<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad21e922-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528"><num value="12528">§ 12528.</num><heading> Federal, State, and local contributions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad21e923-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a"><num value="a" class="bold">(a)</num><heading class="bold"> Corporation share</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad21e924-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Corporation share of the cost of carrying out a program for which a grant is made from an allotment under this part—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad21e925-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/1/A"><num value="A">(A)</num><content> for new grants may not exceed 80 percent of the total cost of the program for the first year of the grant period, 65 percent for the second year, and 50 percent for each remaining year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad21e926-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/1/B"><num value="B">(B)</num><content> for continuing grants, may not exceed 50 percent of the total cost of the program.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad21e927-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Noncorporation contribution</heading><chapeau style="-uslm-lc:I12" class="indent1">In providing for the remaining share of the cost of carrying out such a program, each recipient of such a grant under this part—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad21e928-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/2/A"><num value="A">(A)</num><content> shall provide for such share through a payment in cash or in kind, fairly evaluated, including facilities, equipment, or services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad21e929-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/2/B"><num value="B">(B)</num><content> except as provided in subparagraph (C), may provide for such share through Federal, State, or local sources, including private funds or donated services; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad21e92a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/a/2/C"><num value="C">(C)</num><content> may not provide for such share through Federal funds made available under title I of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6311">20 U.S.C. 6311</ref> et seq.) [<ref href="/us/usc/t20/s6301">20 U.S.C. 6301</ref> et seq.] or the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.).</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad22103b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12528/b"><num value="b" class="bold">(b)</num><heading class="bold"> Waiver</heading><content><p style="-uslm-lc:I11" class="indent0">The Chief Executive Officer may waive the requirements of subsection (a) in whole or in part with respect to any such program for any fiscal year, on a determination that such a waiver would be equitable due to a lack of resources at the local level.</p>
