<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8d26f1c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619"><num value="12619">§ 12619.</num><heading> Administrative provisions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8d26f1d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/a"><num value="a" class="bold">(a)</num><heading class="bold"> Supervision</heading><chapeau style="-uslm-lc:I11" class="indent0">The Chief Executive Officer shall monitor and supervise the administration of the National Civilian Community Corps Program authorized to be established under <ref href="/us/usc/t42/s12612">section 12612 of this title</ref>. In carrying out this section, the Chief Executive Officer shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f1e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/a/1"><num value="1">(1)</num><content> approve such guidelines, including those recommended by the Board, for the design, selection of members, and operation of the National Civilian Community Corps as the Chief Executive Officer considers appropriate;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f1f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/a/2"><num value="2">(2)</num><content> evaluate the progress of the Corps in providing a basis for determining the matters set forth in <ref href="/us/usc/t42/s12611">section 12611 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f20-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/a/3"><num value="3">(3)</num><content> carry out any other activities determined appropriate by the Board.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8d26f21-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/b"><num value="b" class="bold">(b)</num><heading class="bold"> Monitoring and coordination</heading><chapeau style="-uslm-lc:I11" class="indent0">The Chief Executive Officer shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f22-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/b/1"><num value="1">(1)</num><content> monitor the overall operation of the National Civilian Community Corps;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f23-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/b/2"><num value="2">(2)</num><content> coordinate the activities of the Corps with other youth service programs administered by the Corporation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8d26f24-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/b/3"><num value="3">(3)</num><content> carry out any other activities determined appropriate by the Board.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8d26f25-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c"><num value="c" class="bold">(c)</num><heading class="bold"> Staff</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8d26f26-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Director</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f27-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Appointment</heading><content><p style="-uslm-lc:I13" class="indent2">Upon the establishment of the Program, the Chief Executive Officer shall appoint a Director. The Director may be selected from among retired commissioned officers of the Armed Forces of the United States.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f28-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I13" class="indent2">The Director shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8d26f29-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/B/i"><num value="i">(i)</num><content> design, develop, and administer the National Civilian Community Corps programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f2a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/B/ii"><num value="ii">(ii)</num><content> be responsible for managing the daily operations of the Corps; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f2b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/B/iii"><num value="iii">(iii)</num><content> report to the Chief Executive Officer.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f2c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Authority to employ staff</heading><content><p style="-uslm-lc:I13" class="indent2">The Director may employ such staff as is necessary to carry out this division. The Director shall, to the maximum extent practicable, utilize in staff positions personnel who are detailed from departments and agencies of the Federal Government and, to the extent the Director considers appropriate, shall request and accept detail of personnel from such departments and agencies in order to do so.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8d26f2d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Permanent cadre</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f2e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I13" class="indent2">The Chief Executive Officer shall establish a permanent cadre that includes the Director and other appointed supervisors and training instructors for National Civilian Community Corps programs.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f2f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Appointment</heading><content><p style="-uslm-lc:I13" class="indent2">The Chief Executive Officer shall consider the recommendations of the Director in appointing the other members of the permanent cadre.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f30-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Employment considerations</heading><chapeau style="-uslm-lc:I13" class="indent2">In appointing individuals to cadre positions, the Chief Executive Officer shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8d26f31-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C/i"><num value="i">(i)</num><content> give consideration to retired, discharged, and other inactive members and former members of the Armed Forces recommended under <ref href="/us/usc/t42/s12622/b">section 12622(b) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f32-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C/ii"><num value="ii">(ii)</num><content> give consideration to former VISTA, Peace Corps, and youth service program personnel;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f33-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C/iii"><num value="iii">(iii)</num><content> ensure that the cadre is comprised of males and females of diverse ethnic, economic, professional, and geographic backgrounds;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f34-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C/iv"><num value="iv">(iv)</num><content> give consideration to retired and other former law enforcement, fire, rescue, and emergency personnel, and other individuals with backgrounds in disaster preparedness, relief, and recovery; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8d26f35-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/C/v"><num value="v">(v)</num><content> consider applicants’ experience in other youth service programs.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f36-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Community service credit</heading><content><p style="-uslm-lc:I13" class="indent2">Service as a member of the cadre shall be considered as a community service opportunity for purposes of section 4403 of the National Defense Authorization Act for Fiscal Year 1993.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8d26f37-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/2/E"><num value="E" class="bold">(E)</num><heading class="bold"> Training</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall provide to other members of the permanent cadre appropriate training in youth development techniques, including techniques for working with and enhancing the development of disadvantaged youth, and the principles of service-learning. All members of the permanent cadre shall be required to participate in the training.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8d26f38-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Inapplicability of certain civil service laws</heading><content><p style="-uslm-lc:I12" class="indent1">The Director, other members of the permanent cadre, and the other staff personnel shall be appointed without regard to the provisions of title 5 governing appointments in the competitive service. The rates of pay of such persons may be established without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title. In the case of a member of the permanent cadre who was recommended for appointment in accordance with 12622(b)(1) <ref class="footnoteRef" idref="fn003990">1</ref><note type="footnote" id="fn003990"><num>1</num> So in original. <paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8d26f39-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12619/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Voluntary services</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law, the Director may accept the voluntary services of individuals. While away from their homes or regular places of business on the business of the Corps, such individuals may be allowed travel expenses, including per diem in lieu of subsistence, in the same amounts and to the same extent, as authorized under <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref> for persons employed intermittently in Federal Government service.</p>
