<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8cdb4af-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594"><num value="12594">§ 12594.</num><heading> Living allowances for national service participants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4b0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a"><num value="a" class="bold">(a)</num><heading class="bold"> Provision of living allowance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Living allowance required</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraphs (2) and (3), a national service program carried out using assistance provided under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> shall provide to each participant who participates on a full-time basis in the program a living allowance in an amount equal to or greater than the average annual subsistence allowance provided to VISTA volunteers under <ref href="/us/usc/t42/s4955">section 4955 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Maximum living allowance</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in subsection (c), the total amount of an annual living allowance that may be provided to a participant in a national service program shall not exceed 200 percent of the average annual subsistence allowance provided to VISTA volunteers under <ref href="/us/usc/t42/s4955">section 4955 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Federal work-study students</heading><content><p style="-uslm-lc:I12" class="indent1">The living allowance that may be provided under paragraph (1) to an individual whose term of service includes hours for which the individual receives a Federal work-study award under part C of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t42/s2751">42 U.S.C. 2751</ref> et seq.) <ref class="footnoteRef" idref="fn003986">1</ref><note type="footnote" id="fn003986"><num>1</num> See References in Text note below.</note> shall be reduced by the amount of the individual’s Federal work study award.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Proration of living allowance</heading><content><p style="-uslm-lc:I12" class="indent1">The amount provided as a living allowance under this subsection shall be prorated in the case of a participant who is authorized to serve a term of service that is less than 12 months.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Waiver or reduction of living allowance</heading><chapeau style="-uslm-lc:I12" class="indent1">The Corporation may waive or reduce the requirement of paragraph (1) with respect to such national service program if such program demonstrates that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8cdb4b6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/5/A"><num value="A">(A)</num><content> such requirement is inconsistent with the objectives of the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8cdb4b7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/5/B"><num value="B">(B)</num><content> the amount of the living allowance that will be provided to each full-time participant is sufficient to meet the necessary costs of living (including food, housing, and transportation) in the area in which the program is located.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4b8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Exemption</heading><content><p style="-uslm-lc:I12" class="indent1">The requirement of paragraph (1) shall not apply to any program that was in existence on <date date="1993-09-21">September 21, 1993</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4b9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/b"><num value="b" class="bold">(b)</num><heading class="bold"> Coverage of certain employment-related taxes</heading><content><p style="-uslm-lc:I11" class="indent0">To the extent a national service program that receives assistance under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> is subject, with respect to the participants in the program, to the taxes imposed on an employer under sections 3111 and 3301 of title 26 and taxes imposed on an employer under a workmen’s compensation act, the assistance provided to the program under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> may be used to pay the taxes described in this subsection.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4ba-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exception from maximum living allowance for certain assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">A professional corps program described in <ref href="/us/usc/t42/s12572/c/1/D">section 12572(c)(1)(D) of this title</ref> that desires to provide a living allowance in excess of the maximum allowance authorized in subsection (a)(2) may still apply for such assistance, except that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8cdb4bb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/c/1"><num value="1">(1)</num><content> any assistance provided to the applicant under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> may not be used to pay for any portion of the allowance; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8cdb4bc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/c/2"><num value="2">(2)</num><content> the national service program shall be operated directly by the applicant and shall meet urgent, unmet human, educational, environmental, or public safety needs, as determined by the Corporation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4bd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/d"><num value="d" class="bold">(d)</num><heading class="bold"> Health insurance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4be-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A State or other recipient of assistance under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> shall provide or make available a basic health care policy for each full-time participant in a national service program carried out or supported using the assistance, if the participant is not otherwise covered by a health care policy. The Corporation shall establish minimum standards that all plans must meet in order to qualify for payment under this part, any circumstances in which an alternative health care policy may be substituted for the basic health care policy, and mechanisms to prohibit participants from dropping existing coverage.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4bf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Option</heading><content><p style="-uslm-lc:I12" class="indent1">A State or other recipient of assistance under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> may elect to provide from its own funds or make available a health care policy for participants that does not meet all of the standards established by the Corporation if the fair market value of such policy is equal to or greater than the fair market value of a plan that meets the minimum standards established by the Corporation, and is consistent with other applicable laws.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4c0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/e"><num value="e" class="bold">(e)</num><heading class="bold"> Child care</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4c1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Availability</heading><chapeau style="-uslm-lc:I12" class="indent1">A State or other recipient of assistance under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8cdb4c2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/e/1/A"><num value="A">(A)</num><content> make child care available for children of each full-time participant who needs child care in order to participate in a national service program carried out or supported by the recipient using the assistance; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8cdb4c3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/e/1/B"><num value="B">(B)</num><content> provide a child care allowance to each full-time participant in a national service program who needs such assistance in order to participate in the program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8cdb4c4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Guidelines</heading><content><p style="-uslm-lc:I12" class="indent1">The Corporation shall establish guidelines regarding the circumstances under which child care shall be made available under this subsection and the value of any allowance to be provided.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8cdb4c5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12594/f"><num value="f" class="bold">(f)</num><heading class="bold"> Individualized support services</heading><content><p style="-uslm-lc:I11" class="indent0">A State or other recipient of assistance under <ref href="/us/usc/t42/s12571">section 12571 of this title</ref> shall provide reasonable accommodation, including auxiliary aids and services (as defined in section 12102(1) <sup>1</sup> of this title), based on the individualized need of a participant who is a qualified individual with a disability (as defined in <ref href="/us/usc/t42/s12111/8">section 12111(8) of this title</ref>).</p>
