or hybrid systems for use in isolated communities that currently import diesel fuel as the primary fuel for electric power production.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Information</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to arrange for tests and demonstrations and to disseminate to researchers and developers information, data, and other materials necessary to support the research and development activities authorized under this section and other efforts authorized under this chapter, consistent with <ref href=\"/us/usc/t42/s12405\">section 12405 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Federal funding</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall carry out the research and development activities authorized under this section only through the funding of research and development proposals submitted by interested persons according to such procedures as the Secretary may require and evaluate on a competitive basis using peer review. Such funding shall be in the form of a grant agreement, procurement contract, or cooperative agreement (as those terms are used in chapter 63 of title 31).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Non-Federal funding</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall not consider a proposal submitted by a person from industry unless the proposal contains a certification that reasonable efforts to obtain non-Federal funding for the entire cost of the project have been made, and that such non-Federal funding could not be reasonably obtained. As appropriate, the Secretary shall require a commitment from non-Federal sources of at least 50 percent of the cost of the development portion of such a proposal.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1dca08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Prohibition on duplicative efforts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall not carry out any activities under this section that unnecessarily duplicate activities carried out elsewhere by the Federal Government or industry.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad1df119-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12403/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Federal funding consistent with the Agreement on Subsidies and Countervailing Measures</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall establish, after consultation with other Federal agencies, terms and conditions under which Federal funding will be provided under this chapter that are consistent with the Agreement on Subsidies and Countervailing Measures referred to in <ref href=\"/us/usc/t19/s3511/d/12\">section 3511(d)(12) of title 19</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad1df11a-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/101/566/s104\">Pub. L. 104–271</ref> amended section generally, substituting present provisions for provisions which stated in subsec. (a) the Secretary was to conduct a research and development program for development of a domestic hydrogen fuel production capability; subsec. (b) attention was to be given to research of critical technical issues; subsec. (c) renewable energy priority; subsec. (d) new technologies; and subsec. (e) gathering and dissemination of information to support research and development efforts.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idad1df11d-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Fuel Cells</heading><p><ref href=\"/us/pl/104/271/tII\">Pub. L. 104–271, title II</ref>, <date date=\"1996-10-09\">Oct. 9, 1996</date>, <ref href=\"/us/stat/110/3307\">110 Stat. 3307</ref>, provided that:<quotedContent origin=\"/us/pl/104/271/tII\">\n<section style=\"-uslm-lc:I580467\"><num value=\"201\">“SEC. 201.</num><heading> INTEGRATION OF FUEL CELLS WITH HYDROGEN PRODUCTION SYSTEMS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><chapeau> Not later than 180 days after the date of enactment of this section [<date date=\"1996-10-09\">Oct. 9, 1996</date>], and subject to the availability of appropriations made specifically for this section, the Secretary of Energy shall solicit proposals for projects to prove the feasibility of integrating fuel cells with—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> photovoltaic systems for hydrogen production; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> systems for hydrogen production from solid waste via gasification or steam reforming.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><content> Each proposal submitted in response to the solicitation under this section shall be evaluated on a competitive gas is [basis] using peer review. The Secretary is not required to make an award under this section in the absence of a meritorious proposals. [sic]</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><chapeau> The Secretary shall give preference, in making an award under this section, to proposals that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> are submitted jointly from consortia including academic institutions, industry, State or local governments, and Federal laboratories; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> reflect proven experience and capability with technologies relevant to the systems described in subsections (a)(1) and (a)(2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><content> In the case of a proposal involving development or demonstration, the Secretary shall require a commitment from non-Federal sources of at least 50 percent of the cost of the development or demonstration portion of the proposal.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><content> The Secretary shall establish, after consultation with other Federal agencies, terms and conditions under which Federal funding will be provided under this title that are consistent with the Agreement on Subsidies and Countervailing Measures referred to in section 101(d)(12) of the Uruguay Round Agreement Act (<ref href=\"/us/usc/t19/s3511/d/12\">19 U.S.C. 3511(d)(12)</ref>).</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"202\">“SEC. 202.</num><heading> AUTHORIZATION OF APPROPRIATIONS.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“There are authorized to be appropriated, for activities under this section [title], a total of $50,000,000 for fiscal years 1997 and 1998, to remain available until <date date=\"1999-09-30\">September 30, 1999</date>.”</p>\n</content>\n</section>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"served_from":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"content_first_seen":{"label":"116-163","currency_date":"2020-10-02","congress":116,"law_num":163,"excluded_laws":[],"update_num":null,"seq":214,"is_partial":false,"caveat":null,"titles_affected":["01","02","03","06","07","08","10","15","17","18","21","22","23","26","28","31","35","36","38","40","42","45","49","50"],"ingested_titles":[]},"is_exact":true,"note":null}
